New Delhi: Taking a cue from the central government in the 2G case, the Gujarat government on Tuesday asked the Supreme Court to stop monitoring the trial in the 2002 riot cases.
Supreme Court bench headed by justice DK Jain was told by senior counsel Mukul Rohtagi that according to the rules, monitoring should come to an end after the chargesheet has been filed. However, the court said that the trial was being monitored by the Special Investigation Team for the last two years and there was no change in circumstances to go back on that decision.
The central government has asked the Supreme Court to stop monitoring in the 2G scam case as the chargesheet has already been filed by the CBI in the trial court. The government has taken the position that monitoring should come to an end after filing of the chargesheet.
When the case against individuals has to be finalised wihin 2 years as per law of the land, who will monitor such cases. The learned counsels in different cases have not stated nor statute had authorised anybody to monitor the cases. Atleast the Apex Court had taken up the issue for monitoring the cases.
