SC poser on government nod preceding graft probes

The Supreme Court Wednesday asked the central government why its sanction was necessary for the investigation of its officials by the CBI in corruption cases being monitored by the court.

An apex court bench headed by Justice R.M. Lodha sought the government’s response in respect of the court-monitored corruption cases as it (government) strongly resisted the dilution of its power under Section 6a of Delhi Special Police Establishment Act that mandates sanction of the government to investigate officers facing corruption charges.

The court’s poser came as Attorney General G.E. Vahanvati told it that taking away the government’s power under the Act would have serious consequences as a whole lot of cases were being monitored by the apex court and the various high courts.

The court was hearing public interest litigation petitions related to coal blocks allotment.
