Appellate Tribunal.-(1) Subject to the provisions of this Act,<\/p>\n<p align=\"left\">the Appellate Tribunal established under section 110 of the<\/p>\n<p align=\"left\">Electricity Act, 2003 (36 of 2003) shall be the Appellate Tribunal<\/p>\n<p align=\"left\">for the purposes of this Act and the said Appellate Tribunal shall<\/p>\n<p align=\"left\">exercise the jurisdiction, powers and authority conferred on it by or<\/p>\n<p align=\"left\">under this Act:<\/p>\n<p align=\"left\">Provided that the Technical Member of the Appellate Tribunal for the<\/p>\n<p align=\"left\">purposes of this Act shall be called the Technical Member (Petroleum<\/p>\n<p align=\"left\">and Natural Gas) and shall have the qualifications specified in subsection<\/p>\n<p align=\"left\">(2) of section 31.<\/p>\n<p align=\"left\">(2) Notwithstanding anything contained in the Electricity Act, 2003<\/p>\n<p align=\"left\">(36 of 2003), the Central Government may, for the purposes of this<\/p>\n<p align=\"left\">Act, appoint one or more Technical Members (Petroleum and Natural<\/p>\n<p align=\"left\">Gas) on the Appellate Tribunal for Electricity or designate a<\/p>\n<p align=\"left\">Technical Member of the said Tribunal having the qualifications<\/p>\n<p align=\"left\">specified in sub-section (2) of section 31 and when a Technical<\/p>\n<p align=\"left\">Member (Petroleum and Natural Gas) is appointed, he shall be in<\/p>\n<p align=\"left\">addition to the three other members appointed under the said Act.<\/p>\n<p align=\"left\">31.<\/p>\n<p align=\"left\">Technical Member (Petroleum and Natural Gas).<\/p>\n<p align=\"left\">31. Technical Member (Petroleum and Natural Gas).-(1) The Technical<\/p>\n<p align=\"left\">Member (Petroleum and Natural Gas) shall be appointed from the panel<\/p>\n<p align=\"left\">prepared by the Search Committee constituted under sub-section (2) of<\/p>\n<p align=\"left\">section 4.<\/p>\n<p align=\"left\">(2) A person shall not be qualified for appointment as a Technical<\/p>\n<p align=\"left\">Member (Petroleum and Natural Gas) of the Appellate Tribunal unless<\/p>\n<p align=\"left\">he-<\/p>\n<p align=\"left\">(i) is, or has been, a Secretary for at least one year in the<\/p>\n<p align=\"left\">Ministry or Department of the Central Government having adequate<\/p>\n<p align=\"left\">experience in energy sector, especially in matters relating to<\/p>\n<p align=\"left\">Petroleum and Natural Gas sector; or<\/p>\n<p align=\"left\">(ii) is, or has been, a person of ability and standing, having<\/p>\n<p align=\"left\">adequate knowledge or experience in dealing with matters relating to<\/p>\n<p align=\"left\">exploration, production, transmission pipelines, marketing or<\/p>\n<p align=\"left\">regulation of petroleum, petroleum products or natural gas,<\/p>\n<p align=\"left\">economics, commerce, law or management.<\/p>\n<p align=\"left\">32.<\/p>\n<p align=\"left\">Terms and conditions of service of Technical Member (Petroleum and<\/p>\n<p align=\"left\">Natural Gas).<\/p>\n<p align=\"left\">32. Terms and conditions of service of Technical Member (Petroleum<\/p>\n<p align=\"left\">and Natural Gas).-The term of office, the salaries and allowances<\/p>\n<p align=\"left\">payable to and the other terms and conditions of service of the<\/p>\n<p align=\"left\">Technical Member (Petroleum and Natural Gas) shall be the same as<\/p>\n<p align=\"left\">applicable to the other members of the Appellate Tribunal.<\/p>\n<p align=\"left\">33.<\/p>\n<p align=\"left\">Appeals to Appellate Tribunal.<\/p>\n<p align=\"left\">33. Appeals to Appellate Tribunal.-(1) Any person aggrieved by an<\/p>\n<p align=\"left\">order or decision made by the Board under this Act may prefer an<\/p>\n<p align=\"left\">appeal to the Appellate Tribunal:<\/p>\n<p align=\"left\">Provided that any person preferring an appeal against an order or<\/p>\n<p align=\"left\">decision of the Board levying any penalty shall, while filing the<\/p>\n<p align=\"left\">appeal, deposit the amount of such penalty:<\/p>\n<p align=\"left\">Provided further that where in any particular case, the Appellate<\/p>\n<p align=\"left\">Tribunal is of the opinion that deposit of such penalty would cause<\/p>\n<p align=\"left\">undue hardship to such person, it may dispense with such deposit<\/p>\n<p align=\"left\">subject to such conditions as it may deem fit to impose so as to<\/p>\n<p align=\"left\">safeguard the realisation of penalty.<\/p>\n<p align=\"left\">(2) Every appeal under sub-section (1) shall be filed within a period<\/p>\n<p align=\"left\">of thirty days from the date on which a copy of the direction or<\/p>\n<p align=\"left\">order of decision made by the Board is received by the aggrieved<\/p>\n<p align=\"left\">person and it shall be in such form, verified in such manner and be<\/p>\n<p align=\"left\">accompanied by such fee as may be prescribed:<\/p>\n<p align=\"left\">Provided that the Appellate Tribunal may entertain an appeal after<\/p>\n<p align=\"left\">the expiry of the said period of thirty days if it is satisfied that<\/p>\n<p align=\"left\">there was sufficient cause for not filing it within that period.<\/p>\n<p align=\"left\">(3) On receipt of an appeal under sub-section (1), the Appellate<\/p>\n<p align=\"left\">Tribunal may, after giving the parties an opportunity of being heard,<\/p>\n<p align=\"left\">pass such orders thereon as it thinks fit.<\/p>\n<p align=\"left\">(4) The Appellate Tribunal shall send a copy of every order made by<\/p>\n<p align=\"left\">it to the parties to the appeal and to the Board.<\/p>\n<p align=\"left\">(5) The appeal filed under sub-section (1) shall be dealt with by the<\/p>\n<p align=\"left\">Appellate Tribunal as expeditiously as possible and endeavour shall<\/p>\n<p align=\"left\">be made by it to dispose of the appeal finally within ninety days<\/p>\n<p align=\"left\">from the date of receipt of appeal:<\/p>\n<p align=\"left\">Provided that where any such appeal could not be disposed of within<\/p>\n<p align=\"left\">the said period of ninety days, the Appellate Tribunal shall record<\/p>\n<p align=\"left\">its reasons in writing for not disposing of the appeal within the<\/p>\n<p align=\"left\">said period.<\/p>\n<p align=\"left\">(6) The Appellate Tribunal may, for the purpose of examining the<\/p>\n<p align=\"left\">legality or propriety or correctness of any order or decision of the<\/p>\n<p align=\"left\">Board referred to in the appeal filed under sub-section (1), either<\/p>\n<p align=\"left\">on its own motion or otherwise, call for the records relevant to<\/p>\n<p align=\"left\">disposing of such appeal and make such orders as it thinks fit.<\/p>\n<p align=\"left\">34.<\/p>\n<p align=\"left\">Procedure and powers of the Appellate Tribunal.<\/p>\n<p align=\"left\">34. Procedure and powers of the Appellate Tribunal.-The provisions of<\/p>\n<p align=\"left\">sections 120 to 124 (both inclusive) of the Electricity Act, 2003 (36<\/p>\n<p align=\"left\">of 2003) shall mutatis mutandis apply to the Appellate Tribunal in<\/p>\n<p align=\"left\">the discharge of its functions under this Act as they apply to it in<\/p>\n<p align=\"left\">the discharge of its functions under the Electricity Act, 2003.<\/p>\n<p align=\"left\">35.<\/p>\n<p align=\"left\">Power of Appellate Tribunal to make rules.<\/p>\n<p align=\"left\">35. Power of Appellate Tribunal to make rules.-The Appellate Tribunal<\/p>\n<p align=\"left\">may, by notification, make rules consistent with the provisions of<\/p>\n<p align=\"left\">this Act as to the conduct and procedure in respect of all<\/p>\n<p align=\"left\">proceedings before it under this Act.<\/p>\n<p align=\"left\">36.<\/p>\n<p align=\"left\">Orders passed by Appellate Tribunal to be executable as a decree.<\/p>\n<p align=\"left\">36. Orders passed by Appellate Tribunal to be executable as a<\/p>\n<p align=\"left\">decree.-(1) Every order made by the Appellate Tribunal under this Act<\/p>\n<p align=\"left\">shall be executable by the Appellate Tribunal as a decree of a civil<\/p>\n<p align=\"left\">court, and for this purpose, the Appellate Tribunal shall have all<\/p>\n<p align=\"left\">the powers of a civil court.<\/p>\n<p align=\"left\">(2) Notwithstanding anything contained in sub-section (1), the<\/p>\n<p align=\"left\">Appellate Tribunal may transmit any order made by it to a civil court<\/p>\n<p align=\"left\">having jurisdiction and such civil court shall execute the order as<\/p>\n<p align=\"left\">if it were a decree made by that court.<\/p>\n<p align=\"left\">37.<\/p>\n<p align=\"left\">Appeal to Supreme Court.<\/p>\n<p align=\"left\">37. Appeal to Supreme Court.-(1) Notwithstanding anything contained<\/p>\n<p align=\"left\">in the Code of Civil Procedure, 1908 (5 of 1908) or in any other law,<\/p>\n<p align=\"left\">an appeal shall lie against any order, not being an interlocutory<\/p>\n<p align=\"left\">order, of the Appellate Tribunal to the Supreme Court on one or more<\/p>\n<p align=\"left\">of the grounds specified in section 100 of that Code.<\/p>\n<p align=\"left\">(2) No appeal shall lie against any decision or order made by the<\/p>\n<p align=\"left\">Appellate Tribunal with the consent of the parties.<\/p>\n<p align=\"left\">(3) Every appeal under this section shall be preferred within a<\/p>\n<p align=\"left\">period of ninety days from the date of the decision or order appealed<\/p>\n<p align=\"left\">against:<\/p>\n<p align=\"left\">Provided that the Supreme Court may entertain the appeal after the<\/p>\n<p align=\"left\">expiry of the said period of ninety days, if it is satisfied that the<\/p>\n<p align=\"left\">appellant was prevented by sufficient cause from preferring the<\/p>\n<p align=\"left\">appeal in time.<\/p>\n<p align=\"left\"><strong><span style=\"text-decoration: underline;\">CHAPTER VII<\/span><\/strong><\/p>\n<p align=\"left\"><strong><span style=\"text-decoration: underline;\">FINANCE, ACCOUNTS AND AUDIT<\/span><\/strong><\/p>\n<p align=\"left\">38. Grants by Central Government.-The Central Government may, after<\/p>\n<p align=\"left\">due appropriation made by Parliament by law in this behalf, make to<\/p>\n<p align=\"left\">the Board grants of such sums of money as are required to pay<\/p>\n<p align=\"left\">salaries and allowances payable to the Chairperson and the other<\/p>\n<p align=\"left\">members and the administrative expenses including the salaries,<\/p>\n<p align=\"left\">allowances and pensions payable to the officers and employees of the<\/p>\n<p align=\"left\">Board.<\/p>\n<p align=\"left\">39.<\/p>\n<p align=\"left\">Fund.<\/p>\n<p align=\"left\">39. Fund.-(1) There shall be constituted a Fund to be called the<\/p>\n<p align=\"left\">Petroleum and Natural Gas Regulatory Board Fund and there shall be<\/p>\n<p align=\"left\">credited thereto-<\/p>\n<p align=\"left\">(i) all grants, fees, penalties and charges received by the Board<\/p>\n<p align=\"left\">under this Act; and<\/p>\n<p align=\"left\">(ii) all sums received by the Board from such other sources as may be<\/p>\n<p align=\"left\">approved by the Central Government.<\/p>\n<p align=\"left\">(2) The Fund shall be applied for making payments towards-<\/p>\n<p align=\"left\">(i) the salaries and allowances payable to the Chairperson and other<\/p>\n<p align=\"left\">members and the administrative expenses including the salaries,<\/p>\n<p align=\"left\">allowances and pensions payable to the officers and employees of the<\/p>\n<p align=\"left\">Board;<\/p>\n<p align=\"left\">(ii) the expenses incurred or to be incurred in carrying out the<\/p>\n<p align=\"left\">provisions of this Act.<\/p>\n<p align=\"left\">(3) The Central Government shall-<\/p>\n<p align=\"left\">(i) constitute a committee consisting of such persons as it thinks<\/p>\n<p align=\"left\">fit to recommend to that Government the budgetary requirements of the<\/p>\n<p align=\"left\">Board for salaries, allowances and all other expenses; and<\/p>\n<p align=\"left\">(ii) fix the budgetary ceiling of the Board on the basis of the<\/p>\n<p align=\"left\">recommendations of the committee.<\/p>\n<p align=\"left\">40.<\/p>\n<p align=\"left\">Accounts and audit.<\/p>\n<p align=\"left\">40. Accounts and audit.-(1) The Board shall maintain proper accounts<\/p>\n<p align=\"left\">and other relevant records and prepare an annual statement of<\/p>\n<p align=\"left\">accounts in such form as may be prescribed by the Central Government<\/p>\n<p align=\"left\">in consultation with the Comptroller and Auditor-General of India.<\/p>\n<p align=\"left\">(2) The accounts of the Board shall be audited by the Comptroller and<\/p>\n<p align=\"left\">Auditor-General of India at such intervals as may be specified by him<\/p>\n<p align=\"left\">and any expenditure incurred in connection with such audit shall be<\/p>\n<p align=\"left\">payable by the Board to the Comptroller and Auditor-General of India.<\/p>\n<p align=\"left\">Explanation.-For the removal of doubts, it is hereby declared that<\/p>\n<p align=\"left\">the decisions of the Board taken in the discharge of its functions<\/p>\n<p align=\"left\">under this Act, being matters appealable to the Appellate Tribunal,<\/p>\n<p align=\"left\">shall not be subject to audit under this section.<\/p>\n<p align=\"left\">(3) The Comptroller and Auditor-General of India or any other person<\/p>\n<p align=\"left\">appointed by him in connection with the audit of the accounts of the<\/p>\n<p align=\"left\">Board shall have the same rights and privileges and authority in<\/p>\n<p align=\"left\">connection with the audit of the Government accounts and, in<\/p>\n<p align=\"left\">particular, shall have the right to demand the production of books,<\/p>\n<p align=\"left\">accounts, connected vouchers and other documents and papers and<\/p>\n<p align=\"left\">inspection of offices of the Board.<\/p>\n<p align=\"left\">(4) The accounts of the Board as certified by the Comptroller and<\/p>\n<p align=\"left\">Auditor-General of India or any other person appointed by him in this<\/p>\n<p align=\"left\">behalf together with the audit report thereon shall be forwarded<\/p>\n<p align=\"left\">annually to the Central Government and that Government shall cause<\/p>\n<p align=\"left\">the same to be laid before each House of Parliament.<\/p>\n<p align=\"left\">41.<\/p>\n<p align=\"left\">Annual report and its laying before Parliament.<\/p>\n<p align=\"left\">41. Annual report and its laying before Parliament.-(1) The Board<\/p>\n<p align=\"left\">shall prepare once every year in such form and at such time as may be<\/p>\n<p align=\"left\">prescribed, an annual report giving a summary of its activities<\/p>\n<p align=\"left\">including information relating to the proceedings and policies during<\/p>\n<p align=\"left\">the previous years and such report shall also contain statements of<\/p>\n<p align=\"left\">annual accounts of the Board.<\/p>\n<p align=\"left\">(2) A copy of the report shall be forwarded to the Central Government<\/p>\n<p align=\"left\">and the Central Government shall cause such report to be laid, as<\/p>\n<p align=\"left\">soon as may be after it is received, before each House of Parliament.<\/p>\n<p align=\"left\"><strong><span style=\"text-decoration: underline;\">CHAPTER VIII<\/span><\/strong><\/p>\n<p align=\"left\"><strong><span style=\"text-decoration: underline;\">POWER OF CENTRAL GOVERNMENT<\/span><\/strong><\/p>\n<p align=\"left\">42. Power of Central Government to issue directions.-(1) The Central<\/p>\n<p align=\"left\">Government may, from time to time, by writing issue to the Board such<\/p>\n<p align=\"left\">directions as it may think necessary in the interest of the<\/p>\n<p align=\"left\">sovereignty and integrity of India, the security of the State,<\/p>\n<p align=\"left\">friendly relations with foreign States or public order.<\/p>\n<p align=\"left\">(2) Without prejudice to the foregoing provision, the Central<\/p>\n<p align=\"left\">Government may, if it finds necessary or expedient so to do in public<\/p>\n<p align=\"left\">interest or for maintaining or increasing supplies of petroleum,<\/p>\n<p align=\"left\">petroleum products or natural gas or all or any of them or for<\/p>\n<p align=\"left\">securing their equitable distribution and ensuring adequate<\/p>\n<p align=\"left\">availability, issue policy directives to the Board in writing and<\/p>\n<p align=\"left\">such policy directives shall be binding upon the Board:<\/p>\n<p align=\"left\">Provided that no such directive shall relate to any day-to-day<\/p>\n<p align=\"left\">affairs of the Board:<\/p>\n<p align=\"left\">Provided further that the Board shall, as far as practicable, be<\/p>\n<p align=\"left\">given an opportunity of expressing its views before any directive is<\/p>\n<p align=\"left\">issued under this sub-section.<\/p>\n<p align=\"left\">(3) The decision of the Central Government whether a question is one<\/p>\n<p align=\"left\">of policy or not shall be final.<\/p>\n<p align=\"left\">43.<\/p>\n<p align=\"left\">Taking over control and management of facilities and business<\/p>\n<p align=\"left\">premises of any entity and retail outlets in public interest.<\/p>\n<p align=\"left\">43. Taking over control and management of facilities and business<\/p>\n<p align=\"left\">premises of any entity and retail outlets in public interest.-(1) In<\/p>\n<p align=\"left\">the event of war or natural calamity or such other similar<\/p>\n<p align=\"left\">circumstances leading to disruption of supply of petroleum, petroleum<\/p>\n<p align=\"left\">products or natural gas, the Central Government may, for ensuring the<\/p>\n<p align=\"left\">continuous supply of petroleum, petroleum products or natural gas, by<\/p>\n<p align=\"left\">notification, either take over the control and management of any<\/p>\n<p align=\"left\">storage site, facilities and business premises of any entity and<\/p>\n<p align=\"left\">retail outlets or suspend its operations or entrust, to any agency of<\/p>\n<p align=\"left\">the Central or State Government for such time and manage it in such<\/p>\n<p align=\"left\">manner, as may be specified in that notification:<\/p>\n<p align=\"left\">Provided that the affected entities shall be given an opportunity of<\/p>\n<p align=\"left\">being heard before issuing orders to take over the control and<\/p>\n<p align=\"left\">management of retail outlets and other business premises:<\/p>\n<p align=\"left\">Provided further that in case of any urgency or in cases where the<\/p>\n<p align=\"left\">circumstances do not permit serving of notice for want of sufficient<\/p>\n<p align=\"left\">time or otherwise upon the entity against whom the order is directed,<\/p>\n<p align=\"left\">the opportunity of hearing may be dispensed with in public interest<\/p>\n<p align=\"left\">in order to maintain the uninterrupted supply of petroleum, petroleum<\/p>\n<p align=\"left\">products or natural gas for a specified period.<\/p>\n<p align=\"left\">(2) The collector of the revenue district in which the property<\/p>\n<p align=\"left\">referred to in the notification issued under sub-section (1) is<\/p>\n<p align=\"left\">situated shall determine the amount of compensation payable for<\/p>\n<p align=\"left\">taking over of the property.<\/p>\n<p align=\"left\">(3) The form and manner in which an application for claiming<\/p>\n<p align=\"left\">compensation under this section shall be made, the procedure for<\/p>\n<p align=\"left\">determining the compensation and the time within which such<\/p>\n<p align=\"left\">compensation shall be payable, shall be such as may be prescribed.<\/p>\n<p>\u00a0<\/p>\n<p align=\"left\"><strong><span style=\"text-decoration: underline;\">CHAPTER IX<\/span><\/strong><\/p>\n<p align=\"left\"><strong><span style=\"text-decoration: underline;\">OFFENCES AND PUNISHMENT<\/span><\/strong><\/p>\n<p align=\"left\">44. Punishment for contravention of directions of the Board.-If a<\/p>\n<p align=\"left\">person contravenes the directions of the Board, such person shall be<\/p>\n<p align=\"left\">punishable with fine which may extend to twenty-five crore rupees and<\/p>\n<p align=\"left\">in case of continuing contravention with additional fine which may<\/p>\n<p align=\"left\">extend to ten lakh rupees for every day during which the<\/p>\n<p align=\"left\">contravention continues.<\/p>\n<p align=\"left\">45.<\/p>\n<p align=\"left\">Penalty for willful failure to comply with orders of Appellate<\/p>\n<p align=\"left\">Tribunal.<\/p>\n<p align=\"left\">45. Penalty for willful failure to comply with orders of Appellate<\/p>\n<p align=\"left\">Tribunal.-If any person wilfully fails to comply with the order of<\/p>\n<p align=\"left\">the Appellate Tribunal, he shall be punishable with fine which may<\/p>\n<p align=\"left\">extend to one crore rupees and in case of a second or subsequent<\/p>\n<p align=\"left\">offence with fine which may extend to two crore rupees and in the<\/p>\n<p align=\"left\">case of continuing contravention with additional fine which may<\/p>\n<p align=\"left\">extend to twenty lakh rupees for every day during which such default<\/p>\n<p align=\"left\">continues.<\/p>\n<p align=\"left\">46.<\/p>\n<p align=\"left\">Punishment for unauthorized activities.<\/p>\n<p align=\"left\">46. Punishment for unauthorized activities.-If any person, being an<\/p>\n<p align=\"left\">entity, markets any notified petroleum, petroleum products or natural<\/p>\n<p align=\"left\">gas without a valid registration, or authorisation such person shall<\/p>\n<p align=\"left\">be punishable with imprisonment which may extend to three years or<\/p>\n<p align=\"left\">with fine which may extend to twenty-five crore rupees or with both,<\/p>\n<p align=\"left\">and in case of continuing contravention with additional fine which<\/p>\n<p align=\"left\">may extend to ten lakh rupees for every day during which the<\/p>\n<p align=\"left\">contravention continues.<\/p>\n<p align=\"left\">47.<\/p>\n<p align=\"left\">Punishment for establishing or operating a liquefied natural gas<\/p>\n<p align=\"left\">terminal without registration.<\/p>\n<p align=\"left\">47. Punishment for establishing or operating a liquefied natural gas<\/p>\n<p align=\"left\">terminal without registration.-If a person establishes or operates a<\/p>\n<p align=\"left\">liquefied natural gas terminal without registration as required under<\/p>\n<p align=\"left\">section 15, such person shall be liable for punishment with an<\/p>\n<p align=\"left\">imprisonment for a term which may extend to three years or penalty of<\/p>\n<p align=\"left\">twenty-five crore rupees or with both, and in case of continuing<\/p>\n<p align=\"left\">contravention with additional fine which may extend to ten lakh<\/p>\n<p align=\"left\">rupees for every day during which the contravention continues.<\/p>\n<p align=\"left\">48.<\/p>\n<p align=\"left\">Punishment for laying, building, operating or expanding a common<\/p>\n<p align=\"left\">carrier or contract carrier without authorisation.<\/p>\n<p align=\"left\">48. Punishment for laying, building, operating or expanding a common<\/p>\n<p align=\"left\">carrier or contract carrier without authorisation.-If a person lays,<\/p>\n<p align=\"left\">builds, operates or expands a common carrier or contract carrier or a<\/p>\n<p align=\"left\">city or local natural gas distribution network without obtaining<\/p>\n<p align=\"left\">authorisation required under section 19, such person shall be liable<\/p>\n<p align=\"left\">for punishment with an imprisonment for a term which may extend to<\/p>\n<p align=\"left\">three years or penalty of twenty-five crore rupees or with both, and<\/p>\n<p align=\"left\">in case of continuing contravention with additional fine which may<\/p>\n<p align=\"left\">extend to ten lakh rupees for every day during which the<\/p>\n<p align=\"left\">contravention continues.<\/p>\n<p align=\"left\">49.<\/p>\n<p align=\"left\">Punishment for willful damages to common carrier or contract carrier.<\/p>\n<p align=\"left\">49. Punishment for willful damages to common carrier or contract<\/p>\n<p align=\"left\">carrier.-Every person who wilfully removes, destroys or damages any<\/p>\n<p align=\"left\">pipeline or city or local natural gas distribution network or other<\/p>\n<p align=\"left\">work of the common carrier or contract carrier for supplying<\/p>\n<p align=\"left\">petroleum, petroleum products or natural gas shall for each such<\/p>\n<p align=\"left\">offence be punishable with imprisonment which may extend to three<\/p>\n<p align=\"left\">years or with fine which may extend to twenty-five crore rupees or<\/p>\n<p align=\"left\">with both, and, in case of continuing contravention with additional<\/p>\n<p align=\"left\">fine which may extend to ten lakh rupees for every day during which<\/p>\n<p align=\"left\">such contravention continues.<\/p>\n<p align=\"left\">50.<\/p>\n<p align=\"left\">Offences by companies.<\/p>\n<p align=\"left\">50. Offences by companies.-(1) Where an offence under this Act has<\/p>\n<p align=\"left\">been committed by a company, every person who at the time the offence<\/p>\n<p align=\"left\">was committed was in charge of, and was responsible to, the company<\/p>\n<p align=\"left\">for the conduct of the business of the company, as well as the<\/p>\n<p align=\"left\">company, shall be deemed to be guilty of the offence and shall be<\/p>\n<p align=\"left\">liable to be proceeded against and punished accordingly:<\/p>\n<p align=\"left\">Provided that nothing contained in this sub-section shall render any<\/p>\n<p align=\"left\">such person liable to any punishment provided in this Act, if he<\/p>\n<p align=\"left\">proves that the offence was committed without his knowledge or that<\/p>\n<p align=\"left\">he has exercised all due diligence to prevent the commission of such<\/p>\n<p align=\"left\">offence.<\/p>\n<p align=\"left\">(2) Notwithstanding anything contained in sub-section (1), where an<\/p>\n<p align=\"left\">offence under this Act has been committed by a company and it is<\/p>\n<p align=\"left\">proved that the offence has been committed with the consent or<\/p>\n<p align=\"left\">connivance of, or is attributable to, any neglect on the part of any<\/p>\n<p align=\"left\">director, manager, secretary or other officer of the company, such<\/p>\n<p align=\"left\">director, manager, secretary or other officer shall also be deemed to<\/p>\n<p align=\"left\">be guilty of the offence and shall be liable to be proceeded against<\/p>\n<p align=\"left\">and punished accordingly.<\/p>\n<p align=\"left\">Explanation.-For the purpose of this section,-<\/p>\n<p align=\"left\">(a) &#8220;company&#8221; means any body corporate and includes a firm or other<\/p>\n<p align=\"left\">association of individuals; and<\/p>\n<p align=\"left\">(b) &#8220;director&#8221;, in relation to a firm, means a partner in the firm.<\/p>\n<p align=\"left\"><strong><span style=\"text-decoration: underline;\">CHAPTER X<\/span><\/strong><\/p>\n<p align=\"left\"><strong><span style=\"text-decoration: underline;\">MISCELLANEOUS<\/span><\/strong><\/p>\n<p align=\"left\">51. Maintenance of data bank and information.-(1) The Board shall<\/p>\n<p align=\"left\">maintain a data bank and information system relating to activities of<\/p>\n<p align=\"left\">entities dealing with petroleum, petroleum products and natural gas<\/p>\n<p align=\"left\">in such form and manner as may be provided by regulations.<\/p>\n<p align=\"left\">(2) The Board shall have power to verify the data supplied by the<\/p>\n<p align=\"left\">entities and appoint any person or persons for the purpose and take<\/p>\n<p align=\"left\">such measures as it may consider necessary.<\/p>\n<p align=\"left\">52.<\/p>\n<p align=\"left\">Obligations of entities.<\/p>\n<p align=\"left\">52. Obligations of entities.-(1) Every entity shall-<\/p>\n<p align=\"left\">(a) maintain such documentary records as may be specified by the<\/p>\n<p align=\"left\">Board by regulations;<\/p>\n<p align=\"left\">(b) allow inspection of such facilities and documentary records, as<\/p>\n<p align=\"left\">may be specified by the Board, by any person authorised by the<\/p>\n<p align=\"left\">Board;<\/p>\n<p align=\"left\">(c) commence operation of activities for which authorisation has been<\/p>\n<p align=\"left\">granted within such period as may be specified by the Board in the<\/p>\n<p align=\"left\">document of authorisation;<\/p>\n<p align=\"left\">(d) register-<\/p>\n<p align=\"left\">(i) agreements with the Board relating to use of pipelines for supply<\/p>\n<p align=\"left\">of petroleum, petroleum products and natural gas; or<\/p>\n<p align=\"left\">(ii) any other document which the Board may determine by regulations;<\/p>\n<p align=\"left\">(e) comply with marketing service obligations and retail service<\/p>\n<p align=\"left\">obligations.<\/p>\n<p align=\"left\">(2) The Board may call for any information from any entity including<\/p>\n<p align=\"left\">information which is considered necessary for ensuring transparency<\/p>\n<p align=\"left\">or ascertaining true ownership of the entity.<\/p>\n<p align=\"left\">(3) The Board or any officer authorised by the Board shall have the<\/p>\n<p align=\"left\">power to inspect and obtain information, wherever necessary, from the<\/p>\n<p align=\"left\">entities.<\/p>\n<p align=\"left\">(4) For the effective enforcement of the terms and conditions of<\/p>\n<p align=\"left\">authorisation, the Board or any officer authorised by it for that<\/p>\n<p align=\"left\">purpose, shall have all the powers of an inspecting officer as<\/p>\n<p align=\"left\">provided under section 209A of the Companies Act, 1956 (1 of 1956).<\/p>\n<p align=\"left\">(5) It shall be the duty of every entity to carry out the directions<\/p>\n<p align=\"left\">of the Board given under this section.<\/p>\n<p align=\"left\">(6) The Board shall maintain confidentiality in respect of any<\/p>\n<p align=\"left\">information and record received by it from the entities and shall not<\/p>\n<p align=\"left\">disclose information contained therein to any person or authority<\/p>\n<p align=\"left\">except on the grounds of public interest.<\/p>\n<p align=\"left\">53.<\/p>\n<p align=\"left\">Furnishing of returns, etc., to Central Government.<\/p>\n<p align=\"left\">53. Furnishing of returns, etc., to Central Government.-The Board<\/p>\n<p align=\"left\">shall furnish to the Central Government at such time and in such form<\/p>\n<p align=\"left\">and manner as may be prescribed or as the Central Government may<\/p>\n<p align=\"left\">direct, such returns and statements and such particulars in regard to<\/p>\n<p align=\"left\">any matter in connection with proposed or existing activities under<\/p>\n<p align=\"left\">this Act, as the Central Government may, from time to time, require.<\/p>\n<p align=\"left\">54.<\/p>\n<p align=\"left\">Chairperson, members, etc., to be public servants.<\/p>\n<p align=\"left\">54. Chairperson, members, etc., to be public servants.-The<\/p>\n<p align=\"left\">Chairperson, Members, Officers and other employees of the Board and<\/p>\n<p align=\"left\">Technical Member (Petroleum and Natural Gas) of the Appellate<\/p>\n<p align=\"left\">Tribunal shall be deemed, when acting or purporting to act in<\/p>\n<p align=\"left\">pursuance of any of the provisions of this Act, to be public servants<\/p>\n<p align=\"left\">within the meaning of section 21 of the Indian Penal Code (45 of<\/p>\n<p align=\"left\">1860).<\/p>\n<p align=\"left\">55.<\/p>\n<p align=\"left\">Protection of action taken in good faith.<\/p>\n<p align=\"left\">55. Protection of action taken in good faith.-No suit, prosecution or<\/p>\n<p align=\"left\">other legal proceeding shall lie against the Central Government,<\/p>\n<p align=\"left\">Board, Technical Authority or Appellate Tribunal or any officer of<\/p>\n<p align=\"left\">the Central Government or any Chairperson, Member, officer or other<\/p>\n<p align=\"left\">employee of the Board or Technical Member (Petroleum and Natural Gas)<\/p>\n<p align=\"left\">of the Appellate Tribunal for anything which is in good faith done or<\/p>\n<p align=\"left\">intended to be done under this Act or the rules or regulations made<\/p>\n<p align=\"left\">thereunder.<\/p>\n<p align=\"left\">56.<\/p>\n<p align=\"left\">Civil courts not to have jurisdiction.<\/p>\n<p align=\"left\">56. Civil courts not to have jurisdiction.-No civil court shall have<\/p>\n<p align=\"left\">jurisdiction to entertain any suit or proceeding in respect of any<\/p>\n<p align=\"left\">matter which the Board or the Appellate Tribunal is empowered by or<\/p>\n<p align=\"left\">under this Act to determine, and no injunction shall be granted by<\/p>\n<p align=\"left\">any court or other authority in respect of any action taken or to be<\/p>\n<p align=\"left\">taken in pursuance of any power conferred by or under this Act.<\/p>\n<p align=\"left\">57.<\/p>\n<p align=\"left\">Cognizance of certain offences.<\/p>\n<p align=\"left\">57. Cognizance of certain offences.-(1) No court shall take<\/p>\n<p align=\"left\">cognizance of any offence punishable under Chapter IX save on a<\/p>\n<p align=\"left\">complaint made by the Board or by any investigating agency directed<\/p>\n<p align=\"left\">by the Central Government.<\/p>\n<p align=\"left\">(2) No court inferior to that of a Chief Metropolitan Magistrate or<\/p>\n<p align=\"left\">of a Chief Judicial Magistrate shall try any offence punishable under<\/p>\n<p align=\"left\">Chapter IX.<\/p>\n<p align=\"left\">(3) Every offence punishable under sections 44, 45, 46 and 47 shall<\/p>\n<p align=\"left\">be cognizable.<\/p>\n<p align=\"left\">58.<\/p>\n<p align=\"left\">Delegation.<\/p>\n<p align=\"left\">58. Delegation.-The Board may, by general or special order in<\/p>\n<p align=\"left\">writing, delegate to any member or officer of the Board subject to<\/p>\n<p align=\"left\">such conditions, if any, as may be specified in the order, such of<\/p>\n<p align=\"left\">its powers and functions under this Act (except the power to settle a<\/p>\n<p align=\"left\">dispute under Chapter VI and to make regulations under section 61),<\/p>\n<p align=\"left\">as it may deem necessary.<\/p>\n<p align=\"left\">59.<\/p>\n<p align=\"left\">Power to remove difficulties.<\/p>\n<p align=\"left\">59. Power to remove difficulties.-(1) If any difficulty arises in<\/p>\n<p align=\"left\">giving effect to the provisions of this Act, the Central Government<\/p>\n<p align=\"left\">may, by order, published in the Official Gazette, make such<\/p>\n<p align=\"left\">provisions not inconsistent with the provisions of this Act as it may<\/p>\n<p align=\"left\">deem necessary for removing the difficulty:<\/p>\n<p align=\"left\">Provided that no order shall be made under this section after the<\/p>\n<p align=\"left\">expiry of two years from the date of commencement of this Act.<\/p>\n<p align=\"left\">(2) Every order made under this section shall be laid, as soon as may<\/p>\n<p align=\"left\">be after it is made, before each House of Parliament.<\/p>\n<p align=\"left\">60.<\/p>\n<p align=\"left\">Power of Central Government to make rules.<\/p>\n<p align=\"left\">60. Power of Central Government to make rules.-(1) The Central<\/p>\n<p align=\"left\">Government may, by notification, make rules for carrying out the<\/p>\n<p align=\"left\">provisions of this Act.<\/p>\n<p align=\"left\">(2) In particular, and without prejudice to the generality of the<\/p>\n<p align=\"left\">foregoing power, such rules may provide for all or any of the<\/p>\n<p align=\"left\">following matters, namely:-<\/p>\n<p align=\"left\">(a) the salaries and allowances payable to and the other conditions<\/p>\n<p align=\"left\">of service of the Chairperson and the other members under subsection<\/p>\n<p align=\"left\">(4) of section 5;<\/p>\n<p align=\"left\">(b) the procedure for appointment of any person or constitution of<\/p>\n<p align=\"left\">any authority and conducting inquiry under section 7;<\/p>\n<p align=\"left\">(c) the salaries and allowances payable to and the other terms and<\/p>\n<p align=\"left\">conditions of service of the Secretary, officers and other employees<\/p>\n<p align=\"left\">of the Board, under sub-section (3) of section 10;<\/p>\n<p align=\"left\">(d) any other matter in respect of which the Board may exercise the<\/p>\n<p align=\"left\">powers of a civil court under clause (i) of sub-section (1) of<\/p>\n<p align=\"left\">section 13;<\/p>\n<p align=\"left\">(e) the eligibility conditions which an entity shall fulfil for<\/p>\n<p align=\"left\">registration under sub-section (1) of section 15;<\/p>\n<p align=\"left\">(f) the form of appeal and the manner of verifying such form, and the<\/p>\n<p align=\"left\">fee which shall accompany such form, under sub-section (2) of section<\/p>\n<p align=\"left\">33;<\/p>\n<p align=\"left\">(g) the manner in which the accounts of the Board shall be maintained<\/p>\n<p align=\"left\">under sub-section (1) of section 40;<\/p>\n<p align=\"left\">(h) the time and manner in which the annual report of the Board<\/p>\n<p align=\"left\">shall be prepared under sub-section (1) of section 41;<\/p>\n<p align=\"left\">(i) the form and manner in which applications for claiming<\/p>\n<p align=\"left\">compensation shall be made, the procedure for determining the<\/p>\n<p align=\"left\">compensation and the time within which such compensation shall be<\/p>\n<p align=\"left\">payable, under sub-section (3) of section 43;<\/p>\n<p align=\"left\">(j) the time and manner in which returns and statements are to be<\/p>\n<p align=\"left\">furnished by the Board to the Central Government under section 53;<\/p>\n<p align=\"left\">(k) any other matter which is to be, or may be, prescribed, or in<\/p>\n<p align=\"left\">respect of which provision is to be made, by rules.<\/p>\n<p align=\"left\">61.<\/p>\n<p align=\"left\">Power of Board to make regulations.<\/p>\n<p align=\"left\">61. Power of Board to make regulations.-(1) The Board may, by<\/p>\n<p align=\"left\">notification, make regulations consistent with this Act and the rules<\/p>\n<p align=\"left\">made thereunder to carry out the provisions of this Act.<\/p>\n<p align=\"left\">(2) In particular, and without prejudice to the generality of the<\/p>\n<p align=\"left\">foregoing power, such regulations may provide for all or any of the<\/p>\n<p align=\"left\">following matters, namely:-<\/p>\n<p align=\"left\">(a) the time and places of meetings of the Board and the procedure<\/p>\n<p align=\"left\">(including quorum necessary for the transaction of business) to be<\/p>\n<p align=\"left\">followed at such meetings under sub-section (1) of section 8;<\/p>\n<p align=\"left\">(b) the powers and duties of the Secretary under sub-section (1) of<\/p>\n<p align=\"left\">section 10;<\/p>\n<p align=\"left\">(c) the terms and conditions of the consultants appointed under subsection<\/p>\n<p align=\"left\">(4) of section 10;<\/p>\n<p align=\"left\">(d) the capacity of storage facilities for petroleum, petroleum<\/p>\n<p align=\"left\">products or natural gas requiring registration under sub-clause (iii)<\/p>\n<p align=\"left\">of clause (b) of section 11;<\/p>\n<p align=\"left\">(e) regulating open access to and transportation rate for the common<\/p>\n<p align=\"left\">carrier or contract carrier or city or local natural gas<\/p>\n<p align=\"left\">distribution network and other matters referred to in clause (e) of<\/p>\n<p align=\"left\">section 11;<\/p>\n<p align=\"left\">(f) marketing service obligations for entities and retail service<\/p>\n<p align=\"left\">obligations for retail outlets under sub-clause (v) of clause (f) of<\/p>\n<p align=\"left\">section 11;<\/p>\n<p align=\"left\">(g) levy of fees and other charges under clause (g) of section 11;<\/p>\n<p align=\"left\">(h) the technical standards and specifications including safety<\/p>\n<p align=\"left\">standards in activities relating to petroleum, petroleum products and<\/p>\n<p align=\"left\">natural gas under clause (i) of section 11;<\/p>\n<p align=\"left\">(i) the procedure to be followed by the Board including the places at<\/p>\n<p align=\"left\">which it shall conduct its business under sub-section (3) of section<\/p>\n<p align=\"left\">13;<\/p>\n<p align=\"left\">(j) the manner of maintaining the Petroleum and Natural Gas Register<\/p>\n<p align=\"left\">under<\/p>\n<p align=\"left\">sub-section (1) of section 14;<\/p>\n<p align=\"left\">(k) the form and manner of making application for obtaining certified<\/p>\n<p align=\"left\">copy of any entry in the register and the fee which shall accompany<\/p>\n<p align=\"left\">such application, under sub-section (4) of section 14;<\/p>\n<p align=\"left\">(l) the form and manner in which an application under sub-section (1)<\/p>\n<p align=\"left\">of section 15 shall be made and the fee which shall accompany such<\/p>\n<p align=\"left\">application under sub-section (2) of section 15;<\/p>\n<p align=\"left\">(m) the manner by which a certificate of registration granted under<\/p>\n<p align=\"left\">sub-section (3) of section 15 may be suspended or cancelled under<\/p>\n<p align=\"left\">sub-section (4) of section 15;<\/p>\n<p align=\"left\">(n) the form and manner in which an application under sub-section (1)<\/p>\n<p align=\"left\">or sub-section (2) of section 17 shall be made and the fee which<\/p>\n<p align=\"left\">shall accompany such application under sub-section (3) of section 17;<\/p>\n<p align=\"left\">(o) the form and manner in which publicity of acceptance of<\/p>\n<p align=\"left\">applications for registration shall be made under section 18;<\/p>\n<p align=\"left\">(p) the manner of selection of an entity under sub-section (2) of<\/p>\n<p align=\"left\">section 19;<\/p>\n<p align=\"left\">(q) the principles for determining the number of years for which a<\/p>\n<p align=\"left\">city or local natural gas distribution network shall be excluded from<\/p>\n<p align=\"left\">the purview of a common carrier or contract carrier under sub-section<\/p>\n<p align=\"left\">(4) of section 20;<\/p>\n<p align=\"left\">(r) the guiding principles to be followed by the Board and the<\/p>\n<p align=\"left\">objectives for declaring, or authorising to lay, build, operate or<\/p>\n<p align=\"left\">expand a common carrier or contract carrier for declaring, or<\/p>\n<p align=\"left\">authorising to lay, build, operate or expand a city or local natural<\/p>\n<p align=\"left\">gas distribution network, under sub-section (5) of section 20;<\/p>\n<p align=\"left\">(s) the affiliate code of conduct under which the entities are<\/p>\n<p align=\"left\">required to comply with under the proviso to sub-section (1) of<\/p>\n<p align=\"left\">section 21;<\/p>\n<p align=\"left\">(t) the transportation tariffs for common carriers or contract<\/p>\n<p align=\"left\">carriers or city or local natural gas distribution network and the<\/p>\n<p align=\"left\">manner of determining such tariffs under sub-section (1) of section<\/p>\n<p align=\"left\">22;<\/p>\n<p align=\"left\">(u) the form in which a complaint may be made and the fee which shall<\/p>\n<p align=\"left\">accompany such complaint, under sub-section (2) of section 25;<\/p>\n<p align=\"left\">(v) the manner of holding an investigation by an Investigating<\/p>\n<p align=\"left\">Officer under sub-section (1) of section 26;<\/p>\n<p align=\"left\">(w) the qualifications and experience which any person for<\/p>\n<p align=\"left\">appointment as an Investigating Officer shall possess, under subsection<\/p>\n<p align=\"left\">(2) of section 26;<\/p>\n<p align=\"left\">(x) the form and manner of maintaining data bank and information<\/p>\n<p align=\"left\">system by the Board under sub-section (1) of section 51;<\/p>\n<p align=\"left\">(y) maintenance of documentary records by an entity, under clause (a)<\/p>\n<p align=\"left\">of sub-section (1) of section 52;<\/p>\n<p align=\"left\">(z) any other type of documents which are to be registered with the<\/p>\n<p align=\"left\">Board under sub-clause (ii) of clause (d) of sub-section (1) of<\/p>\n<p align=\"left\">section 52;<\/p>\n<p align=\"left\">(za) any other matter which is required to be, or may be, specified<\/p>\n<p align=\"left\">by regulations or in respect of which provision is to be or may be<\/p>\n<p align=\"left\">made by regulations.<\/p>\n<p align=\"left\">62.<\/p>\n<p align=\"left\">Rules and regulations to be laid before Parliament.<\/p>\n<p align=\"left\">62. Rules and regulations to be laid before Parliament.-Every rule<\/p>\n<p align=\"left\">made by the Central Government and every regulation made by the Board<\/p>\n<p align=\"left\">under this Act shall be laid, as soon as may be after it is made,<\/p>\n<p align=\"left\">before each House of Parliament, while it is in session, for a total<\/p>\n<p align=\"left\">period of thirty days which may be comprised in one session or in two<\/p>\n<p align=\"left\">or more successive sessions, and if, before the expiry of the session<\/p>\n<p align=\"left\">immediately following the session or the successive sessions<\/p>\n<p align=\"left\">aforesaid, both Houses agree in making any modification in the rule<\/p>\n<p align=\"left\">or regulation or both Houses agree that the rule or regulation should<\/p>\n<p align=\"left\">not be made, the rule or regulation shall thereafter have effect only<\/p>\n<p align=\"left\">in such modified form or be of no effect, as the case may be; so,<\/p>\n<p align=\"left\">however, that any such modification or annulment shall be without<\/p>\n<p align=\"left\">prejudice to the validity of anything previously done under that rule<\/p>\n<p align=\"left\">or regulation.<\/p>\n<p align=\"left\">63.<\/p>\n<p align=\"left\">Transitional arrangements.<\/p>\n<p align=\"left\">63. Transitional arrangements.-(1) Where, before the commencement of<\/p>\n<p align=\"left\">this Act, an agreement or agreements have been entered into between<\/p>\n<p align=\"left\">one oil company and another for the purpose of sharing of petroleum<\/p>\n<p align=\"left\">products or sharing of infrastructure facilities among the oil<\/p>\n<p align=\"left\">companies and such agreements have been approved by the Central<\/p>\n<p align=\"left\">Government, the Board may monitor the implementation of such<\/p>\n<p align=\"left\">agreements for the transition period.<\/p>\n<p align=\"left\">(2) The Board shall monitor setting up of dealerships and<\/p>\n<p align=\"left\">distributorships of motor spirit, high speed diesel, superior<\/p>\n<p align=\"left\">kerosene oil, liquefied petroleum gas and CNG stations for natural<\/p>\n<p align=\"left\">gas during transition period by the entities without encroaching on<\/p>\n<p align=\"left\">the retail network of the existing entities.<\/p>\n<p align=\"left\">Explanation I.-For the purposes of this section, the expression<\/p>\n<p align=\"left\">&#8220;transition period&#8221; shall mean a period of three years from the date<\/p>\n<p align=\"left\">of commencement of this Act.<\/p>\n<p align=\"left\">Explanation II.-For the purposes of this section, &#8220;infrastructure<\/p>\n<p align=\"left\">facilities&#8221; shall mean facilities at ports, refineries, terminals,<\/p>\n<p align=\"left\">depots and aviation fuelling stations including hydrant lines and<\/p>\n<p align=\"left\">shall include loading and unloading facilities.<\/p>\n<p align=\"left\">Explanation III.-For the purposes of this section &#8220;encroaching&#8221;<\/p>\n<p align=\"left\">includes taking over of retail outlet of one entity by another.<\/p>\n<p align=\"left\">&#8212;-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>CHAPTER VI APPEALS TO APPELLATE TRIBUNAL 30.
