Youth gets life term for murder in New Delhi

A 26-year-old youth has been sentenced to life imprisonment for murder by a Delhi court, which said the incident was “indicative of a pre-meditated plan” to kill the victim.

Additional Sessions Judge Savita Rao handed down the jail term to one Karan, a west Delhi resident, for the offences under sections 302 read with 149 (murder committed in unlawful assembly) and 147 and 148(rioting) of the IPC.

The court also imposed a fine of Rs 5,000 on Karan, who along with five other boys had gheraoed victim Mukesh and his friends in 2007 and stabbed him to death.

“Considering the reliable testimony of eye witnesses and the death of Mukesh having been caused by stab injuries, there remains no doubt that the injuries were inflicted with intention of causing death or at least with the knowledge that such injuries were likely to cause death,” the judge said.

While relying on the statements of the eye witnesses, the court said the incident was “indicative of pre?meditated plan from the side of accused persons and not result of any sudden or grave provocation or arising out of any such circumstances leading the quarrel to the extent by which even death of one person was caused.

“Prosecution has succeeded in proving that Karan was a member of unlawful assembly, common object of which was to commit the murder of Mukesh and he also committed the offence of rioting by using force and violence as well as voluntarily caused hurt on the persons of other prosecution witnesses. Accordingly, he is held guilty and convicted…” the judge said.

According to prosecution, in 2007, the victim and his friends Rajnish and Sanjeev had met one Ajay Malhotra, who got them engaged with a TV channel for an event at a remuneration of around Rs 2200. It further said that this amount was not paid by Malhotra for two months despite repeated requests.

On March 18, 2007 Malhotra called Mukesh, Rajnish and Sanjeev to Shadipur here to collect the money, but when they reached, a group of men surrounded them.

Rajnish, who was an eye witness, deposed that Malhotra, with six of his associates including Karan, beat them up leading to Mukesh’s death.
