Give Raj Bala’s autopsy report to her family: Supreme court

The Supreme Court Friday directed Delhi Police to give the post-mortem examination report of Raj Bala to her family. The Haryana resident was injured in the police crackdown on yoga guru Baba Ramdev’s gathering at Ramlila ground in Delhi in June and died earlier this week after being hospitalised for 114 days.

 

Raj Bala was one of the thousands who had thronged the Ramlila ground for Ramdev’s fast against corruption when police broke it up on the night of June 4-5. The 51-year-old woman succumbed to the injuries at a hospital here Monday.

 

The apex court bench of Justice B.S. Chauhan and Justice Swatanter Kumar issued the direction after counsel Kumud L. Das, appearing for Raj Bala’s family, told the court that despite their repeated requests police were not giving the post-mortem examination report.

Justice Swatanter Kumar told senior counsel Ram Jethmalani, appearing for Baba Ramdev, that the CD of the police action at Ramlila ground given to court by his client had a small portion depicting violence.

Justice Chauhan observed that the CD given to them “does not have violence”.

 The court’s observations came in the course of the hearing on the suo motu cognisance of the incident taken by the court.

 Jethmalani told the court that he was under the impression that the judges were to watch the CD together before the proceedings began. He said that he would like to see the CD first before commencing the arguments.

 

He said he wanted some people to be cross-examined. The court said that he could name them in the next hearing and court would look into it. The hearing was adjourned till Oct 17.

 

Raj Bala’s son Anil Malik also filed an affidavit in which he recounted the entire sequence of the police action and all that happened in the hospital during his mother’s treatment.

 He told the court that police were yet to register a first information report on his complaint which he had lodged at Kamla Market police station June 6, seeking action against those responsible for inflicting “serious injuries” to his mother.
