Court rejects plea against security to MPs facing criminal

A Delhi court today dismissed a plea seeking an order to restrain the police and other central forces from providing security to Member of Parliament (MPs) against whom criminal cases are pending.

The plea was filed in the court last year in which the petitioner had cited media reports that several MPs were elected in 2014 Lok Sabha elections and they would misuse the official position if they are provided with security cover.

Earlier, the Union Home Ministry had informed administrative civil judge Prashant Sharma that a similar issue pertaining to security provided to the lawmakers was pending adjudication before the Supreme Court.

The petition was filed by Delhi resident Satyavir Singh who had alleged that persons having criminal cases against them should not be provided security by the agencies.

He had alleged that after going through the media reports that some of the persons elected as MPs in the 2014 Lok Sabha election had criminal cases pending against them, he had approached Delhi Police seeking permission to sit on dharna at Jantar Mantar on this issue in May last year but permission was not granted to him.

In his plea, he had also sought a direction to the Ministry of Home Affairs and other security agencies that they should not provide security cover to MPs facing criminal cases.

  1. dear reader an accused is said to be innocent until charges are proved against him.on should. Even criminal undergoing sentence awarded to him has fundamental rights to himself though his movement are only restricted to the boundary of the prison. A parole granted to him is under the fundamental rights he owes.
Yes our election commision can take care to little more extent by making a declaration that if any criminal case is pending and charge sheet is submitted by IO than he should not be allowed to contest.
