Delhi HC dismisses petition for disqualification of Nomination for DUSU elections

Delhi High Court today dismissed the petition filed by three ABVP students of Delhi University who challenged the University’s decision to disqualify them from the students election scheduled for September 4.

The petition of three ABVP and two NSUI candidates was dismissed earlier on Tuesday but the ABVP candidates choose to appeal the HC again.

Refusing to hear the petition, a bench comprising Chief Justice A P Shah and Justice Manmohan held that the courts cannot interfere even in the assembly elections and this was just the students union election.

Their nomination was cancelled as they were found to have spent money in excess to that fixed of Rs 5,000, using cars and organising rallies for the election campaign, which was against the Lyngdoh committee recommendations.

Akhil Bhartiya Vidyarthi Parishad’s (ABVP) presidential candidate Rohit Chahal, along with Lalit Kumar, for the post of secretary and Ashok Khari, for Jt. Secretary, through their lawyer Ajay Digpaul asked the court to allow them to contest the elections as the decision of the DU to disqualify them was “arbitrary and unjustified”.
