The Lucknow bench of the Allahabad High Court today took a serious note of “objectionable” language used by some leaders of political parties and observed that it is for the court to decide the limits to ‘right to freedom of speech’ as enshrined in the Constitution.

The court also invited the designated senior advocates of Oudh Bar Association (OBA) to put forth their points of view on the issue.

However, it reserved its order on the maintainability of a public interest litigation (PIL) on the matter.

“Can you say anything invoking right to freedom of speech and expression? What are the limits? We will decide them,” said a division bench of Justices Amreshwar Pratap Sahi and Vijay Laxmi in open court while hearing a PIL filed by Mamta Jindal, a social worker.

The petitioner has sought directions for action against officials of the district administration for allowing the BSP to stage a protest against expelled BJP leader Dayashankar Singh at Hazratganj here on July 21. The protesters allegedly used abusive language against women members of Singh’s family.

The petition claimed that without permission, this kind of protests were not permissible.
