The Delhi High Court Wednesday directed the Delhi government to frame within three weeks rules to provide free and compulsory education to children under the right to education law.
Taking note of an NGO’s plea seeking framing of rules to provide free and compulsory education, acting Chief Justice A.K. Sikri and Justice Rajiv Sahai Endlaw had earlier directed the Delhi government’s Principal (Secretary) Education Rakesh Mohan to be personally present before it.
Mohan was personally present in the court. His counsel informed the bench that the final rules had been approved by the Delhi cabinet Nov 4 and sent to the the lieutenant governor for assent Nov 8. These may be notified within three weeks.
The bench disposed off the petition saying: “The court notes that the notified rules were required for the implementation of the Right of Children to Free and Compulsory Education Act, 2011 and directed the government to notify the rules in three weeks, positively.”
The court was hearing a by NGO Social Jurist filed through its counsel Ashok Agarwal.
The petition said that the government did not seem to be serious about making and notifying rules as required under the act.
This had resulted in continuous violation of the right to education of lakhs of children in the capital, it said.
