Regularised daily wagers entitled to all benefits: Court

Daily-wage employees, who have been regularised in government service, cannot be denied access to benefits enjoyed by permanent government servants, the Gujarat High Court ruled Friday.

The ruling was made by a division bench of Justices D.H. Waghela and K.A. Puj while dismissing the state government’s appeal against a single judge’s order.

Mahendrakumar Bhagwandas and others had entered government service as daily wage employees and were regularised in their service under a 1988 government resolution.

Most of the benefits which were available to the regular government servants were extended to them. However, some benefits such as encashment of leave, leave travel allowance, travelling allowance, uniform allowance and others were denied to them by the government.

These employees went to court and secured a ruling for parity in treatment but the government appealed.

The division bench, however, considering all aspects dismissed the appeal and upheld the treating of the employees concerned as permanent employees. The court also held that they be treated at par with other employees and granted all benefits.

    I am working in Central Institute of Mining & Fuel Research (an authmonous body of Govt. of India, CSIR, New Delhi) as a Computer Operator. I am working in Stores & Purchase Section from last 9 years and 10 months. I am doing my work regularly without any interruption or leave. But me with other 162 daily wages do not get the complete medical facility, counter payment or bank payment, leave and bonus with other facilities which have been providing to permanent staffs.
    I, therefore, want to know what facility should we get. And tell me the process to obtain the same.
