New Delhi, There is no fear in the minds of perpetrators of crimes against women which have been rising on a daily basis, a Delhi court has said while sending a 20-year -old youth to jail for a year for outraging the modesty of a woman.

Special Judge Sanjeev Aggarwal handed over a one-year jail term to Central Delhi resident Abhimanyu while setting aside a magisterial court’s order acquitting him.

The judge held that the convict “had assaulted the victim and also outraged her modesty when she questioned him as to why he was following her on daily basis”.

“No ground for probation is made out in the present case, as Section 354 (assault or criminal force to woman with intent to outrage her modesty) of the IPC was amended…to curb this menace, as the crimes against women are increasing on daily basis without any fear in the minds of persons perpetuating the said crimes,” the court said.

In its order, the court also considered the fact that the convict was only 20 years of age at the time of the incident and was the only bread-earner of the family, saying, “interest of justice would be met if the convict is sentenced to rigorous imprisonment for one year.”

Besides, the court also held the convict guilty under section 323 (voluntarily causing hurt) IPC and imposed a fine of Rs 1,500 on him.

According to prosecution, the woman had filed a complaint on December 9, 2013, that she was working as nursing orderly and the youth had abused, assaulted and outraged her modesty.

She had claimed that for one year, the convict used to abuse her whenever he met her on the way.

The youth, however, had claimed innocence saying he had been falsely implicated in this case.
