HC rejects PIL for blocking sites selling sex determination

The Delhi High Court today rejected a PIL seeking directions to the Centre to block sites which provide information on or sell pre-natal sex determination kits, saying there is already a remedy available under the law.

A bench of Chief Justice G Rohini and Justice R S Endlaw refused to entertain the petition which alleged “pathetic inaction” on the part of the government in “curbing” import and search of pre-natal gender determination tests and kits online.

“There is already a remedy available under the law for prayers sought in the petition. We are not inclined to entertain the petition,” the court said.

The petition, filed by Nandita Bansal through advocate Gaurav Kumar Bansal, had claimed if there is no intervention from the government, entire purpose of the Pre-Conception and Pre-Natal Diagnostic Techniques (PNDT) Act would be defeated.

Under the PNDT Act, pre-natal sex determination is banned.

The petition had claimed there were several online stores, which sells such kits for prices ranging from USD 19 to USD 500.

These tests or kits are packed in the US, where sex determination is legal, and are transported here, it had said.
