An Act to amend the Electricity Act, 2003.<\/p>\n
BE it enacted by Parliament in the Fifty-fourth Year of the Republic of<\/p>\n
India as follows:-<\/p>\n
\u00a0<\/p>\n
1.<\/p>\n
Short title and commencement.<\/p>\n
\u00a0<\/p>\n
1. Short title and commencement.-(1) This Act may be called the<\/p>\n
Electricity (Amendment) Act, 2003.<\/p>\n
(2) It shall come into force on such date as the Central Government<\/p>\n
may, by notification in the Official Gazette, appoint.<\/p>\n
\u00a0<\/p>\n
2.<\/p>\n
Amendment of section 14.<\/p>\n
\u00a0<\/p>\n
2. Amendment of section 14.-In section 14 of the Electricity Act, 2003<\/p>\n
(36 of 2003) (hereinafter referred to as the principal Act), in the<\/p>\n
sixth proviso, for the brackets and words “(including the capital<\/p>\n
adequacy, creditworthiness, or code of conduct)”, the words “relating<\/p>\n
to the capital adequacy, creditworthiness, or code of conduct” shall be<\/p>\n
substituted.<\/p>\n
\u00a0<\/p>\n
3.<\/p>\n
Amendment of section 42.<\/p>\n
\u00a0<\/p>\n
3. Amendment of section 42.-In section 42 of the principal Act, in subsection<\/p>\n
(2), after the fourth proviso, the following proviso shall be<\/p>\n
inserted, namely:-<\/p>\n
“Provided also that the State Commission shall, not later than five<\/p>\n
years from the date of commencement of the Electricity (Amendment) Act,<\/p>\n
2003, by regulations, provide such open access to all consumers who<\/p>\n
require a supply of electricity where the maximum power to be made<\/p>\n
available at any time exceeds one megawatt.”.<\/p>\n

4.<\/p>\n
Substitution of new section for section 121.<\/p>\n
\u00a0<\/p>\n
4. Substitution of new section for section 121.-For section 121 of the<\/p>\n
principal Act, the following section shall be substituted, namely:-<\/p>\n
\u00a0<\/p>\n
Power of Appellate Tribunal.<\/p>\n
\u00a0<\/p>\n
“121. Power of Appellate Tribunal.-The Appellate Tribunal may, after<\/p>\n
hearing the Appropriate Commission or other interested party, if any,<\/p>\n
from time to time, issue such orders, instructions or directions as it<\/p>\n
may deem fit, to any Appropriate Commission for the performance of its<\/p>\n
statutory functions under this Act.”.<\/p>\n

5.<\/p>\n
Amendment of section 135.<\/p>\n
\u00a0<\/p>\n
5. Amendment of section 135.-In section 135 of the principal Act, in<\/p>\n
sub-section (2),-<\/p>\n
(i) in clause (a), for the words “has been, is being, or is likely to<\/p>\n
be,”, the words “has been or is being” shall be substituted;<\/p>\n
(ii) in clause (b), for the words “has been, is being, or is likely to<\/p>\n
be,”, the words “has been or is being” shall be substituted.<\/p>\n

6.<\/p>\n
Substitution of new sections for sections 139 and 140.<\/p>\n
\u00a0<\/p>\n
6. Substitution of new sections for sections 139 and 140.-For sections<\/p>\n
139 and 140 of the principal Act, the following sections shall be<\/p>\n
substituted, namely:-<\/p>\n
\u00a0<\/p>\n
Negligently breaking or damaging works.<\/p>\n
\u00a0<\/p>\n
“139. Negligently breaking or damaging works.-Whoever, negligently<\/p>\n
breaks, injures, throws down or damages any material connected with the<\/p>\n
supply of electricity, shall be punishable with fine which may extend<\/p>\n
to ten thousand rupees.<\/p>\n
\u00a0<\/p>\n
Penalty for intentionally injuring works.<\/p>\n
\u00a0<\/p>\n
140. Penalty for intentionally injuring works.-Whoever, with intent to<\/p>\n
cut off the supply of electricity, cuts or injures, or attempts to cut<\/p>\n
or injure, any electric supply line or works, shall be punishable with<\/p>\n
fine which may extend to ten thousand rupees.”.<\/p>\n

Amendment of section 146.<\/p>\n
\u00a0<\/p>\n
7. Amendment of section 146.-In section 146 of the principal Act, the<\/p>\n
following proviso shall be inserted, namely:-<\/p>\n
“Provided that nothing contained in this section shall apply to the<\/p>\n
