Forum denies insurance claim for stolen vehicle

A consumer forum here has denied the insurance claim of a man for his stolen vehicle, noting that there was a delay of 46 days in intimidating about incident to the firm, which lost “a valuable right to investigate claim”.

Central Delhi District Consumer Disputes Redressal Forum, presided by Rakesh Kapoor, dismissed the plea of Delhi resident Naveen who had sought the insurance amount from the Oriental Insurance Company Ltd.

“Admittedly, the theft of the vehicle had taken place on April 29, 2012 and an FIR of the same was lodged on April 30, 2012. However, the insurance company was informed in writing about the loss only on June 14, 2012 by which time it had lost a valuable right to investigate the claim.

“We hold that the insurance company was justified in repudiating the claim of the complainant. We, therefore, see no merits in this complaint. The same is hereby dismissed,” it said.

Naveen had earlier told the forum that his scooty was stolen in April 2012 and an FIR was lodged in this regard.

He claimed that he had lodged the claim with the firm which had insured the scooty. However, the firm repudiated it on the ground that there was a violation of the terms and conditions of the policy of insurance. Thereafter, he filed a complaint with the forum.

The firm, however, claimed that intimation about the loss was given to it after a delay of 46 days and not within 48 hours as per the terms of the policy.
