HC to hear petition challenging Lokpal Bill tomorrow

New Delhi, Aug 31 A petition challenging the government’s action to present Gandhian Anna Hazare’s as well as its own Lokpal Bill in Parliament has been filed in the Delhi High Court and is slated to come up for hearing tomorrow.

 

The petition filed by Delhi-based lawyer Manohar Lal Sharma has alleged that the drafting of the Lokpal BillS done in both the bills-Anna’s as well as Government’s own- has been done in an unconstitutional manner as the committee drafting it comprises of members who are from the civil society.

 

The petition will come up for hearing before the bench of Justices Vikramajit Sen and Siddharth Mridul tomorrow (September 1).

 

The petitioner has urged the court to declare Centre’s act of introduction of Lokpal bills in Parliament as unconstitutional as it violated the parliamentary procedures laid down for introduction of Lokpal bills (government as well as private ones).

 

The Government has followed an unprecedented and unconstitutional procedure to draft the Bill by a drafting committee, the petitioner alleged, adding that the committee comprised of civil society members, whereas Parliamentarians are only empowered to draft the bills, the petitioner urged.

 

Urging the court to declare the introduction of both the Lokpal bills as unconstitutional, the petitioner urged the court to direct the government to bring a fresh Lokpal Bill as per the guidelines laid down by Parliament.
