Accident victim’s kin get Rs 20.42L compensation

The family of a 31-year-old road mishap victim, who died 10 months after the accident involving an auto rickshaw, has been awarded a compensation of Rs 20.42 lakh by a Motor Accident Claims Tribunal (MACT).

The MACT asked United India Insurance Company Ltd, with which the offending vehicle was insured, to pay the money to the kin of Anil Kumar Tiwari, who had died in July 2011 due to injuries suffered in the accident on September 29, 2010.

“In view of the unrebutted testimony of the petitioners (victim’s family members) and the documents available on record, it is prima facie proved that the deceased died due to injuries suffered in the accident caused by rash and negligent driving of the respondent no.1 (auto driver),” MACT presiding officer Dinesh Bhatt said.

The order came on plea by victim’s family members, including his wife, minor daughter and aged parents for the compensation.

Tiwari, who was working with a private firm, was hit by an auto rickshaw when he was returning from work and was waiting for the bus near ISBT flyover at Kashmiri Gate here.

The offending vehicle being driven rashly and negligently hit Tiwari, who was rushed Aruna Asaf Ali Hospital, said the counsel for kin adding he eventually died on July 16, 2011 due to injuries suffered in the accident.

“There is however, no contrary evidence led by any party to the claim of the petitioner in respect of the fact that deceased died due to complication of injuries suffered by him in the accident in question,” the tribunal noted, while awarding the compensation to victim’s family members.
