Poll code case: Court to decide plea seeking probe documents

The Ahmedabad rural court is likely to decide the plea of an Aam Aadmi Party (AAP) worker on November 14, seeking probe documents on the basis of which the city crime branch had given a “clean chit” to Prime Minister Narendra Modi in an alleged poll code violation case.

Chief Judicial Magistrate U C Bhatt of Ahmedabad rural court heard the contentions of the applicant AAP member Nishant Verma as well as the Detection of crime branch (DCB) and posted the case for further hearing to November 14.

AAP member Nishant Verma’s advocate K R Koshti submitted that the court should ask for documents comprising statements of witnesses, map of the place and other electronic evidence on the basis of which the probe agency has filed a closure report in the poll code violation case.

On behalf of the state of Gujarat and the DCB, public prosecutor H R Kapadia opposed the applicant’s demand stating that he should approach the Ahmedabad metropolitan court, where the closure report was filed.

On August 9, the DCB had filed a closure report in the alleged poll code violation case and given Modi a “clean chit”.

The public prosecutor contended that the applicant should exhaust other alternative remedies like filing an RTI application to get those documents.

Earlier, the court had earlier directed the applicant to make a submission on whether the closure summary report of the city crime branch in the metropolitan court is just, fair as well as proper and if they could argue on the report filed in another court.

In his plea, Verma had alleged that the police had lodged an incomplete FIR. He had sought additional charges against Modi for displaying the BJP symbol on polling day.
