The registration of a Geographical Indication shall be for a period of ten years but may be renewed from time to time for an unlimited period by payment of the renewal fees. If it is not renewed it is liable to be removed from the register.
The benefits of GI registration are following –
• It prevents unauthorized use of a registered Geographical Indication goods by third parties.
• It boosts exports
• It promotes economic prosperity of producers.
• Only an authorized user has the exclusive rights to use the geographical indication in relation to goods in respect of which it is registered.
A geographical indication (GI) is a sign used on products that have a specific geographical origin and possess qualities or a reputation that are due to that origin. In order to function as a GI, a sign must identify a product as originating in a given place.
A Geographical Indications Registry has been established in Chennai for the purpose of administering the legislation. Appeal against the Registrar’s decision would be to the Intellectual Property Appellate Board established under the Trade Marks legislation.
