Recycled Plastics Manufacture and usage Amendment Rules, 20021. (1) These rules may be called the Recycled Plastics Manufacture and usage Amendment Rules, 2002.<\/p>\n
(2) These shall come into force on the date of their publication in the gazette.<\/p>\n
2. In the Recycled Plastics Manufacture and usage Amendment Rules, 2002 in sub-rule (1) to Rule 1 the title of the rules shall read as;<\/p>\n
” Plastics Manufacture, Sale and Usage Rules, 2002.<\/p>\n
3. In the Plastics Manufacture, sale and usage Rules, 2002. (herein after referred to as the said rules), in rule 2; –<\/p>\n
a. for sub-rule (c ) the following sub-rule be substituted namely ” vendor” means any person who sells articles or commodities packaged and stored in plastic carry bags or containers;<\/p>\n
(b) after sub-rule (c) the following sub-rules shall be inserted namely;<\/p>\n
“(d) “Registration” means permission for manufacture of carry bags and containers made of virgin or recycled plastics;<\/p>\n
(e) “Carry bags” means plastic bags which have a self carrying feature commonly known as vest type bag and \/ or ” D ” punched bags used to carry commodities;<\/p>\n
(f) “Commodities” means articles and items including vegetables, fruits, pharmaceuticals etc.;<\/p>\n
(g) “Containers” means rigid plastic holdings and articles with or without lid used to store, carry or dispense commodities.”<\/p>\n
(h) Words and expression used in the rules and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act.”<\/p>\n
1. In the said rules for rule -4 the following rule shall be substituted –<\/p>\n
“4 Restriction on manufacture, sale and usage of virgin and recycled plastic carry bags and recycled plastic containers.<\/p>\n
a. Subject to the provisions of Rule 8; –<\/p>\n
1. No person shall manufacture, distribute or sell carry bags made of virgin or recycled plastics of or below the size prescribed;<\/p>\n
2. No vendor shall use carry bags of or below the size prescribed made of virgin or recycled plastic for selling any commodity;<\/p>\n
3. No vendor shall use carry bags made of recycled plastics for storing, carrying, dispensing or packaging of foodstuffs;<\/p>\n
a. No vendor shall use containers made of recycled plastics for storing, carrying, dispensing or packaging of foodstuffs.<\/p>\n
1. In rule 5 of the said rules after sub-rule (b) the following sub-rule shall be inserted; –<\/p>\n
“(c) Carry bags shall not be of or below 8×12 inches (20×30 cms) in size.”<\/p>\n
2. In rule – 7 of the said rules; –<\/p>\n
a. The words “subject to the provision of rule 4 & 5” shall be inserted before the words “Manufacturers of recycled plastic”;<\/p>\n
1. After rule – 9, the following rules shall be inserted namely; –<\/p>\n
“10. Grant of Registration for Manufacture” – (1) Every occupier manufacturing carrybags or containers shall make an application in Form 1 along with a sum of Rupees 500.00 (Rupees five hundred only) as processing fee to the State Pollution Control Board\/Pollution Control Committee for the grant of Registration and renewal of Registration;<\/p>\n
1. The State Pollution Control Board\/Pollution Control Committee shall not issue and renew a Registration unless the unit meets the norms prescribed under rule 5,6,7 and 8 of these rules and also possess a valid consent under Air & Water Act as per requirements of the State Pollution Control Board\/Pollution Control Committee.<\/p>\n
2. Decision on grant of registration shall be taken within 30 days of receipt of application complete in all respects.<\/p>\n
3. The Registration granted under this rule shall, unless revoked suspended or cancelled earlier, shall be valid for a period of three years.<\/p>\n
4. An application for the renewal of Registration shall be made in Form 1 at least 60 days before expiry of validity of registration<\/p>\n
5. The Registration shall continue to be in force until it is renewed or revoked.<\/p>\n
1. Application.-Provisions of rules 5 ( c ) and 8 shall not apply to occupiers registered to manufacture carry bags for exports against an export order.”<\/p>\n
