New Delhi, The Centre and Central Bureau of Investigation (CBI) today opposed a petition filed by Janata Party president Subramanian Swamy seeking investigation against Union Home Minister P Chidambaram for his alleged involvement in 2G spectrum scam.
A bench comprising Justices G S Singhvi and A K Ganguly was told by senior counsel K K Venugopal appearing for CBI that the Supreme Court has no jurisdiction to order police investigation against Mr Chidambaram.
Judges wanted to know whether the trial has started in the case or not. The court was told that the charges are yet to be framed by the trial court and the petitioner can approach the Special Court for the relief he is seeking.
Earlier, Dr Swamy appearing in person had contended that Mr Chidambaram who was then the Union Finance Minister had approved the decisions of former Telecom Minister A Raja in the allocation of licenses to service provider in January 2008.
The Janata Party president submitted before the court that the CBI should be directed to probe the role of Mr Chidambaram in 2G spectrum scam.
Arguments will continue tomorrow.
On what grounds CBI opposed was not clear.
If a person sits in the chair, he should be exempted for whatever does by him. Let PC resign, face investigation and comeback if proved to be innocent. However, the power of seat should not protect him nor should be trial be unduly delayed. At the same time, tempers should be cooled down.
