No criminal offence made out against Dikshit

dixitThe Delhi Police on Thursday told a city court that no criminal offence is made out against Chief Minister Sheila Dikshit in BJP leader Vijender Gupta’s complaint against her for allegedly misusing government funds in an advertisement campaign ahead of the 2008 Assembly polls.
Filing its status report in the case before Special Judge Narottam Kaushal, police said: “Since the allegations do not constitute a criminal offence, there is no basis for police to carry out any enquiry/investigation into the complaint.”

 However, Gupta’s counsel raised objection on the status report saying the police has not disclosed the steps taken it on the complaint.

The court took note of the submissions of Gupta’s counsel, saying: “I have also gone through the report. I am satisfied that the report does not disclose steps taken by the investigating agency on allegations made in the complaint.”

The judge then directed the police to submit a fresh status report by Aug 17 on the steps taken in pursuance of Gupta’s complaint.

The investigating agency filed status report in compliance with a July 10 court order.

The report also It also said that in the absence of any guideline for circulation of advertisements, it is difficult to infer that any criminal offence has been committed.

In his complaint, Gupta has sought registration of FIR against Dikshit and others for alleged criminal breach of trust (section 409 IPC), criminal misappropriation of public funds and criminal misconduct under provisions of the Prevention of Corruption Act.
