Disability Pension<\/p>\n<p>(Will be published later)<\/p>\n<p>B. Terminal Gratuity<\/p>\n<p>1. All officers, JCOs other ranks and NCs(E) commissioned\/<\/p>\n<p>enrolled in the Territorial Army (excepting civil Government servants<\/p>\n<p>holding permanent appointments), who were in the Terri<\/p>\n<p>torial army on the 30th March 1955 or who joined it on or<\/p>\n<p>after that date will be eligible for terminal gratuity at the rates<\/p>\n<p>and under the conditions given below :-<\/p>\n<p>2. Officers and JCOs<\/p>\n<p>Rate of terminal gratuity and conditions governing the grant-<\/p>\n<p>(a) Terminal gratuity will be admissible to only such officers<\/p>\n<p>and JCOs of the Territorial Army as have completed either a<\/p>\n<p>minimum of five years of aggregate embodied service (which<\/p>\n<p>for this purpose will include the period spent on training under<\/p>\n<p>TA Act Rule 18) or 10 years engagement in TA (combined embodied<\/p>\n<p>and non-embodied service) at the rate of one month\u2019s<\/p>\n<p>pay (Pay for this purpose is not to exceed *Rs. (1500 per month)<\/p>\n<p>for each aggregate year of embodied service, subject to a maximum<\/p>\n<p>of fifteen months\u2019 pay or *Rs. 22,500 whichever is less.<\/p>\n<p>*(Auth\u2014CS No 261\/1\/84)<\/p>\n<p>(b) Subject to the service rendered being certified by the<\/p>\n<p>prescribed authority (vide para 4 below) to have been satisfactory,<\/p>\n<p>terminal grauity will be admissible to Officers and JCOs on retirement,<\/p>\n<p>or discharge as the case may be, for the following causes :-<\/p>\n<p>(i) On disbandment\/re-organisation\/inter-zonal transfer of<\/p>\n<p>unit, provided there is no other unit to which the Officer\/<\/p>\n<p>JCO can be transferred, or his consent to a transfer is<\/p>\n<p>necessary under the rules and he refuses to consent<\/p>\n<p>thereto.<\/p>\n<p>(ii) On reaching the retiring age as prescribed in Rule 14 (c).<\/p>\n<p>(iii)On being declared medically unfit for further service subject<\/p>\n<p>to the provision of sub para (c) below.<\/p>\n<p>371<\/p>\n<p>(iv) On completion of tenure of appointment or service limits;<\/p>\n<p>or<\/p>\n<p>(v) When services are no longer required other than for disciplinary<\/p>\n<p>reasons (in case of JCOs only).<\/p>\n<p>(c) In case of termination of service on account of medical<\/p>\n<p>unfitness, the terminal gratuity will be payable only if the<\/p>\n<p>officer\/JCO does not qualify for disability pension.<\/p>\n<p>(d) In the case of pensioners (both civil and military) serving<\/p>\n<p>in the Territorial Army, the gratuity will not be payable for any<\/p>\n<p>period of service in the Territorial Army during which pension<\/p>\n<p>continues to be drawn, except in the case of civil pensioners whose<\/p>\n<p>pay is fixed after deducting the amount of pension including the<\/p>\n<p>commuted portion if any, under the provisions of para 187. No<\/p>\n<p>gratuity will, however, be payable to any retired commissioned<\/p>\n<p>officer or retired civilian Gazetted officer irrespective of whether<\/p>\n<p>their pension is held in abeyance or not.<\/p>\n<p>Pay for Assessment of Terminal Gratuity\u2014<\/p>\n<p>In the case of officers, terminal gratuity will be assessed on<\/p>\n<p>the pay on the substantive rank last held. In the case of JCOs,<\/p>\n<p>pay for assessment of terminal gratuity will consist of\u2014<\/p>\n<p>(a) Basic pay of the substantive rank last held; and<\/p>\n<p>(b) Dearness allowance appropriate to the emoluments of the<\/p>\n<p>substantive rank last held.<\/p>\n<p>3. OR and NCs(E)\u2014<\/p>\n<p>Rate of terminal gratuity and conditions governing its grant\u2014<\/p>\n<p>The provisions of para 2 above will also apply to other ranks<\/p>\n<p>and NCs(E) of the Territorial Army, except that terminal gratuity<\/p>\n<p>will be admissible on discharge for the following cause :&#8211;<\/p>\n<p>(i) On become entitled to receive discharge under TA<\/p>\n<p>Rules.<\/p>\n<p>(ii) On being declared medically unfit for further service, provided<\/p>\n<p>the OR\/NCs(E) does not qualify for disability<\/p>\n<p>pension.<\/p>\n<p>(iii)When services are no longer required other than for disciplinary<\/p>\n<p>reasons.<\/p>\n<p>Pay for Assessment of Terminal Gratuity\u2014<\/p>\n<p>Pay for the purpose of assessment of terminal gratuity in the<\/p>\n<p>case of other ranks and NCs(E) will consist of :-<\/p>\n<p>372<\/p>\n<p>(a) Basic pay (including deferred pay) of the substantive<\/p>\n<p>rank last held.<\/p>\n<p>(b) Rank\/appointment pay of the substantive rank last held.<\/p>\n<p>(c) Increment of pay.<\/p>\n<p>(d) Good service pay; and<\/p>\n<p>(e) Dearness allowance appropriate to the emoluments of<\/p>\n<p>the substantive rank last held.<\/p>\n<p>4. Prescribed authority for certifying that service rendered is<\/p>\n<p>satisfactory for purpose of grant of terminal gratuity.<\/p>\n<p>(i) In the case of an &#8212; Director, Territorial Army,<\/p>\n<p>officer Army Headquarters.<\/p>\n<p>(ii) In the case of &#8212; The Officer Commanding; the<\/p>\n<p>JCOs, OR and Sub-Area or equivalent Comman-<\/p>\n<p>NCs(E) der or in the absence of such<\/p>\n<p>formation, the Area or equivalent<\/p>\n<p>Commander, appropriate to the<\/p>\n<p>location of the unit of the individual.<\/p>\n<p>373<\/p>\n<p>374<\/p>\n<p>***APPENDIX XXVII<\/p>\n<p>Grant of Service Pension\/Gratuity to TA Officers, JCOs\/ORs other than<\/p>\n<p>Civil. Govt. Servants and Civil Pensioners<\/p>\n<p>1. Pension:&#8211; Service pension to TA Officers and JCOs\/ORs(other than<\/p>\n<p>Civil Government servants and Civil Pensioners), who have a minimum<\/p>\n<p>qualifying aggregate embodied service of 20 years in the case of officers<\/p>\n<p>and 15 years in the case of JCOs\/ORs will be admissible as indicated<\/p>\n<p>below :&#8211;<\/p>\n<p>(a) Former qualifying regular service in Army, Navy and Air Force<\/p>\n<p>in any rank will be counted to the same extent as admissible to the<\/p>\n<p>regular Army personnel.<\/p>\n<p>(b) The weightage added to the qualifying service of regular Army<\/p>\n<p>personnel will not be allowed in the case of Territorial Army<\/p>\n<p>personnel.<\/p>\n<p>(c) The qualifying embodied service, as mentioned above, may be<\/p>\n<p>continuous or rendered in broken spell. For calculating the<\/p>\n<p>total embodied service, the breaks in embodied service due to<\/p>\n<p>disembodiment, will be treated as condoned but the period of<\/p>\n<p>breaks itself will not be treated as qualifying service for pension.<\/p>\n<p>Where qualifying, embodied service has been rendered in broken<\/p>\n<p>spells, five per cent cut will be imposed on the pension of those<\/p>\n<p>JCOs\/ORs, who have completed 15 years or more of aggregate<\/p>\n<p>embodied service, but have not completed 20 years of aggregate<\/p>\n<p>embodied service.<\/p>\n<p>2. (a) Officers, JCOs and ORs who had formerly served in the regular<\/p>\n<p>Army, Navy and Air Force and are now serving in the Territorial<\/p>\n<p>Army will have the option either :&#8211;<\/p>\n<p>(i) to continue to draw military pension and retain gratuity<\/p>\n<p>received on discharge from military service in which case<\/p>\n<p>their former military service shall not count as qualifying<\/p>\n<p>service for pension under these orders.<\/p>\n<p>OR<\/p>\n<p>(ii) to cease to draw pension henceforth and refund the service<\/p>\n<p>pension already drawn during the TA service and gratuity,<\/p>\n<p>including DCRG, if any, already drawn for the previous<\/p>\n<p>military service and count the previous military service as<\/p>\n<p>qualifying service for grant of pension etc, under these<\/p>\n<p>orders. In the case of TA personnel who have already<\/p>\n<p>retired, the service pension drawn during the TA service and<\/p>\n<p>gratuity, including DCR gratuity already drawn for previous<\/p>\n<p>military service will be adjusted by deduction from<\/p>\n<p>the DCR gratuity admissible under these orders.<\/p>\n<p>375<\/p>\n<p>(b) The option above shall be exercised at the time of enrolment in<\/p>\n<p>TA. In the case of serving TA personnel and retired personnel<\/p>\n<p>covered by these orders, the option shall be exercised within six<\/p>\n<p>months. Option once exercised shall be final. If no option<\/p>\n<p>is exercised within the period referred above the TA personnel<\/p>\n<p>shall deemed to have opted for clause (i) of para 2(a) above.<\/p>\n<p>(c) In the case of Officers, JCOs\/ORs who opts for 2(a) (ii) above,<\/p>\n<p>the provisions of the TA Regulations, para 187(b) (i) and (ii) will<\/p>\n<p>not apply. In case they do not complete the minimum qualifying<\/p>\n<p>service for TA pension, even after including former military<\/p>\n<p>service, they shall be granted terminal gratuity at the prescribed<\/p>\n<p>rates. Terminal gratuity shall not be paid for the embodied service<\/p>\n<p>in addition to service pension and DCR gratuity admissible under<\/p>\n<p>the provisions of this regulation.<\/p>\n<p>3. (i) Territorial Army pensioners covered by these orders will<\/p>\n<p>also be entitled to commute their pension in accordance<\/p>\n<p>with the rules and orders, applicable to the corresponding<\/p>\n<p>ranks in the regular Army.<\/p>\n<p>(ii) Death-cum-retirement-Gratuity and ordinary Family<\/p>\n<p>Pension will be admissible, as applicable to the Regular<\/p>\n<p>Army.<\/p>\n<p>(iii) Periodic Relief, sanctioned from time to time, for pensioners<\/p>\n<p>of the Regular Army, will be payable to TA pensioners also<\/p>\n<p>on the same basis\/scale.<\/p>\n<p>***(Auth\u2014CS No 266\/1\/86)<\/p>\n<p>376<\/p>\n<p>APPENDIX XXVIII<\/p>\n<p>INDIAN ARMY FORMS PECULIAR TO THE TERRITORIAL ARMY<\/p>\n<p>IAF(TA)-1 Application for enrolment.<\/p>\n<p>IAF(TA)-2 Budget Estimate, Centrally Controlled heads.<\/p>\n<p>IAF(TA)-3 Budget Estimate, Locally Controlled heads.<\/p>\n<p>IAF(TA)-4 Annual Inspection reports.<\/p>\n<p>IAF(TA)-5 Weapon Training return.<\/p>\n<p>IAF(TA)-6 Discharge Certificate.<\/p>\n<p>IAF(TA)-7 Mileage and Subsistance Allowance Forms.<\/p>\n<p>IAF(TA)-8 Distinctive Coloured envelopes for use in sending out<\/p>\n<p>orders for embodiment to members of the T.A.<\/p>\n<p>IAF(TA)-9 Application for the grant of Commission as officers in<\/p>\n<p>T.A.<\/p>\n<p>IAF(TA)-10 Notification of change of address.<\/p>\n<p>IAF(TA)-11 Notice for calling up.<\/p>\n<p>IAF(TA)-12 Certificate for proficiency in trades\u2014All Arms.<\/p>\n<p>IAF(TA)-13 Register of miscellaneous charges.<\/p>\n<p>IAF(TA)-14 Application for the grant of JCO Commission in T.A.<\/p>\n<p>IAF(TA)-15 Paramount Cards.<\/p>\n<p>IAF(TA)-16 Ledger Account.<\/p>\n<p>IAF(TA)-19 Territorial Army Medal or Clasp.<\/p>\n<p>IAF(TA)-20 Territorial Army Decoration.<\/p>\n<p>Note\u2014Forms for reports and returns, as applicable to corresponding units<\/p>\n<p>of the Regular Army, will be used.<\/p>\n<p>377<\/p>\n<p>378<\/p>\n<p>APPENDIX XXIX<\/p>\n<p>REGULATIONS GOVERNING THE AWARD OF THE TERRITORIAL ARMY DECORATION AND THE TERRITORIAL<\/p>\n<p>ARMY MEDAL<\/p>\n<p>TERRITORIALARMYDECORATION<\/p>\n<p>1. The decoration shall be styled and designated the \u201cTERRITORIAL ARMY DECORATION\u201d.<\/p>\n<p>2. The decoration shall be oval in shape, made of Silver.<\/p>\n<p>On the obverse it shall have a lotus wreath along the rim, a five<\/p>\n<p>pointed star in Gold gilt embosed in the centre and the State,<\/p>\n<p>Emblem in Gold gilt resting on the upper point of the star. On<\/p>\n<p>the reverse it shall have a lotus flower with buds and leaves<\/p>\n<p>embossed in the center and the words \u201c \u201c in<\/p>\n<p>the form of an arch above it. A sealed pattern to the Decoration<\/p>\n<p>shall be deposited and kept.<\/p>\n<p>3. The decoration shall be suspended from a Silver bar<\/p>\n<p>broach, with the word \u201cTERRITORIAL\u201d embossed thereon, by<\/p>\n<p>a silk ribbon 3.175 centimetres in width. The ribbon shall be<\/p>\n<p>divided into 5 stripes by 4 white vertical lines. The stripe in<\/p>\n<p>the centre shall be orange and the other four stripes blue. The<\/p>\n<p>width of the orange stripe shall be double than that of a blue stripe.<\/p>\n<p>The orange colour denotes renunciation and sacrifice, blue devotion<\/p>\n<p>and white purity.<\/p>\n<p>4. The decoration shall be an award to Commissioned Officers<\/p>\n<p>of the Territorial Army for 20 years meritorious service<\/p>\n<p>of proved capacity. The qualifying service shall be reckoned in<\/p>\n<p>accordance with the conditions herein after mentioned.<\/p>\n<p>5. The following service shall count as two-fold qualifying<\/p>\n<p>service :-<\/p>\n<p>(a) The period of commissioned service rendered in a theare<\/p>\n<p>of war by an Officer of the late Indian Territorial<\/p>\n<p>Force or the late Auxiliary Force (India) during the<\/p>\n<p>period 3rd September 1939 to 2nd September 1945;<\/p>\n<p>(b) Embodied commissioned service in India by an Officer<\/p>\n<p>of the late Indian Territorial Force or the late Auxiliary<\/p>\n<p>379<\/p>\n<p>380<\/p>\n<p>Force (India) during the period 3rd September 1939 to<\/p>\n<p>2nd September 1945;n and<\/p>\n<p>(c) Embodied commissioned service in the Territorial Army<\/p>\n<p>during an emergency declared by Government.<\/p>\n<p>6. The following service shall count as single qualifying service:-<\/p>\n<p>(a) Commissioned Service in the Territorial Army;<\/p>\n<p>(b) Commissioned Service in the late Indian Territorial<\/p>\n<p>Force or on the active list of late Auxiliary Force<\/p>\n<p>(India) during the period 3rd September 1939 to 2nd<\/p>\n<p>September 1945;<\/p>\n<p>(c) Commissioned Service in the Army, the Navy and the<\/p>\n<p>Air Force during the period 3rd September 1939 to 2nd<\/p>\n<p>September 1945;<\/p>\n<p>(d) Commissioned Service in the Army, the Navy and the<\/p>\n<p>Air Force during an emergency declared by Government;<\/p>\n<p>(e) Service rendered as a Junior Commissioned Officer, Non-<\/p>\n<p>Commissioned Officer or Other Ranks in the Army and<\/p>\n<p>equivalent ranks of the Navy and the Air Force in a<\/p>\n<p>theatre of war during the period 3rd September 1939 to<\/p>\n<p>2nd September 1945;<\/p>\n<p>(f) Embodied service as a Junior Commissioned Officer,<\/p>\n<p>Non-Commissioned Officer or Other Ranks of the Indian<\/p>\n<p>Territorial Force or the Auxiliary Force (India) during<\/p>\n<p>the period 3rd September 1939 to 2nd September 1945;<\/p>\n<p>(g) Embodied service as a Junior Commissioned Officer,<\/p>\n<p>Non-Commissioned Officer or Other Ranks in the Territorial<\/p>\n<p>Army during an emergency declared by Government.<\/p>\n<p>7. The following service shall count as half-qualifying service:-<\/p>\n<p>(a) Service as a Junior Commissioned Officer, Non-Commissioned<\/p>\n<p>Officer or Other Ranks in the Territorial<\/p>\n<p>Army other than that covered by clauses sixthly and<\/p>\n<p>seventhly;<\/p>\n<p>(b) Unembodied service as a Junior Commissioned Officer,<\/p>\n<p>Non-Commissioned Officer or Other Ranks in the late<\/p>\n<p>.<\/p>\n<p>381<\/p>\n<p>382<\/p>\n<p>Indian Territorial Force or on the active list of the late<\/p>\n<p>Auxiliary Force in India, during the period 3rd September<\/p>\n<p>1939 to 2nd September 1945;<\/p>\n<p>(c) Service as a Junior Commissioned Officer, Non-Commissioned<\/p>\n<p>Officer or Other Rank in the Army or equivalent<\/p>\n<p>rank in the Navy and the Air Force during the<\/p>\n<p>period 3rd September 1939 to 2nd September 1945; and<\/p>\n<p>(d) Service rendered as a Junior Commissioned Officer, Non-<\/p>\n<p>Commissioned Officer or Other Ranks in the Army or<\/p>\n<p>equivalent ranks in the Navy and the Air Forced during<\/p>\n<p>an emergency declared by Government.<\/p>\n<p>8. No period of service in the force in which an officer<\/p>\n<p>qualified for the Efficiency Decoration shall be reckoned as qualifying<\/p>\n<p>service for the Territorial Army Decoration.<\/p>\n<p>9. Service requisite to qualify for the decoration shall not<\/p>\n<p>necessarily be continuous service.<\/p>\n<p>10. An officer already in possession of the Efficiency Decoration<\/p>\n<p>or any Long Service and Good Conduct Medal or Efficiency<\/p>\n<p>Medal and Clasp shall be eligible to receive the Territorial Army<\/p>\n<p>Decoration and to wear them provided that he has completed the<\/p>\n<p>full period of qualifying service for such awards and that no<\/p>\n<p>qualifying service towards one award is permitted to count towards<\/p>\n<p>the other.<\/p>\n<p>11. The miniature decoration which may be worn on certain<\/p>\n<p>occasions by those to whom the decoration is awarded shall be<\/p>\n<p>half the size of the decoration and a sealed pattern of the<\/p>\n<p>miniature decoration shall be deposited and kept.<\/p>\n<p>**12. The President may cancel and annual the award of the<\/p>\n<p>decoration to any person and he shall be required to surrender the<\/p>\n<p>decoration; but it shall be competent for the President to restore the<\/p>\n<p>decoration subsequently when such cancellation and annulment has<\/p>\n<p>been withdrawn.<\/p>\n<p>**13. It shall be competent for the Government to frame such<\/p>\n<p>instructions, as may be necessary, to carry out the purpose of<\/p>\n<p>these ordinances.<\/p>\n<p>**(Auth\u2014CS No 1\/7\/82)<\/p>\n<p>383<\/p>\n<p>384<\/p>\n<p>TERRITORIAL ARMY MEDAL<\/p>\n<p>1. The Medal shall be styled and designated the \u201cTERRITORIAL<\/p>\n<p>ARMY MEDAL\u201d.<\/p>\n<p>2. The medal shall be oval in shape, made of Silver, with<\/p>\n<p>a fixed fitting for the ribbon in the form of two leaves and<\/p>\n<p>a scroll on which shall be embossed the world \u201cTERRITORIAL\u201d.<\/p>\n<p>On the obverse, it shall have embossed the State Emblem and on<\/p>\n<p>the reverse the inscription. The award<\/p>\n<p>of a clap to the medal shall be denoted by a bar with the<\/p>\n<p>ASHOKA CHAKRA embossed in the centre to be worn on the<\/p>\n<p>ribbon of the medal. A sealed pattern of the medal shall be<\/p>\n<p>deposited and kept.<\/p>\n<p>3. The medal shall be suspended by a ribbon of dark blue<\/p>\n<p>silk, 3.175 centimeters in width. It shall be divided into six<\/p>\n<p>equal strips by five vertical lines. The central vertical line<\/p>\n<p>shall be orange in colour and the remaining four lines shall be<\/p>\n<p>white. The orange colour denotes renunciation and sacrifice,<\/p>\n<p>blue devotion and white purity.<\/p>\n<p>4. The medal shall be an award to Junior Commissioned<\/p>\n<p>Officers, Non-Commissioned Officers and Other Ranks of the<\/p>\n<p>Territorial Army for 12 years efficient service. The qualifying service<\/p>\n<p>shall be reckoned in accordance with the conditions hereinafter<\/p>\n<p>mentioned.<\/p>\n<p>5. The following service shall count as two-fold qualifying<\/p>\n<p>service.:&#8211;<\/p>\n<p>(a) The period of service rendered in a theatre of war by<\/p>\n<p>a member of the late Indian Territorial Force or the<\/p>\n<p>late Auxiliary Force (Indian) during the period 3rd September<\/p>\n<p>1939 to 2nd September 1945;<\/p>\n<p>(b) Embodied service in India by a member of the late<\/p>\n<p>Indian Territorial Force or the late Auxiliary Force<\/p>\n<p>(Indian) during the period 3rd September 1939 to 2nd<\/p>\n<p>September 1945; and<\/p>\n<p>(c) Embodied service in the Territorial Force during an<\/p>\n<p>emergency declared by Government.<\/p>\n<p>385<\/p>\n<p>386<\/p>\n<p>6. The following service shall count as single qualifying<\/p>\n<p>service :&#8211;<\/p>\n<p>(a) Service in the Territorial Army;<\/p>\n<p>(b) Service in the late Indian Territorial Force or on the<\/p>\n<p>active list of the late Auxiliary Force (India) during<\/p>\n<p>the period 3rd September 1939 to 2nd September 1945;<\/p>\n<p>(c) Service in the Army, the Navy and the Air Force during<\/p>\n<p>the period 3rd September 1939 to 2nd September 1945;<\/p>\n<p>and<\/p>\n<p>(d) Service in the Army, the Navy and the Air Force during<\/p>\n<p>an emergency declared by Government.<\/p>\n<p>7. A clasp to be worn on the ribbon of the medal, shall be<\/p>\n<p>awarded to those who having been awarded the medal complete<\/p>\n<p>a total of 18 years efficient service and a further clasp shall be<\/p>\n<p>awarded after completing 24 years service. When the ribbon is<\/p>\n<p>worn without the medal, the grant of clasps shall be denoted by<\/p>\n<p>the wearing on the ribbon of small Silver rosettees, one or more<\/p>\n<p>according to the number of clasps awarded.<\/p>\n<p>8. No period of service in the force which has previously<\/p>\n<p>been counted for any Long Service, Good Conduct or Efficiency<\/p>\n<p>Medals\/Clasps shall be reckoned as qualifying service for the<\/p>\n<p>Territorial Army Medal.<\/p>\n<p>9. Service requisite to qualify for the medal shall not necessarily<\/p>\n<p>be continuous service.<\/p>\n<p>10. The recipient of any Long Service, Good Conduct or<\/p>\n<p>Efficiency Medal and Clasps shall be eligible to receive the Territorial<\/p>\n<p>Army Medal and clasps and to wear them, provided that<\/p>\n<p>he has completed the full periods of qualifying service for such<\/p>\n<p>awards and that no qualifying service towards one award is<\/p>\n<p>permitted to count towards the other.<\/p>\n<p>11. The miniature medal which may be worn on certain<\/p>\n<p>occassion by those to whom the medal is awarded shall be half<\/p>\n<p>the size of the medal and a sealed pattern of the said miniature<\/p>\n<p>medal shall be deposited and kept.<\/p>\n<p>**12. The President may cancel and annual the award of the<\/p>\n<p>Medal to any person and he shall be required to surrender the<\/p>\n<p>Medal; but it shall be competent for the President to restore the<\/p>\n<p>Medal subsequently when such cancellation and annulment has<\/p>\n<p>been withdrawn.<\/p>\n<p>**13.
