Court asks Police CP to initiate probe against IO and prosecutor

A local court has asked Delhi Police Commissioner and the director of prosecution to initiate probe against a investigating officer (IO) and a law officer for delay in filing charge sheet in a chit fund case.

The order came after four accused, facing prosecution for offences of criminal breach of trust and criminal conspiracy in the case, filed a revision petition challenging the order of a magisterial court framing charges against them.

The accused had approached the sessions court against the order passed by the magistrate putting them on trial on the ground of delay of around three years in filing charge sheet against them by the IO.

Additional sessions judge Pulastya Pramachala set aside the order passed by the magistrate and directed Delhi Police Commissioner and director of prosecution to inquire into the matter regarding delay in filing of the final report.

“Accordingly, matter is referred to the Commissioner of Police, as well as Director of Prosecution to make their respective inquiry in respect of the role played by IO, as well as prosecution, to find out the justification in delay in filing of this charge sheet,” the judge said.

The court further said that both police and prosecution department should analyse the “quality” of probe conducted by the police and take appropriate action.

“… It is also expected that the quality of investigation done would be also analyzed by both agencies and appropriate steps and action would be taken,” the court said.

The court observed this while deciding revision petition filed by accused Surender Kumar Shukla, his wife and two of their relatives against whom a magistrate had framed charges under provisions of IPC, including section 406 IPC (criminal breach of trust) and section 120-B (criminal conspiracy).
