APPENDIX II<\/span><\/strong><\/p>\n

THE TERRITORIAL ARMY ACT RULES 1948<\/span><\/strong><\/p>\n

In exercise of the powers conferred by section 14 of the<\/p>\n

Territorial Army Act 1948 (LVI of 1948), the Central Government<\/p>\n

is pleased to make the following rules:-<\/p>\n

1. Short title\u2014These rules may be called the Territorial<\/p>\n

Army (Amendment) Rules, 1964. They extend to the whole of<\/p>\n

India.<\/p>\n

2. Definitions-In these rules, unless there is anything<\/p>\n

repugnant in the subject or context:-<\/p>\n

(a) \u201cthe Act\u201d means the Territorial Army Act, 1948;<\/p>\n

(b) \u201cForm\u201d means a Form as set out in Schedule 1;<\/p>\n

(c) \u201cSchedule\u201d means a schedule to these rules;<\/p>\n

(d) \u201cSection\u201d means a section of the act;<\/p>\n

(e) \u201ctraining year\u201d means a period of twelve months<\/p>\n

beginning on the first day of April and ending on the<\/p>\n

thirty first day of March;<\/p>\n

(f) the expression \u201cOfficer Commanding the Area\u201d means<\/p>\n

the General or other officer commanding an Area or an<\/p>\n

Independent Sub Area, or an equivalent Commander<\/p>\n

within the limits of whose command the headquarters<\/p>\n

of a unit constituted under the Act is situated or such<\/p>\n

other officer as may be specified by the Central Government<\/p>\n

in this befhalf.<\/p>\n

(g) \u201cProvincial Unit\u201d means a unit having training annually<\/p>\n

in camp.<\/p>\n

(h) \u2018Urban unit\u201d means a unit having training throughout<\/p>\n

the year on the weekly drill system and at an<\/p>\n

annual camp\u201d.<\/p>\n

3. Constitution and zones-(a) Units of the Territorial<\/p>\n

Army shall be raised on a zonal basis.<\/p>\n

(b) Zones shall be constituted and defined by the Central<\/p>\n

Government by notification in the official Gazette.<\/p>\n

(c) The Central Government may, by notification in the<\/p>\n

Official Gazette constitute for any zone, one or more provincial<\/p>\n

units or one or more urban units of the Territorial Army.<\/p>\n

(d) Provided that the Central Government may, however<\/p>\n

it considers it necessary, direct that recruitment to Territorial<\/p>\n

Army units may be made from persons (being citizens of India)<\/p>\n

irrespective of their place of residence.<\/p>\n

PART 1-ENROLMENT<\/span><\/strong><\/p>\n

4. Qualifications of enrolment-No person shall be eligible<\/p>\n

for enrolment as a member of the Territorial Army-<\/p>\n

(a) unless he is of good character: (ia) The Central Government<\/p>\n

may relax the condition prescribed in clause<\/p>\n

(c) in respect of any or all units of the Territorial<\/p>\n

Army.<\/p>\n

(b) Unless he has attained the age of 18 years and has not<\/p>\n

attained the age of-<\/p>\n

(i) 40 years in the case of enrolment in the Railways<\/p>\n

or Port, Dock, inland water Transport or Electrical<\/p>\n

and Mechanical Engineer units;<\/p>\n

(ii) 45 years in the case of enrolment in Posts and<\/p>\n

Telegraphs units.<\/p>\n

(iii) 45 years in the case of women employees of Posts<\/p>\n

and Telegraphs Department enrolled in the posts<\/p>\n

Telegraphs units.<\/p>\n

(iv) *42 years in all other cases.<\/p>\n

(c) unless he is a resident of the zone for which the unit<\/p>\n

in which enrolment has been applied for is constituted.<\/p>\n

(d) unless he satisfies such standards of physical fitness<\/p>\n

in height, chest measurement and other respects as<\/p>\n

may be specified by the Ministry of Defence, Government<\/p>\n

of India;<\/p>\n

(e) if he is in the service of the Central or a State Government<\/p>\n

unless he has obtained from the Government<\/p>\n

permission for enrolment and also a certificate to the<\/p>\n

effect that his services will forthwith be made available<\/p>\n

for service in the Territorial Army, whenever required;<\/p>\n

(f) if he belongs to any Reserve Force.<\/p>\n

(g) if he has any reserve liability.<\/p>\n

(h) if he has at any time been convicted of an offence involving<\/p>\n

moral turpitude and a sentence other than one<\/p>\n

of fine or of imprisonment in default of payment of<\/p>\n

fine has been passed in respect of such offence, such<\/p>\n

sentence not having been subsequently reversed or remitted<\/p>\n

or the offence pardoned.<\/p>\n

(j) if he has been ordered to give security for good behaviour<\/p>\n

under the Code of Criminal Procedure 1898.<\/p>\n

(k) If he has been dismissed from the Territorial Army<\/p>\n

or the Auxiliary Forces (India or the Indian Territorial<\/p>\n

Force, Militia or the scouts, regular army or the<\/p>\n

Navy or the Air Force;<\/p>\n

(l) if he has more than one wife living.<\/p>\n

Provided that\u2014<\/p>\n

(i) the Chief of the Army Staff, in any case, and any<\/p>\n

authority empowered by the Chief of the Army Staff in<\/p>\n

this behalf, in such cases and to such extent as the<\/p>\n

Chief of the Army Staff may specify, may relax the<\/p>\n

age limits prescribed by clause (b)<\/p>\n

(ia) The Central Govt may relax the condition specified in<\/p>\n

clause (e) in respect of any unit or all units of the Territorial<\/p>\n

Army.<\/p>\n

(ii) a person who is ineligible by virtue of the provisions<\/p>\n

in clause (h) or (j) may be enrolled if he produces a<\/p>\n

certificate that he is fit to be enrolled from the Govt<\/p>\n

of the State of which he is a resident.<\/p>\n

(iii) The Central Government may, for special reasons exempt<\/p>\n

any person from the operation of clause (k).<\/p>\n

5. Application for enrolment\u2014(I) A person desirous of being<\/p>\n

enrolled shall apply to the Officer Commanding a unit for<\/p>\n

service in which he desires to be enrolled or to an officer who<\/p>\n

is a recruiting officer or assistant recruiting officer for the purpose<\/p>\n

of the enrolment of persons under the Army Act, 1950,<\/p>\n

or to such other officer as may be appointed by the Central<\/p>\n

Government in this behalf.<\/p>\n

(2) The officer to whom an application under sub-rule (I)<\/p>\n

is made shall cause the applicant to fill up and sign in his presence<\/p>\n

a statement set forth in Form I.<\/p>\n

6. Verification\u2014The officer aforesaid\u2014<\/p>\n

(a) shall satisfy himself in the manner laid down by the<\/p>\n

Central Government that the application is in order<\/p>\n

and that the applicant is eligible for enrolment under<\/p>\n

rule 4 and<\/p>\n

(b) may make such further inquiry as he thinks necessary<\/p>\n

regarding the suitability of the applicant for enrolment<\/p>\n

in the unit.<\/p>\n

7. Medical Examination\u2014Where such officer is satisfied<\/p>\n

that the application is in order, that the applicant fulfils the<\/p>\n

conditions of enrolment, that he is suitable for enrolment in the<\/p>\n

unit in which he desires to be enrolled, and that a vacancy<\/p>\n

exists in that unit, he shall cause the applicant to be served<\/p>\n

with a notice requiring him to present himself for medical examination<\/p>\n

at a time and place to be specified in the notice.<\/p>\n

8. Rejection\u2014Where such officer is satisfied that the application<\/p>\n

is not in order or that the applicant does not fulfil the<\/p>\n

conditions of enrolment or that he is not suitable to be enrolled<\/p>\n

in the unit of his choice or if the applicant fails to comply with<\/p>\n

the notice served on him under rule 7 or is found to be medically<\/p>\n

unfit for service in the Territorial Army, such officer shall<\/p>\n

reject the application and shall inform the applicant accordingly.<\/p>\n

Such applicant shall, however, have a right of appeal against<\/p>\n

the decision of the officer who rejected his application to the<\/p>\n

Commander of the Sub Area in which the unit of his choice is<\/p>\n

located.<\/p>\n

9. Method of enrolment\u2014(a) If the applicant is accepted<\/p>\n

for enrolment he shall be required to sign a declaration at the<\/p>\n

foot of Form I.<\/p>\n

(b) Where the Officer referred to in sub rule (I) of rule 5<\/p>\n

is satisfied that the applicant understands the questions put to<\/p>\n

him and consents to the conditions of service, he shall sign a<\/p>\n

certificate to that effect on the said Form, and the applicant<\/p>\n

shall thereupon be deemed to be enrolled.<\/p>\n

10. Attestation\u2014(a) Every person enrolled shall be attested<\/p>\n

by his commanding Officer and for this purpose an oath<\/p>\n

or affirmation shall be administered to him in one of the forms<\/p>\n

specified in form II, or in such other form to the same purport<\/p>\n

as the Commanding Officer deems to be in accordance with the<\/p>\n

religion of the person to be attested or otherwise binding on<\/p>\n

his conscience.<\/p>\n

(b) An entry of the fact that a person enrolled has taken<\/p>\n

the oath or affirmation directed by this rule shall be endorsed<\/p>\n

on the enrolment form signed by him and shall be authenticated<\/p>\n

by the signature of the Commanding Officer.<\/p>\n

11. Period of enrolment\u2014Subject to the provisions of Part<\/p>\n

III of these rules, the period of enrolment as a Member of the<\/p>\n

Territorial Army , in the case of every person who is accepted<\/p>\n

for such enrolment in the Territorial Army on or after the 1st<\/p>\n

day of January 1972, be seven years commencing on and from<\/p>\n

the date of his enrolment for service in the Territorial Army.<\/p>\n

Provided that\u2014<\/p>\n

(i) the service of any person in the Territorial Army as<\/p>\n

aforesaid may be extended with the consent of the<\/p>\n

individual by two years at a time or by such longer<\/p>\n

periods as may be specified in this behalf by the<\/p>\n

Director Territorial Army, but the maximum period of<\/p>\n

service of any person in the Territorial Army shall not<\/p>\n

exceed *Seventeen years for other ranks and *Twenty years<\/p>\n

for Non-Commissioned Officers commencing on and<\/p>\n

from the date of his enrolment for such service;<\/p>\n

(ii) nothing contained in this rule shall apply to a person<\/p>\n

enrolled prior to the 1st day of January 1972 except<\/p>\n

that such person shall not carry out reserve liability on<\/p>\n

expiry of this period of enrolment specified before the<\/p>\n

date aforesaid.<\/p>\n

PART I\u2014A LIABILITY FOR COMPULSORY SERVICE IN<\/span><\/strong><\/p>\n

THE TERRITORIAL ARMY<\/span><\/strong><\/p>\n

11A. Power to call upon persons to perform service in<\/p>\n

Territorial Army\u2014Where the Central Government is of opinion<\/p>\n

that it is necessary so to do, it may, by a notification in the official<\/p>\n

Gazette, direct that all or any of the employees or certain classes<\/p>\n

of employees of a certain office or group of offices in a specified<\/p>\n

area, under the Central Government or a State Government or<\/p>\n

in the public utility service, who has or have attained the age of<\/p>\n

twenty years but has or have not completed the age of forty<\/p>\n

years, shall, when called upon to do so, perform service in the<\/p>\n

Territorial Army;<\/p>\n

Provided that in selecting persons to perform service in the<\/p>\n

Territorial Army, the Central Government shall have regard to<\/p>\n

the age, physical fitness, qualifications, experience and also the<\/p>\n

nature of work, previously performed by the persons concerned<\/p>\n

while employed under the Government or in a public utility<\/p>\n

service and the work to be performed by him in the Territorial<\/p>\n

Army.<\/p>\n

Note–**(1) Officers and enrolled persons of the Territorial Army<\/p>\n

shall also be liable to perform military service beyond the limits<\/p>\n

of INDIA.<\/p>\n

11B. Prescribed authority for purposes of sections 6A and<\/p>\n

10A\u2014(I) The prescribed authority for the purpose of sub sections<\/p>\n

(2) and (3) of section 6A shall be the Central Government<\/p>\n

in all cases.<\/p>\n

(2) The prescribed authority for the purpose of sub-section<\/p>\n

(4) of section 6A and clause (c) of section 10A shall\u2014<\/p>\n

(i) in relation to persons who are required to join the<\/p>\n

Territorial Army as enrolled persons, be the Director<\/p>\n

Territorial Army or the Recruiting Officer or the Assistant<\/p>\n

Recruiting Officer of the area or place in which<\/p>\n

such persons are for the time being employed:<\/p>\n

(ii) in relation to persons who are required to join the Territorial<\/p>\n

Army as Junior Commissioned Officer, be the<\/p>\n

Director, Territorial Army or the Officer Commanding<\/p>\n

in the Area in which such persons are for the time being<\/p>\n

employed: and<\/p>\n

(iii) in relation to persons who are required to join the Territorial<\/p>\n

Army as officers, be the Director, Territorial<\/p>\n

Army.<\/p>\n

3. The prescribed authority for the purpose of sub section<\/p>\n

(5) of section 6A shall be the Officer Commanding the Area in<\/p>\n

which the office of the employer is located.<\/p>\n

11C. Obtaining particulars of persons liable for compulsory<\/p>\n

service\u2014The authority specified in sub rule (2) of rule 11B may<\/p>\n

serve any employer with a notice in the form set out in Schedule<\/p>\n

11B requiring him to furnish to such authority particulars specified<\/p>\n

in the Forms set out in Schedules 11C & 11D relating to<\/p>\n

any of his employees or class of employees who are liable under<\/p>\n

the Act to perform compulsory service in the Territorial Army<\/p>\n

within such period (not less than ten days after the service of the<\/p>\n

notice) as may be specified in the notice.<\/p>\n

11.D. Collection of particulars of persons liable for compulsory<\/p>\n

service\u2014(1) Any person who is liable for compulsory service<\/p>\n

in the Territorial Army may be served with a written notice in<\/p>\n

the Form set out in schedule 11E by the authority specified in<\/p>\n

sub rule (I) of rule 11B requiring such person to fill up, sign<\/p>\n

and dodge the Form set out in schedule II-F with such authority<\/p>\n

and within such time (not earlier than seven days after the<\/p>\n

service of the notice) as may be specified in the notice.<\/p>\n

(2) Every such person who has lodged the Form set out in<\/p>\n

schedule II-F with the authority under sub rule (1) shall be<\/p>\n

bound to report to that authority any change in the particulars<\/p>\n

given by him in that Form, within twenty one days of occurrence<\/p>\n

of such change.<\/p>\n

(3) Every such person shall be bound to furnish such additional<\/p>\n

information as may be required from him by the authority.<\/p>\n

11E. Liability to attend interviews, Tests and medical examinations\u2014<\/p>\n

If the authority specified in sub rule (1) of rule 11B considers<\/p>\n

that a person who has lodged the form under rule 11D<\/p>\n

is qualified to join the Territorial Army as an officer or as an<\/p>\n

enrolled person, that authority shall serve upon such person a<\/p>\n

written notice in the Form set out in Schedule IIG requiring him<\/p>\n

to attend such interviews, undergo such tests and examinations,<\/p>\n

including physical tests, and submit to such medical examinations<\/p>\n

as may be specified in the notice. Any date or dates fixed for<\/p>\n

such interview, tests and examinations shall not be earlier than<\/p>\n

seven days after the service of the notice.<\/p>\n

11F. Joining the Territorial Army\u2014(1) If the authority specified<\/p>\n

in sub rule (I) of rule 11B finds, after the interviews, tests<\/p>\n

and examinations referred to in rule 11E, and after making such<\/p>\n

further inquiries, if any, that a person is suitable for performing<\/p>\n

service in the Territorial Army, that authority shall serve upon<\/p>\n

that person a notice in the form set out in Schedule II-H stating<\/p>\n

that he shall join the Territorial Army as an officer, or Junior<\/p>\n

Commissioned Officer or enrolled person, and requiring him to<\/p>\n

present himself to such authority, and at such place, date and<\/p>\n

time as may be specified in the notice, such date being not<\/p>\n

earlier that seven days after the service of the notice.<\/p>\n

(2) On any person reporting to an authority in pursuance of<\/p>\n

a notice serviced under sub rule (I) that authority shall sign the<\/p>\n

following certificate at the foot of the Form set out in Schedule<\/p>\n

11-H, namely :-<\/p>\n

Certified that …………………………(here insert the name of<\/p>\n

the person) has joined______________(here insert the Terri117<\/p>\n

torial Army unit where the person has reported) on_________<\/p>\n

(here insert the date of reporting as an officer\/JCO\/enrolled person)<\/p>\n

Place<\/p>\n

Date:–<\/p>\n

Signature of authority<\/p>\n

*(Delete whichever not applicable)<\/p>\n

(3) Every person who joins the Territorial Army as an<\/p>\n

enrolled person in pursuance of a notice under sub rule (1) shall<\/p>\n

sign part I of the Form set out in Schedule II-I and, as from<\/p>\n

the date of such joining, be deemed to be enrolled in the Territorial<\/p>\n

Army for the same period for which persons are enrolled<\/p>\n

under rule II, and appointed to the unit indicated in the aforesaid<\/p>\n

notice. He shall also be attested as provided in rule 10 and<\/p>\n

a record of the fact shall be made in Part II of the said Form.<\/p>\n

11G. Notices\u2014(1) Any notice to be served on a person under<\/p>\n

this part, shall be either personally delivered to such persons<\/p>\n

or sent to him by registered post at his last known address.<\/p>\n

(2) When a notice has been served on any person under<\/p>\n

this part, the authority who issued the notice, may at any time,<\/p>\n

while that person remains liable for compulsory service under<\/p>\n

the Act, cancel it and, in any such case, shall cause to be served<\/p>\n

on that person a further notice cancelling the original notice.<\/p>\n

(3) A notice served on any person under this part shall cease<\/p>\n

to have effect if, before the date on which he is thereby required<\/p>\n

to present himself he ceases to be liable for compulsory service<\/p>\n

in the Territorial Army.<\/p>\n

11H. Mode of lodging forms\u2014Any form to be lodged under<\/p>\n

this part shall be either delivered at the office of the authority<\/p>\n

with whom it is required to be lodged or sent by registered post<\/p>\n

to such authority.<\/p>\n

11-I. Payment of travelling and other allowances\u2014Every<\/p>\n

person liable for compulsory service in the Territorial Army, who<\/p>\n

is required to present himself in accordance with any notice under<\/p>\n

this part, shall be paid by the authority to whom he presents<\/p>\n

himself, travelling and other allowances at such rates as may be<\/p>\n

determined by Government from time to time.<\/p>\n

Provided that such rates shall in no case be less than those<\/p>\n

admissible to the said person in his civil appointment under<\/p>\n

similar conditions.<\/p>\n

11-J. Appeals-(1) If any person liable for compulsory<\/p>\n

service in the Territorial Army or his employer, feels aggrieved by<\/p>\n

any notice issued under the rules in this Part, he may appeal<\/p>\n

against such notice to the authority specified in sub rule, (2).<\/p>\n

(2) The authority to which an appeal may be made under<\/p>\n

sub rule (1), shall be-<\/p>\n

(i) The Central Government, if the notice was issued by<\/p>\n

the \u2018ADGTA, Army Headquarters\u2019,<\/p>\n

(ii) The Chief of the Army Staff, if the notice was issued<\/p>\n

by an Officer Commanding the Area or by a Recruiting<\/p>\n

or Assistant Recruiting Officer.<\/p>\n

(3) Every appeal under this rule shall be made within fifteen<\/p>\n

days of the receipt of the notice by the aggrieved person.<\/p>\n

(4) Any notice against which an appeal has been made under<\/p>\n

this rule, shall be deemed to be suspended until the decision<\/p>\n

on the appeal is communicated to the appellant, and if the decision<\/p>\n

is against the appellant, the time fixed in the original notice<\/p>\n

for compliance shall commence from the day on which the decision<\/p>\n

of the appellate authority is communicated to him.<\/p>\n

(5) Every appeal under this rule shall be forwarded in the<\/p>\n

first instance to the authority who issued the notice appealed<\/p>\n

against, and that authority shall forward the appeal to the appellate<\/p>\n

authority with his report thereon.<\/p>\n

(6) (a) The decision of the Central Government on appeal<\/p>\n

under sub rule 2(i) shall be final.<\/p>\n

(b) Any person aggrieved by the decision of the Chief of<\/p>\n

the Army Staff on appeal under sub rule 2(ii) may file a revision<\/p>\n

to the Central Government and the decision of the Central Government<\/p>\n

thereon shall be final.<\/p>\n

PART II-APPOINTMENT AND TRANSFER<\/strong><\/p>\n

12. Appointment-(a) A person enrolled in the Territorial<\/p>\n

Army shall be appointed by the officer who enrolled him to a unit<\/p>\n

of the Territorial Army.<\/p>\n

(b) Rules for appointment of officers of the Territorial Army<\/p>\n

shall be the same as for the regular army.<\/p>\n

13. Transfer and attachment-(1) Any person appointed to<\/p>\n

a unit under rule 12 may be transferred by the prescribed authority<\/p>\n

whether on disbandment of the unit or otherwise to another<\/p>\n

unit of the Territorial Army or the Director of Signals.<\/p>\n

(2) Nothing contained in sub rule (1) shall be deemed to<\/p>\n

authorise the transfer without his own consent of any person appointed<\/p>\n

to a unit except when such transfer is deemed necessary<\/p>\n

and a period of emergency declared in this behalf in a notification<\/p>\n

published in the official gazette by the Central Government<\/p>\n

or such transfer is from one provincial unit to another<\/p>\n

similar provincial unit within the same zone, or from one uraban<\/p>\n

unit together similar urban unit in the same town.<\/p>\n

. (3) A person who desires to be transferred to another unit<\/p>\n

shall submit his application in writing to his Commanding Officer<\/p>\n

and in such application shall state reasons for desiring the transfer<\/p>\n

and the unit to which he desires to be transferred. There upon<\/p>\n

the transfer shall be effected in the case of an enrolled person by<\/p>\n

mutual agreement between his Commanding Officer and<\/p>\n

the Commanding Officer of the unit to which he desires to be transferred,<\/p>\n

and in the case of an officer by order of the prescribed authority.<\/p>\n

(4) When a person belonging to a unit ceases to reside in<\/p>\n

the zone for which such unit is constituted he may be compulsorily<\/p>\n

transferred by the prescribed authority to a unit constituted for<\/p>\n

the zone in which he for the time being resides provided that he<\/p>\n

can be absorbed in such unit.<\/p>\n

(5) Any person belonging to a unit may be attached by the<\/p>\n

prescribed authority at his own request or otherwise to any unit<\/p>\n

of the Territorial Army or to any unit of the regular army.<\/p>\n

(6) Any person belonging to a unit who leaves his place of<\/p>\n

residence for the time being and thereby leaves the zone in which<\/p>\n

the unit wherein he is serving is constituted shall, if he does not<\/p>\n

intend to return to that zone, notify the prescribed authority in<\/p>\n

that zone of his change of residence.<\/p>\n

(7) Where a person mentioned in sub rule (6) intended to return<\/p>\n

but did not in fact return to his zone within three months of<\/p>\n

his departure he shall immediately on the expiry of the said<\/p>\n

period send intimation in writing to the prescribed authority.<\/p>\n

Explanation\u2014In this rule, the expression \u201cprescribed authority<\/p>\n

means\u2014<\/p>\n

(1) In the case of an enrolled person the Officer Commanding<\/p>\n

the Sub-Area\/Div\/Independent Sub-Area\/Indep Bde<\/p>\n

Gp\/Indep Bde as the case may be within which the<\/p>\n

unit of the person is constituted or the Director Territorial<\/p>\n

Army or the Director of Signals.<\/p>\n

(2) In the case of an officer the Director Territorial Army or<\/p>\n

Director of Signals.<\/p>\n

PART III<\/span><\/strong><\/p>\n

14. Discharge\u2014(a) Every person enrolled shall, on becoming<\/p>\n

entitled to receive his discharge under the Act or these rules,<\/p>\n

be so discharge with all convenient speed.<\/p>\n

(b) Any such person may be discharged as hereinafter provided<\/p>\n

on any of the following grounds namely\u2014<\/p>\n

(i) That he has been convicted by a criminal court of an<\/p>\n

offence punishable with transportation or imprisonment.<\/p>\n

(ii) That he has in filling up any form prescribed by these<\/p>\n

rules or otherwise for the purpose of obtaining his enrolment<\/p>\n

made any statement which was false and which<\/p>\n

he knew to be false or did not believe to be true.<\/p>\n

(iii) That his services are no longer required.<\/p>\n

(iv) That he is medically unfit for further service.<\/p>\n

(c) Discharge, dismissal, removal, retirement\u2014Officers\u2014<\/p>\n

Rules for the discharge, dismissal, removal and retirement of the<\/p>\n

officers of the Territorial Army shall be the same as for the regular<\/p>\n

army provided that the retiring age for the officers of the<\/p>\n

Territorial Army shall be as specified in the table below\u2014<\/p>\n

**(d) Notwithstanding, anything contained in clause (c) of rule 14, the<\/p>\n

Territorial Army Officers who do not attend annual training camps for two<\/p>\n

consecutive years without securing the exemption, as provided for in subrule<\/p>\n

(2) of 20 of these rules and who cannot urge any valid reasons,<\/p>\n

justifying their absence from such training, may, for reasons to be<\/p>\n

recorded in writing by the competent authority, be discharged from the<\/p>\n

Territorial Army service.<\/p>\n

(e) An Officer of the Departmental (TA) units who<\/p>\n

resigns\/is dismissed\/removed from his civil job of the concerned<\/p>\n

Department shall automatically relinquish his commission<\/p>\n

from the Territorial Army w.e.f. the date of release from the civil<\/p>\n

department.<\/p>\n

15. (1) The authority competent to authorise the discharge<\/p>\n

of an enrolled person under the provisions specified in column I<\/p>\n

of the annexed table shall subject to the provision of sub rule<\/p>\n

2 be the authority specified in the corresponding entry in coloumn<\/p>\n

2 thereof.<\/p>\n

123<\/p>\n

(1A) Where a discharge is authorised under the provisions<\/p>\n

of clause (ii) and (iii) of sub rule (b) of rule 14, the competent<\/p>\n

authority before authorising the discharge shall if the circumstances<\/p>\n

of the case permit, give the enrolled person an opportunity<\/p>\n

to show cause against the discharge, unless such discharge<\/p>\n

is at the request of the enrolled person.<\/p>\n

(2) In a case in which the authority competent to authorise<\/p>\n

discharge under sub rule (1) is the Commanding Officer, the discharge<\/p>\n

may also be authorised by the Officer Commanding the<\/p>\n

Sub-Area, the Area, TA Group Commander , the General Officer<\/p>\n

Commanding-in-Chief a Command, the Chief of the Army<\/p>\n

staff or the Central Government, and in a case in which the<\/p>\n

authority competent to authorise discharge thereunder is the<\/p>\n

Officer Commanding sub-Area\/TA Group Commander, the discharge<\/p>\n

may also be authorised by the Officer Commanding the<\/p>\n

Area, the General Officer Commanding-in-Chief the Command,<\/p>\n

the Chief of the Army Staff or the Central Government.<\/p>\n

(3) Any enrolled person discharged under sub-rule (1) or subrule<\/p>\n

(2) shall have a right of appeal against the decision of the<\/p>\n

authority which authorised his discharge to the next higher authority<\/p>\n

provided that there shall be no appeal where the order of<\/p>\n

discharge is made by the Central Government.<\/p>\n

(4) A discharge duly authorised under this rule shall be<\/p>\n

carried out by the Commanding Officer with all convenient<\/p>\n

speed.<\/p>\n

16. Discharge on application\u2014(1) Any enrolled person not<\/p>\n

entitled to his discharge under the Act or these rules who is<\/p>\n

desirous of being discharged before the expiration of the period<\/p>\n

for which he was enrolled, shall apply in writing stating the<\/p>\n

reason for his application to the Officer Commanding the unit<\/p>\n

to which he is for the time being appointed.<\/p>\n

(2) The Officer Commanding the unit shall, on receipt of<\/p>\n

such an application forward the same to the Sub Area or TA<\/p>\n

Group Commander or an equivalent or higher Commander who<\/p>\n

may in his discretion authorise the discharge of such applicant.<\/p>\n

17. Discharge Certificate\u2014Every enrolled person who is<\/p>\n

discharged from the Territorial Army shall be furnished by his<\/p>\n

Commanding Officer with a Certificate similar to that referred to<\/p>\n

in section 23 of the Army Act 1950.<\/p>\n

PART IV \u2013 TRAINING<\/span><\/strong><\/p>\n

18. Military Training\u2014Military training for Territorial<\/p>\n

Army unit shall consist of\u2014<\/p>\n

(a) Recruit Training<\/p>\n

(b) Annual Training<\/p>\n

(bb) Post Commission Training<\/p>\n

(c) Voluntary Training and<\/p>\n

(d) Service on the permanent staff<\/p>\n

19. Recruit Training\u2014(a) Every person appointed to a provincial<\/p>\n

unit shall be liable for the purpose of undergoing recruit<\/p>\n

training, to be embodied under the orders of the Officer Commanding<\/p>\n

the Area\/TA Group Commander in which the unit is<\/p>\n

located, for a period or periods not exceeding in the aggregate 30<\/p>\n

days in any one year.<\/p>\n

(b) Every member of an urban unit other than Railway<\/p>\n

Engineers units or Signal (Post and Telegraphs) units, or General<\/p>\n

hospital (TA) unit, shall be liable to undergo recruit training<\/p>\n

for a period of 32 days, during which period he may be<\/p>\n

embodied for not less than four consecutive days. This embodied<\/p>\n

period, may, however, be extended upto a maximum of fourteen<\/p>\n

consecutive days in all provided that, in so far as the additional<\/p>\n

period beyond the initial period of four days in concerned, the<\/p>\n

individual volunteers and obtains the written consent of his<\/p>\n

employer, if any.<\/p>\n

125<\/p>\n

(bb) Every member of a General Hospital (TA) shall be<\/p>\n

liable for the purpose of undergoing recruit training to be embodied<\/p>\n

under the orders of the Officer Commanding the Area or<\/p>\n

TA Group Commander in which the General Hospital (TA) unit<\/p>\n

is located for a period not exceeding thirty days in any one training<\/p>\n

year. The training will be on urban system without a<\/p>\n

camp.<\/p>\n

(c) Every member of a Railway Engineer unit or Signal<\/p>\n

(Post & Telegraph) unit shall be liable for the purpose of undergoing<\/p>\n

recruit training, to be embodied under the orders of the<\/p>\n

Officer Commanding the Area\/TA Group Commander in which<\/p>\n

the unit is located for a period of thirty days in any one year.<\/p>\n

(d) Every member of an Urban unit shall be liable for the<\/p>\n

purpose of firing the annual musketry course to be embodied for<\/p>\n

one day in the year in addition to the period prescribed in<\/p>\n

clause (b). Such periods of embodiment shall only take place on<\/p>\n

Sundays or other recognised holidays.<\/p>\n

(e) The Officer Commanding of any unit may exempt either<\/p>\n

wholly or in part from liability to undergo recruit training any<\/p>\n

person who has in his opinion undergone adequate military training<\/p>\n

in the regular army or otherwise.<\/p>\n

Explanation\u2014For the purpose of clause (b), a day shall<\/p>\n

consist of 4 hours of actual military drill or instruction, and<\/p>\n

may be made up of fractions of a day not more than 4 in<\/p>\n

number.<\/p>\n

20. Annual Training\u2014(I) Every person who has undergoned<\/p>\n

the recruit training required by rule 19, or has been exempted<\/p>\n

from undergoing such training shall be liable to undergo annual<\/p>\n

training as hereinafter provided namely\u2014<\/p>\n

(a) Every such person who is appointed to a Provincial unit<\/p>\n

shall be liable to be embodied, ;under the orders of the Officer<\/p>\n

Commanding the Area\/TA Group Commander in which the<\/p>\n

unit is located, for annual training for period not exceeding two<\/p>\n

calendar months in each training year, whether or not such person<\/p>\n

has been embodied for recruit training that year.<\/p>\n

(b) Every such person who is appointed to an urban unit<\/p>\n

other than Railway Engineers unit or Signal (Post and Telegraph)<\/p>\n

unit or General Hospital (TA) unit shall be liable to<\/p>\n

undergo annual training for a period of not less than 36 days,<\/p>\n

and not more than 60 days, subject to the provision that he shall<\/p>\n

attend a minimum of three days training during every month for<\/p>\n

9 months in the year excluding the days spent in camp. During<\/p>\n

the aforesaid period of training, he may, under orders of the Officer<\/p>\n

Commanding the Area\/TA Gp Cdr in which the unit is<\/p>\n

located, be embodied for an annual camp of not less than fourteen<\/p>\n

consecutive days.<\/p>\n

Explanation\u2014For the purposes of clause (b) a day shall consist<\/p>\n

of 4 hours of actual military drill or instruction, and may<\/p>\n

be made up of fractions of a day not more than 4 in number.<\/p>\n

(ba) Every such person who is appointed to a General Hospital<\/p>\n

(TA) unit shall be liable to be embodied, under the orders<\/p>\n

of the Officer Commanding the Area or TA Group Commander<\/p>\n

in which the General Hospital (TA) unit is located, for annual<\/p>\n

training for a period of thirty days in each training year. The<\/p>\n

training will be on urban system without a camp.<\/p>\n

(bb) Every such person who is appointed to a General<\/p>\n

Hospital (TA)unit may, under the orders of the Area or Independent<\/p>\n

Sub Area Commander or TA Group Commander, be<\/p>\n

embodied for a period not exceeding seven days for the purpose<\/p>\n

of passing prescribed trade tests;<\/p>\n

Provided that the individual volunteers and obtains the written<\/p>\n

consent of the employer, if any. The period of embodiment<\/p>\n

shall count against the period of annual training as prescribed<\/p>\n

in clause (ba).<\/p>\n

(c) Every member of a Railway Engineer Unit or Signal<\/p>\n

(Post and Telegraph) unit shall be liable, for the purpose of undergoing<\/p>\n

annual training, to be embodied under the orders of the<\/p>\n

officer Commanding the Area\/TA Group Commander in which<\/p>\n

the unit is located, for a period of thirty days in each training<\/p>\n

year, whether or not such person was embodied for recruit training<\/p>\n

that year.<\/p>\n

(d) Every person who is appointed to an urban unit shall be<\/p>\n

liable, for the purpose of firing the annual musketry course, be<\/p>\n

embodied for a period not exceeding one day in the year in<\/p>\n

addition to the period prescribed in clause (b) of Rule 20(1).<\/p>\n

The period of one day of embodiment for the purpose of<\/p>\n

firing annual musketry course may be increased to two days in<\/p>\n

cases where the training could not be completed in one day provided<\/p>\n

that the increased period on one day is within the maximum<\/p>\n

period of annual training laid down in clause (b). Such<\/p>\n

period of embodiment shall only take place on Sundays or recognised<\/p>\n

holidays.<\/p>\n

127<\/p>\n

(c) Junior Commissioned Officers and other ranks (other<\/p>\n

than permanent staff) upto five per cent of the authorised establishment<\/p>\n

of the unit,<\/p>\n

may be employed at the discretion of the<\/p>\n

Area or |Independent Sub Area Commander or TA Group Commander<\/p>\n

for a period of seven days before training commences<\/p>\n

and for a period of four days after training ends, for the purpose<\/p>\n

of pitching and striking camp and issuing and taking into stores<\/p>\n

clothing and equipment etc.<\/p>\n

(f) Every such person who is appointed to an Urban unit<\/p>\n

may, under the orders of the Area or Independent Sub Area<\/p>\n

Commander or TA Group Commander be embodied for a<\/p>\n

period not exceeding seven days for the purpose of passing prescribed<\/p>\n

trade tests, provided the individual volunteers and obtains<\/p>\n

the written consent of his employer if any. The period of embodiment<\/p>\n

shall count against the extended period of annual camp<\/p>\n

as prescribed in Clause (b).<\/p>\n

(g) Every officer commissioned in the Territorial Army<\/p>\n

shall, for the purpose of appearing at the prescribed test in<\/p>\n

Hindi, be embodied for the period of actual duration of the test.<\/p>\n

Such period of embodiment shall count towards the period prescribed<\/p>\n

for annual training.<\/p>\n

(h) Every such person may, under the orders of the Officer<\/p>\n

Commanding the Area\/TA Group Commander be embodied<\/p>\n

with the consent of his employer, if any, for the purpose of<\/p>\n

participating in the ceremonial parade for a period upto four<\/p>\n

consecutive days. The period of embodiment shall be in addition<\/p>\n

to the period of annual training prescribed in clauses (a).(b)<\/p>\n

and (c).<\/p>\n

(i) A person while embodied for annual training under<\/p>\n

clauses (a), (b) or (c) may be ordered to participate ;in a ceremonial<\/p>\n

parade for a period upto four consecutive days, in which<\/p>\n

case, the period of annual training for which such person was<\/p>\n

embodied shall be deemed to have been extended by number<\/p>\n

of days spent by him in training for and participation in such<\/p>\n

ceremonial parade.<\/p>\n

(2) The Officer Commanding of any unit may exempt wholly<\/p>\n

or in part, any person from the obligation to undergo the annual<\/p>\n

training prescribed by sub rule (1).<\/p>\n

$20-A. Post-Commission training for officers appointed to<\/p>\n

non-departmental TA units\u2014Every officer commissioned in the<\/p>\n

Territorial Army shall be liable, for the purpose of undergoing<\/p>\n

post-commission training, to be embodied under the orders of<\/p>\n

the officer Commanding the Area in which the unit is located or<\/p>\n

the Territorial Army Group commander, for a total period not<\/p>\n

exceeding seventy-five days in a maximum of two modules within<\/p>\n

a period of two years from the date of being commissioned, in<\/p>\n

addition to the training prescribed by Rules 19 and 20. For imparting<\/p>\n

post commission training, Territorial Army officers of the nondepartmental<\/p>\n

TA units shall be attached to the corresponding<\/p>\n

Regiments\/Battalions or deputed to any other training Institutions of<\/p>\n

the Army specifically approved by the Min of Def for this purpose.<\/p>\n

20-B. Post-commission training for officers appointed to<\/p>\n

Departmental TA units\u2014Every officer commissioned in the<\/p>\n

Territorial Army and appointed to railway engineer groups, port<\/p>\n

and inland water transport companies or communication zone<\/p>\n

signal companies (Post and Telegraphs), shall be liable, for the<\/p>\n

purpose of undergoing post-commission training, to be embodied<\/p>\n

under the orders of the Officer Commanding the Area in which<\/p>\n

the unit is located or the Territorial Army Group Commander,<\/p>\n

for a continuous period not exceeding thirty days (excluding the<\/p>\n

period of journey), within a period of two years from the date<\/p>\n

of being commissioned, in addition to the training prescribed by<\/p>\n

rules 19 and 20.<\/p>\n

21. Voluntary training\u2014Every person may be permitted to<\/p>\n

be embodied under the orders of the Officer Commanding the<\/p>\n

Area\/TA Group Commander in which the unit to which he is<\/p>\n

appointed is located, for such periods of voluntary training as<\/p>\n

may from time to time be sanctioned by the Central Government<\/p>\n

in addition to the training prescribed by rules ;19 and<\/p>\n

20.<\/p>\n

21-A. Service on the Permanent Staff\u2014(a) Every enrolled<\/p>\n

person who volunteers with the written consent of his employer,<\/p>\n

if any, for employment of the permanent staff of a Territorial<\/p>\n

Army unit , may, if found suitable by the Commanding Officer<\/p>\n

of the unit, be embodied under the orders of the Officer Commanding<\/p>\n

the Area\/TA Group Commander in which the unit is located<\/p>\n

for such period as he is required to fill a vacancy on the permanent<\/p>\n

staff of the unit.<\/p>\n

(b) Every Officer who volunteers with the written consent<\/p>\n

of his employer, if any, for employment on the permanent staff<\/p>\n

of a Territorial Army unit, may if found suitable, be embodied<\/p>\n

under the orders of the ADGTA, for such<\/p>\n

period as he is required to fill a vacancy on the permanent staff<\/p>\n

of that unit or of any other unit of the Territorial Army to which<\/p>\n

he may be transferred.<\/p>\n

22. Embodiment\u2014For the purposes of clause (a) of rule 19,<\/p>\n

rule 20, rule 20-A, rule 20-B, rule 21 and rule 21-A, a person<\/p>\n

shall be deemed to be embodied with effect from the date specified<\/p>\n

for such embodiment in the order issued under the authority<\/p>\n

of the Officer Commanding the Area\/TA Group Commander<\/p>\n

in which the unit is located or the ADGTA,<\/p>\n

as the case may be.<\/p>\n

PART V\u2014PAY AND ALLOWANCES<\/span><\/strong><\/p>\n

23. Pay and Allowances\u2014(a) Every person subject to the<\/p>\n

Act, shall be entitled to such pay and allowances as are specified<\/p>\n

in Schedule III.<\/p>\n

(i) For every day of military training completed or duty<\/p>\n

performed in accordance with paragraph 15 of TA Regulations,<\/p>\n

provided that no pay and allowances shall be admissible for any<\/p>\n

days of such training or duty in excess of the number of days<\/p>\n

for which these rules provide and for the actual periods of<\/p>\n

journey to and from their permanent place of residence subject<\/p>\n

to a maximum of 7 days in all. @@For such journey period, the<\/p>\n

Government servants shall be allowed to draw pay and allowances<\/p>\n

at military rates, and if, the civil rates admissible to such Government<\/p>\n

servants are higher than the military rates, the Government servants<\/p>\n

shall also be allowed to draw the difference between these two rates<\/p>\n

and the extra expenditure involved shall constitute a charge against the<\/p>\n

head of expenditure to which the civil pay of the individuals concerned<\/p>\n

is debitable.<\/p>\n

Note\u2014In the case of an urban unit, a day shall consist of 4<\/p>\n

hours of actual military drill or instruction, and may be made up<\/p>\n

of fractions of a day not more than 4 in number.<\/p>\n

(ii) For periods of actual attendance, and for such period,<\/p>\n

not exceeding two days, as is required by the students to reach<\/p>\n

a school of army instruction before the commencement of course,<\/p>\n

at authorised course of instruction in army schools with regular<\/p>\n

units or otherwise, including intervening Sundays and holidays<\/p>\n

and for the actual periods of journey not exceeding 7 days in all<\/p>\n

to and from their permanent place of residence. @@For such<\/p>\n

journey period, the Government servants shall be allowed to draw<\/p>\n

pay and allowances at military rates, and if, the civil rates admissible<\/p>\n

to such Government servants are higher than the military rates, the<\/p>\n

Government servants shall also be allowed to draw the difference<\/p>\n

between these two rates and the extra expenditure involved shall<\/p>\n

constitute a charge against the head of expenditure to which<\/p>\n

the civil pay of the individuals concerned is debitable.<\/p>\n

Provided that no such person shall be entitled to any such<\/p>\n

pay and allowances for any day or days for which he<\/p>\n

may be absent, except that a member of a provincial<\/p>\n

unit, who is embodied or called out for training, may<\/p>\n

be granted casual leave with pay and allowances on<\/p>\n

Sundays and notified public holidays at the discretion of<\/p>\n

the Commanding Officer and a member of Provincial<\/p>\n

or Urban unit, who is attending an authorised course of<\/p>\n

instruction in any army school, may be granted casual<\/p>\n

leave with pay and allowances on intervening Sundays<\/p>\n

and holidays at the discretion of the commandant of<\/p>\n

the School.<\/p>\n

Note\u2014\u2018Period of journey\u2019 will include any period spent on<\/p>\n

journey from permanent place of residence to parent unit and<\/p>\n

vice-versa.<\/p>\n

(iii) For such period as a person is borne on the establishment<\/p>\n

of the permanent, administrative or instructional staff of<\/p>\n

a unit in the Territorial Army and for the actual periods of<\/p>\n

journey to and from their permanent place of residence subject to<\/p>\n

a maximum of 7 days in all. @@For such journey period, the<\/p>\n

Government servants shall be allowed to draw pay and allowances<\/p>\n

at military rates, and if, the civil rates admissible to such Government<\/p>\n

servants are higher than the military rates, the Government servants<\/p>\n

shall also be allowed to draw the difference between these two rates<\/p>\n

and the extra expenditure involved shall constitute a charge against the<\/p>\n

head of expenditure to which the civil pay of the individuals concerned<\/p>\n

is debitable.<\/p>\n

Explanation\u2014For the purpose of this Sub-clause an officer<\/p>\n

other than a Junior Commissioned Officer, shall be deemed to be<\/p>\n

borne on the establishment of the permanent staff of a unit<\/p>\n

during the period, not exceeding four days, he is taking over<\/p>\n

charge of an appointment on the said establishment from an<\/p>\n

officer holding that appointment. In the case of Quarter Masters<\/p>\n

of units or sub-units, the said period of four days may, for<\/p>\n

the purpose of taking over charge of stores including arms and<\/p>\n

ammunition, be extended upto a maximum of seven days at the<\/p>\n

discretion of Sub Area\/Brigade\/TA Group Commander.<\/p>\n

Note\u2014Pay and Allowances to personnel of the Territorial<\/p>\n

Army (employed on the permanent, administrative or instructional<\/p>\n

staff or embodied for service otherwise than for training)<\/p>\n

while under arrest or suspension, otherwise than for absence without<\/p>\n

leave, shall be governed by the terms of clause (b) of section<\/p>\n

90 of the Army Act, 1950.<\/p>\n

Any such personnel of the Territorial Army undergoing<\/p>\n

training shall not the entitled to any pay and allowances while<\/p>\n

under arrest or suspension.<\/p>\n

131<\/p>\n

(b) Every person subject to the Act shall be entitled to such pay and allowances as are<\/p>\n

specified in schedule IV for every day during which he is called out or embodied for military<\/p>\n

service.<\/p>\n

Note I\u2014Such person shall also be entitled to pay and allowances for the actual periods of<\/p>\n

journey to and from their permanent place of residence subject to a maximum of 7 days in all.<\/p>\n

@@@ Provided that for journey period under these rules, the Government servants shall be<\/p>\n

allowed to draw pay and allowances at military rates, and if, the civil rates admissible to such<\/p>\n

Government servants shall also be allowed to draw the difference between these two rates and<\/p>\n

the extra expenditure involved shall constitute a charge against the head of expenditure to<\/p>\n

which the civil pay of the individual concerned is debitable.@@@(Auth\u2014SRO 170 dated 14th<\/p>\n

March 1986)<\/p>\n

Note 2\u2014Persons employed on the permanent staff under Rule 21-A or embodied for<\/p>\n

service under Rule 33, shall on transfer from one unit\/formation to another be allowed joining<\/p>\n

time with pay and allowances as admissible to regular army personnel. Such joining time<\/p>\n

will not, however, be allowed when persons are posted to embodied units or employed on the<\/p>\n

Permanent Staff from their place of residence and vice versa: they will be governed by the<\/p>\n

provisions of note 1 above.<\/p>\n

(c) Pay of Government servants\u2014Government servants who are members of the<\/p>\n

Territorial Army are entitled, when called out or embodied for training to pay and allowances<\/p>\n

at the rates admissible for the Territorial Army.<\/p>\n

In cases where a Department of the Government of India,<\/p>\n

or its attached and subordinate offices or a State Government<\/p>\n

may have specially authorised in respect of its own servants who<\/p>\n

belong to the Territorial Army the payment of the difference<\/p>\n

if any, between their civil pay and military pay at the rates above<\/p>\n

referred to, the extra expenditure involved shall constitute a<\/p>\n

charge against the ordinary head of expenditure to which the<\/p>\n

civil pay of the individuals concerned is debitable.<\/p>\n

Every Government servant who is a member of the Territorial<\/p>\n

Army will intimate to his Commanding Officer the designation<\/p>\n

of head of the office or department to which he belongs<\/p>\n

for the time being during the period of his enrolled service. Summons<\/p>\n

to military training or service of any kind will be issued<\/p>\n

by the Commanding Officer through the head of the office with<\/p>\n

copies to the Controller of Defence Accounts concerned. After<\/p>\n

payment to the individual of whatever military pay and allowances<\/p>\n

are due to him, the Controller of Defence Accounts will<\/p>\n

intimate periodically to the head of the office, in the case of a<\/p>\n

non-gazetted Government servant, and to the audit officer, in<\/p>\n

the case of a gazetted officer, what remuneration and for<\/p>\n

what period, has been disbursed to the individual from DefenceEstimates.<\/p>\n

132<\/p>\n

PART VI\u2014DISCIPLINE DURING TRAINING<\/span><\/strong><\/p>\n

24. Application of the Army Act, 1950, to enrolled persons\u2014<\/p>\n

(1) The Army Act, 1950 and the rules and regulations made<\/p>\n

thereunder in their application to enrolled persons of the Territorial<\/p>\n

Army during training shall, subject to the provisions of<\/p>\n

sub rule (2), be modified in the manner and to the extent specified<\/p>\n

in Schedule II in the case of males and Schedule II-A in the<\/p>\n

case of females.<\/p>\n

(2) Enrolled persons not being females who are serving on<\/p>\n

the permanent staff of a unit or are undergoing training at the<\/p>\n

National Defence Academy shall be subject to the said Act and<\/p>\n

the rules and regulations made thereunder without any modifications.<\/p>\n

25. Authority for purpose of Section 10\u2014The prescribed<\/p>\n

authority for the purpose of Section 10 of the Act shall, in case<\/p>\n

where the accused is below the rank of warrant officer, be<\/p>\n

the Officer Commanding the unit to which the accused belongs,<\/p>\n

and in the case of a warrant officer be the Officer Commanding<\/p>\n

the Sub-Area or equivalent Commander in which the accused\u2019s<\/p>\n

unit is located.<\/p>\n

26. Recovery of Fines\u2014(a) A fine imposed under Section<\/p>\n

10 of the Act or under Clause (b) of rule 30 or sub-clause (v) of<\/p>\n

clause (a) of rule 31 may be recovered in the following manner,<\/p>\n

that is to say\u2014<\/p>\n

(i) By the officer imposing the fine from the pay and allowance<\/p>\n

and other public money due to the person<\/p>\n

on whom the fine is imposed.<\/p>\n

(ii) If the officer imposing the fine is unable to recover the<\/p>\n

same he shall send a certified copy of the order to<\/p>\n

the District Magistrate or the Chief Presidency Magistrate<\/p>\n

as the case may be, having jurisdiction in the<\/p>\n

area in which the fine has been inflicted, and such<\/p>\n

Magistrate shall recover the fine in accordance with<\/p>\n

the provisions of the Code of Criminal Procedure, 1898,<\/p>\n

as if it had been imposed by him, and shall remit the<\/p>\n

amount recovered to the officer concerned.<\/p>\n

(b) All fines recovered shall be credited to the Government.<\/p>\n

27. Prescribed Officer under Section 12\u2014The certificate referred<\/p>\n

to in Section 12 of the Act shall be signed by the commanding<\/p>\n

Officer of the unit to which the person concerned belongs.<\/p>\n

133<\/p>\n

URBAN UNITS<\/p>\n

28. Offences\u2014Every enrolled person of an urban unit when<\/p>\n

undergoing military training without having been embodied for<\/p>\n

the purpose commits an offence, if he does any of the following<\/p>\n

acts, namely.<\/p>\n

(a) when on parade, engaged on any military duty or wearing<\/p>\n

the uniform of the Territorial Army\u2014<\/p>\n

(i) strikes, or uses or offers violence to or uses threatening<\/p>\n

or insubordinate language to, or behaves with<\/p>\n

contempt to, his superior officer; or<\/p>\n

(ii) disobeys any standing order of, or lawful command<\/p>\n

given by his superior officer; or<\/p>\n

(iii) neglects to obey a general or garrison order made<\/p>\n

specially applicable to the Territorial Army, by<\/p>\n

the Officer Commanding the unit to which he belongs;<\/p>\n

or<\/p>\n

(iv) is in a state of intoxication; or<\/p>\n

(v) being a warrant officer or a non-commissioned<\/p>\n

officer strikes or ill-treats any person subject to<\/p>\n

the Army Act, 1950, or to the Act, who is his<\/p>\n

subordinate in rank or position.<\/p>\n

(b) without sufficient cause fails to appear at the place of<\/p>\n

parade at the time fixed or to attend at any place in<\/p>\n

his capacity as a member of the Territorial Army, when<\/p>\n

duly required so to attend, or when on parade, without<\/p>\n

sufficient cause quits the rank;<\/p>\n

(c) without sufficient cause fails to perform any part of the<\/p>\n

training which by or under the Act he is required to<\/p>\n

perform;<\/p>\n

(d) strikes, or uses or offers violence to any person whether<\/p>\n

subject to Army Act, 1950, or to the Act or<\/p>\n

not, in whose lawful custody he is placed, and whether<\/p>\n

such person is or is not his superior officer;<\/p>\n

(e) resists an escort whose duty it is to arrest him or detain<\/p>\n

him in military custody;<\/p>\n

(f) being under arrest or detention or otherwise in lawful<\/p>\n

military custody escapes or attemps to escape;<\/p>\n

(g) when in charge of any property belonging to the Government,<\/p>\n

or to a unit of the Territorial Army, dishonestly.<\/p>\n

misappropriates or converts to his own use, or is<\/p>\n

concerned in such misappropriation or conversion of<\/p>\n

any such property.<\/p>\n

(h) wilfully injures, or by culpable neglect loses or causes<\/p>\n

injury to, any such property as is mentioned in clause<\/p>\n

(g);<\/p>\n

(i) wilfully ill-treats a horse or other animal used in the<\/p>\n

public service;<\/p>\n

(j) knowingly furnishes a false return or report of the number<\/p>\n

or state of men under his command or change, or<\/p>\n

of any money, arms or ammunition, clothing, equipment,<\/p>\n

stores or other public property in his charge;<\/p>\n

(k) through design or culpable neglect, omits to make or<\/p>\n

send any return of any matter mentioned in clause (j)<\/p>\n

which it is his duty to make or send;<\/p>\n

(l) when it is his official duty to make a declaration respecting<\/p>\n

any matter, makes a declaration respecting such<\/p>\n

matter which he either knows or believes to be false<\/p>\n

or does not believe to be true;<\/p>\n

(m) knowingly makes against any person subject to the<\/p>\n

Army Act, 1950, or to the Act, an accusation which<\/p>\n

he either knows or believes to be false or does not believe<\/p>\n

to be true;<\/p>\n

(n) falsely personates any other person at any parade or<\/p>\n

on any occasion when such other person is required<\/p>\n

by or under the Act to do any act or attend at any<\/p>\n

place; or abets any such act of personation.<\/p>\n

29. Disposal of Offences-An Officer Commanding an urban<\/p>\n

unit shall, subject to the provisions of section 10 of the Act<\/p>\n

and after investigation of a charge made against an enrolled<\/p>\n

person appointed to that unit, or any offence specified in rule 28<\/p>\n

deal with the matter in one or other of the following ways, that<\/p>\n

is to say, he may-<\/p>\n

(a) dismiss the charge; or<\/p>\n

(b) deal with the case summarily; or<\/p>\n

(c) take steps for bringing the offender to trail by a criminal<\/p>\n

court; or<\/p>\n

(d) refer the matter to superior authority for instructions<\/p>\n

and deal with it accordingly.<\/p>\n

135<\/p>\n

30. Summary punishments-A commanding officer dealing<\/p>\n

summarily with an offence under rule 28 may inflict punishment<\/p>\n

according to the following scale, that is to say, he may-<\/p>\n

(a) order dismissal of the offender, below the rank of a noncommissioned<\/p>\n

officer from the Territorial Army with or<\/p>\n

without forfeiture of all or any arrears of pay and allowances<\/p>\n

and other public money due to him at the<\/p>\n

time of such dismissal; or<\/p>\n

(b) order the offender to pay a fine not exceeding Rs. 100;<\/p>\n

or<\/p>\n

(c) order stoppages of pay and allowances until any proved<\/p>\n

damage or loss occasioned by the offence of which the<\/p>\n

offender is charged is made good; or<\/p>\n

(d) severely reprimand the offender; or<\/p>\n

(e) reprimand the offender;<\/p>\n

Provided that in every case in which the officer proposes to<\/p>\n

order the offender to pay a fine he shall first ask the offender<\/p>\n

whether he claims to be tried by criminal court, and if the offender<\/p>\n

does so claim , he shall take steps for bringing the offender<\/p>\n

to trail by a criminal court.<\/p>\n

31. Summary punishment of Warrant Officer and Non-Commissioned<\/p>\n

Officer-An Officer having powers not less than that<\/p>\n

of Sub-Area or equivalent Commander dealing summarily with<\/p>\n

an offence under rule 28 may award any of the following punishments-<\/p>\n

(a) In the case of a Warrant Officer-<\/p>\n

(i) Dismissal.<\/p>\n

(ii) Reduction to a lower grade or place in the list of his<\/p>\n

rank or to the ranks.<\/p>\n

(iii) Forfeiture of seniority or rank.<\/p>\n

(iv) Severe reprimand or reprimand.<\/p>\n

(v) Fine.<\/p>\n

(vi) Stoppages of pay and allowances until any proved<\/p>\n

loss or damage occasioned by the offence of which<\/p>\n

the offender is charged is made good.<\/p>\n

Provided that in every case in which the officer proposes to<\/p>\n

order the offender to pay a fine he shall first ask the offender<\/p>\n

whether he claims to be tried by a criminal court, and if the<\/p>\n

offender does so claim, he shall take steps for bringing the offender<\/p>\n

to trial by a criminal court.<\/p>\n

(b) In case of Non-Commissioned Officers-<\/p>\n

(i) Dismissal.<\/p>\n

(ii) Reduction to a lower class or a lower rank or to<\/p>\n

the ranks.<\/p>\n

(iii) Forfeiture of seniority of rank.<\/p>\n

32. (a) Any enrolled person who deems himself wronged by<\/p>\n

any superior or other officer may complain to the officer under<\/p>\n

whose command or orders he is serving.<\/p>\n

(b) When the officer complained against is the officer to<\/p>\n

whom any complaint should, under sub-rule (a) be referred the<\/p>\n

aggrieved person may complain to such officer\u2019s next superior<\/p>\n

officer.<\/p>\n

(c) Every officer receiving such complaint shall inquire into<\/p>\n

it, and when necessary, refer it to superior authority; provided<\/p>\n

that a decision by an authority competent to dispose of the matter<\/p>\n

complained of shall be final.<\/p>\n

(d) Every such complaint shall be preferred through such<\/p>\n

channels as may from time to time be specified by the appropriated<\/p>\n

authority.<\/p>\n

PART VII<\/strong><\/p>\n

33. Every officer and every enrolled person of the Territorial<\/p>\n

Army shall by order of the Central Government or by order of<\/p>\n

such other authority as may be empowered by the Central Government<\/p>\n

in this behalf, be liable, to be called out to act in support<\/p>\n

of the civil power or to provide essential guards or to be<\/p>\n

embodied for the purpose of supporting or supplementing the regular<\/p>\n

army.<\/p>\n

Provided that an officer or an enrolled person who volunteers<\/p>\n

with the written consent of his employer, if any, for an appointment<\/p>\n

with a Headquarters or a unit of the Regular Army, may<\/p>\n

if found suitable, be embodied with the Headquarters or the unit<\/p>\n

of the Regular Army, as the case may be, under the orders of<\/p>\n

the Director Territorial Army.<\/p>\n

137<\/p>\n

34. Every officer and every enrolled person when called out<\/p>\n

or embodied as in rule 33, shall under the orders of the Commander<\/p>\n

of the Sub-Area in which the unit to which he is attached<\/p>\n

may for the time being be serving, act in support or supplement<\/p>\n

the regular army.<\/p>\n

**(a) Disembodiment on compassionate grounds\u2014An Officer<\/p>\n

or enrolled person embodied under rule 33 may be disembodied on<\/p>\n

compassionate grounds under the orders of the following authorities,<\/p>\n

namely :–<\/p>\n

(i) Officer – Director, Territorial Army<\/p>\n

(ii) JCO – Commander Territorial Army Group<\/p>\n

Headquarters or Area\/Sub Area\/Brigade<\/p>\n

Commander.<\/p>\n

(iii) Enrolled – Officer Commanding Territorial Unit.<\/p>\n

Person.<\/p>\n

PART VIII- RENISTATEMENT AFTER COMPLETION OF MILITARY<\/span><\/strong><\/p>\n

SERVICE<\/span><\/strong><\/p>\n

35. PRESCRIBED AUTHORITY UNDER 7A- The prescribed<\/p>\n

authority, referred to in the proviso to sub-section (l) of Section<\/p>\n

7A,shall-<\/p>\n

(a) in respect of any area within the presidency town of<\/p>\n

Bombay, Calcutta or Madras, be the Chief Judge of the<\/p>\n

Court of small Causes within the local limits of whose<\/p>\n

jurisdiction the person claiming reinstatement was employed<\/p>\n

immediately before he was required to perform<\/p>\n

military service under Section 7, and<\/p>\n

(b) in respect of any other area, be the District and Sessions<\/p>\n

Judge within the limits of whose jurisdiction such<\/p>\n

person was employed.<\/p>\n

36. Nature of inquiry by prescribed authority- Where a refrence<\/p>\n

is made by any party under the proviso to sub-section<\/p>\n

(l) of section 7A to the authority referred to in rule 35, a copy<\/p>\n

of such reference shall be served upon the opposite party and the<\/p>\n

said authority shall decide the matter after giving both the parties<\/p>\n

a reasonable opportunity of being heard and after making<\/p>\n

such further inquiry, if any, as it thinks fit.<\/p>\n

138<\/p>\n

37. Prescribed rights under Section 7B- When any person<\/p>\n

subject to the Act is required military service under<\/p>\n

section 7-<\/p>\n

(a) he may, at his option continue to subscribe to any provident<\/p>\n

or superannuation fund or other scheme for the<\/p>\n

benifit of employees maintained in connection with the<\/p>\n

employment which he relinquished immediately before<\/p>\n

he was called out embodied or attached for military<\/p>\n

service, at such rates a applicable to him under<\/p>\n

the rules of such fund or scheme.<\/p>\n

(b) the employer by whom such person was employed shall<\/p>\n

continue to credit such person\u2019s account in the fund or<\/p>\n

scheme with the amount subscribed and the interest on<\/p>\n

the amount in such account in accordance with the rules<\/p>\n

of the fund or scheme; and<\/p>\n

(c) such person may, if the rules of the fund or scheme so<\/p>\n

permit and in accordance with such rules, withdraw<\/p>\n

sums from the amount, standing at his credit in the fund<\/p>\n

or scheme; and for the purpose of calculating the<\/p>\n

amount of contribution or withdrawal admissible, such<\/p>\n

person\u2019s salary shall be deemed to be the salary which<\/p>\n

he would have received had he not been so called out,<\/p>\n

embodied or attached.<\/p>\n

INTRODUCTION<\/p>\n

1. With effect from 1st January, 1971, Territorial Army officers<\/p>\n

will have to pass promotion examination before they are<\/p>\n

granted substantive promotion from Lieutenant to Captain and<\/p>\n

and Captain to Major. Syllabus for promotion examination is given<\/p>\n

in Appendices \u2018A\u2019 and \u2018B\u2019 for Territorial Army officers of nondepartmental<\/p>\n

and departmental Territorial Army units respectively.<\/p>\n

2. The object of promotion examination is to ensure that<\/p>\n

officers have the necessary professional knowledge before promotion<\/p>\n

to the next substantive rank.<\/p>\n

3. Promotion examinations will be held as under:-<\/p>\n

(a) Lieutenant to Captain — Part \u2018A\u2019 Practical Examination<\/p>\n

— Part \u2018B\u2019 Written Examination<\/p>\n

(b) Captain to Major — Part \u2018C\u2019 Practical Examination<\/p>\n

GENERAL INSTRUCTION<\/strong><\/p>\n

4. Territorial Army officers are required to pass the examination<\/p>\n

for promotion to Captain and Major before they have<\/p>\n

completed the prescribed period of service for promotion to these<\/p>\n

ranks laid down in paragraphs 38 (a), Territorial Army Regulations<\/p>\n

1948 (Reprint-1958). Officers failing to pass within the prescribed<\/p>\n

time will be permitted to complete the examination within<\/p>\n

one year from the date they are due for promotion. For the<\/p>\n

purposes of this limit, any period of service forfeited by an officer<\/p>\n

for promotion as a result of disciplinary action will not be<\/p>\n

ignored.<\/p>\n

5. Officers who pass the examination within the time limit<\/p>\n

will be promoted, if recommended, on completion of prescribed<\/p>\n

length of service. Those passing the examination after expiry<\/p>\n

of prescribed limit and within the 12 months extra time allowed,<\/p>\n

will be promoted, if recommended, from the date of passing their<\/p>\n

examination. An officer who passes in any of the practical tests<\/p>\n

or written test will be deemed to have passed such tests or<\/p>\n

paper on the *first day of the examination (in any particular part),<\/p>\n

at which he finally qualifies.<\/p>\n

6. To be eligible to sit for examination for promotion to the<\/p>\n

rank of Captain and Major, an officer must have attained the<\/p>\n

substantive rank of Lieutenant and Captain respectively. Every<\/p>\n

officer must pass the practical portion of the examination before<\/p>\n

he is permitted to appear in the written portion. Officers failing<\/p>\n

to pass the promotion examination within the prescribed time<\/p>\n

limit, vide para 4 above, will be called upon to resign their<\/p>\n

commissions. Should they decline to do so they will be compulsorily<\/p>\n

removed from the service and terminal gratuity, if anyadmissible<\/p>\n

will be paid to them.<\/p>\n

CONDUCT OF EXAMINATION<\/span><\/strong><\/p>\n

7. (a) The examination will be held once yearly as shown<\/p>\n

below:<\/p>\n

Parts \u2018A\u2019 and \u2018C\u2019\u20141st week of February. Parts \u2018B\u2019 and<\/p>\n

\u2018D\u2019 \u20131st Tuesday of June (Note:– Vide AI 3\/61, the<\/p>\n

written examination will be held on the 1st Tuesday<\/p>\n

of the month or subsequent day or days if Tuesday is<\/p>\n

a holiday).<\/p>\n

(b) Examination in Parts \u2018A\u2019 and \u2018C\u2019 will be held under<\/p>\n

orders of the GOC Area\/Div or equivalent formation<\/p>\n

Commander\/Independent Sub Area or equivalent Formation<\/p>\n

Commander who will appoint the examining<\/p>\n

Board as necessary and set the question papers in accordance<\/p>\n

with the syllabus given in Appendix \u2018A\u2019.<\/p>\n

(for Territorial Army officers of non-departmental Territorial<\/p>\n

Army units).<\/p>\n

(c) The Board will consist of a Presiding officer not below<\/p>\n

the rank of Lieutenant Colonel and two Majors, one of<\/p>\n

whom will be from the Regular Army and the other<\/p>\n

may be from the Territorial Army.<\/p>\n

(d) Question papers for Parts \u2018B\u2019 and \u2018D\u2019 will be set and<\/p>\n

corrected under arrangements of Army Headquarters<\/p>\n

(MT Dte).<\/p>\n

8. Officers will normally be examined within the Territorial<\/p>\n

Army Zone in which their unit is located and at centre nearest<\/p>\n

officers are desirous of appearing in the examination.<\/p>\n

10. TA Group Headquarters Command will consolidate and<\/p>\n

submit, in duplicate, a separate nominal roll for individual officer<\/p>\n

appearing for a part or the whole of Parts \u2018B\u2019 and \u2018D\u2019 of<\/p>\n

the examination so as to reach the Vice Chief of the Army Staff<\/p>\n

(MT-20) by 25th April on the form given at Appendix \u2018D\u2019.<\/p>\n

EXEMPTION<\/p>\n

11. The following will be exempted from passing the promotion<\/p>\n

examinations:–<\/p>\n

(a) Officers of the Army Medical Corps.<\/p>\n

(b) Officers who have already passed these examinations<\/p>\n

while serving with the Regular army.<\/p>\n

(c) Officers who are permitted to count their full pay commissioned<\/p>\n

service in the Regular Army for seniority<\/p>\n

which would entitle them to promotion to the next substantive<\/p>\n

rank in less than two years from the date of<\/p>\n

joining the Territorial Army.<\/p>\n

(d) Officers of departmental TA units (Railways, Signal,<\/p>\n

Post and Telegraphs, Docks and Inland Water Transport)<\/p>\n

from Parts \u2018A\u2019,\u2019B\u2019,\u2019C\u2019 and \u2019D\u2019 applicable to Non-<\/p>\n

Departmental TA officers. They will, however, be required<\/p>\n

to pass an examination to be called- Departmental<\/p>\n

TA Officer Promotion Examination (Lt to Capt)-<\/p>\n

within first five year of their service, without attaining<\/p>\n

substantive rank of Lt, as laid down in para 6 above.<\/p>\n

Those who are unable to pass within this period will,<\/p>\n

however, be permitted to pass this examination before<\/p>\n

they complete the prescribe period of service, that is<\/p>\n

8 years as laid down in para 38 (a) of TA Regs for<\/p>\n

promotion to the substantive rank of Captain. Officers<\/p>\n

RESULT<\/p>\n

13. The name of officers who pass in a part or portion of<\/p>\n

the examination will be published in Army Order. The result of<\/p>\n

practical tests will be forwarded by the President of the Board<\/p>\n

direct to the Vice Chief of the Army Staff (MT-2) by registered<\/p>\n

post immediately on the conclusion of the examination. The form<\/p>\n

given in Appendix \u2018C\u2019 will be used for the purpose.<\/p>\n

TERMS AND CONDITIONS OF SERVICE FOR THE\u00a0 <\/span><\/span><\/strong>PERMANENT STAFF<\/span><\/span><\/strong><\/p>\n

A. OFFICERS<\/span><\/span><\/strong><\/p>\n

1. Selection-(a) Officers will normally be seconded to the permanent<\/p>\n

staff from the regular army till such time Territorial<\/p>\n

Army Officers of sufficient service are available.<\/p>\n

(b) Officers of the Territorial Army selected for employment<\/p>\n

on the permanent staff of a unit will normally be selected<\/p>\n

from the officer Cadre of that unit.<\/p>\n

2. Attachment to Regular Army Units- Officer seconded<\/p>\n

from the regular Army when not required for training or administrative<\/p>\n

duties with the Territorial Army will normally return<\/p>\n

to their own unit or group subject to such orders as may be<\/p>\n

issued from the time to time. In the case of Territorial Army Officers<\/p>\n

they may be attached to the nearest group or unit under<\/p>\n

orders of GOC-in-C Command . During the period of attachment<\/p>\n

will be reported by the Officer Commanding to Army Headquarters<\/p>\n

fill the vacancies in the sanctioned establishment by attachment<\/p>\n

from a regular unit pending the appointment by Army Headquarters<\/p>\n

of an officer possessing the requisite qualifications. If<\/p>\n

the officer commanding the unit wishes that a Territorial Army<\/p>\n

Officer be appointed he will forward such recommendation to<\/p>\n

Army Headquarters through normal channels.<\/p>\n

B\u2014JUNIOR COMMISSIONED OFFICER<\/span><\/strong><\/p>\n

1. Selection\u2014(a) Junior Commissioned Officers seconded to<\/p>\n

the permanent staff from the regular army will as far as possible<\/p>\n

belong to the zone in which the unit is raised.<\/p>\n

(b) Junior Commissioned Officers of the Territorial Army<\/p>\n

selected for appointment on the permanent staff of a unit will be<\/p>\n

selected from the junior commissioned officers cadre of that<\/p>\n

unit.<\/p>\n

2. Attachment to Regular Army Units\u2014Junior Commissioned<\/p>\n

Officers seconded from Regular Army when not required<\/p>\n

for training or administrative duties with the Territorial Army<\/p>\n

will normally return to their unit or group in order to keep up-todate<\/p>\n

in administration and instructional methods. In the case of<\/p>\n

Territorial Army Junior Commissioned Officers they may be attached<\/p>\n

to the nearest group or unit under order of Area\/Div\/<\/p>\n

Commander\/TA Group Commander. During the period of attachment<\/p>\n

for the pay and accounts of Junior Commissioned Officers of<\/p>\n

the regular army on the permanent staff during their period of<\/p>\n

8. Appointment and Relief of Permanent Staff\u2014The appointment<\/p>\n

and relief of the Junior Commissioned Officers of the<\/p>\n

regular army on the permanent staff will be co-ordinated by the<\/p>\n

commanding officer of the Territorial Army unit concerned in<\/p>\n

consultation with the officer commanding the Training Centre\/<\/p>\n

Record Office or unit concerned. The appointment and relief of<\/p>\n

Territorial Army J.C.O. will be sanctioned by Army Headquarters.<\/p>\n

Pensioned and non-pensioned Junior Commissioned Officers with<\/p>\n

13. Filling up Vacancies\u2014Vacancies of Junior Commissioned<\/p>\n

Officers in the permanent staff will be reported by the officer<\/p>\n

from a regular unit pending the appointment of a Junior<\/p>\n

Commissioned Officer by a Regimental\/Training Centre\/<\/p>\n

If a J.C.O. from the regular army is not required, the commanding<\/p>\n

officer may recommend a Territorial Army J.C.O. for full<\/p>\n

personnel on account of suitable T.A. personnel being available.<\/p>\n

Territorial Army warrant officers, non-commissioned officers,<\/p>\n

and other ranks of the appropriate ranks may be selected for full<\/p>\n

time employment on the permanent staff of a unit.<\/p>\n

2. Attachment to Regular Army Unit\u2014Warrant officers,<\/p>\n

non-commissioned officers and other ranks seconded from regular<\/p>\n

army, when not required for training or administrative duties with<\/p>\n

the Territorial Army will normally return to their own unit or<\/p>\n

group subject to such orders as may be issued from time to time.<\/p>\n

In the case of Territorial Army personnel, they may be attached<\/p>\n

to the nearest group or unit under orders of the Area\/Div\/Independent<\/p>\n

WO, NCO or OR of the Territorial Army, who is posted to<\/p>\n

a new appointment on the permanent staff in the same unit or<\/p>\n

in another unit either in the same rank or in a higher rank. In<\/p>\n

his unit establishment until absorbed, and in the case of Territorial<\/p>\n

A\u2014OFFICERS<\/p>\n

1. Eligibility\u2014Territorial Army Commissions may be graned<\/p>\n

in the Indian land forces to any national of India, with the<\/p>\n

requisite qualifications.<\/p>\n

2. Nationality\u2014A candidate must be;<\/p>\n

(a) a citizen of India; or<\/p>\n

(b) a subject of Sikkim, or<\/p>\n

(c) a person who has migrated from Pakistan with the intention<\/p>\n

of permanently settling down in India, or<\/p>\n

(d) a subject of Nepal or of a Portuguese or of a former<\/p>\n

French possession in India.<\/p>\n

Note\u2014The appointment of candidates in categories (c) and<\/p>\n

above will be subject to the issue of certificates of eligibility<\/p>\n

in their favour by the Government of India. Certificates of eligibility<\/p>\n

will not, however, be necessary in the case of candidates<\/p>\n

belonging to any of the following categories\u2014<\/p>\n

(1) Persons who migrated to India from Pakistan after 18th<\/p>\n

firm and held a responsible appointment in<\/p>\n

a mechanical, electrical, or automobile firm.<\/p>\n

(c) For Corps of signal units\u2014<\/p>\n

(i) must be in possession of a degree or diploma of a<\/p>\n

recognised university in Electrical Engineering<\/p>\n

with experience in tele-communication.<\/p>\n

or<\/p>\n

(ii) must be in possession of a degree in Physics and<\/p>\n

Mathematics and have good knowledge of Radio.<\/p>\n

N.B.\u2014(These standards may be relaxed if the candidate has<\/p>\n

an extensive knowledge of Communications)<\/p>\n

(d) For Air Observation Squadron Artillery Units\u2014Applicants<\/p>\n

for the Air Defence Operation Squadron must be<\/p>\n

in possession of class A flying licence.<\/p>\n

(e) For other Arms and other Categories of Officers not<\/p>\n

specified in para 4(a). (b), (c) and (d) above\u2014<\/p>\n

(i) Education\u2014The candidate should have passed Intermediate<\/p>\n

or its equivalent from a recognised university.<\/p>\n

(ii) Other Qualifications\u2014Preference may be given to<\/p>\n

a candidate who has served with credit in the<\/p>\n

candidate must satisfy the interviewing officer and<\/p>\n

Selection Board that he is in all respects suitable<\/p>\n

and to this end may be required to undergo certain<\/p>\n

Selection Board Tests.<\/p>\n

NOTE\u2014With effect from 1st January 1964, in the case of<\/p>\n

Infantry, for promotion to Nb Sub, the Examining Board will be<\/p>\n

as per para 4(a) above and convening authority will be unit<\/p>\n

commander not below the rank of Lieutenant colonel.<\/p>\n

5. Qualification\u2014 For ex-officers, ex-VCOs\/JCOs and WOs<\/p>\n

(or their equivalents) of the three services, the Indian Territorial<\/p>\n

force, State Forces, Auxiliary Forces and Reserve and for Ex\/<\/p>\n

serving JCOs of the Territorial Army the above qualifications<\/p>\n

may be relaxed provided they have a creditable record of service<\/p>\n

and provided their technical ability (if applying for a technical<\/p>\n

appointment)is considered adequate by the Selection<\/p>\n

Board.<\/p>\n

6. Physical and Medical Fitness\u2014A candidate must be<\/p>\n

physically and medically fit in all respects, vide Appendix XII.<\/p>\n

7. Method and Submission and Disposal of the Application<\/p>\n

Form\u2014(a) The application or I.A.F.(T.A.) \u2013 9 will be completed<\/p>\n

for all categories of persons applying for an officer\u2019s commission<\/p>\n

in the Territorial Army.<\/p>\n

(i) For candidates who are applying for non-technical commissions<\/p>\n

the form should be submitted in the first<\/p>\n

instance to Sub-Area Headquarters. After the verification<\/p>\n

and interview by the Sub-Area or equivalent Commander,<\/p>\n

and medical examination by the Service medical<\/p>\n

authorities the application forms of suitable candidates<\/p>\n

will be forwarded to Army Headquarters together<\/p>\n

with the medical certificate.<\/p>\n

(ii) For candidates, who are applying for technical appointments<\/p>\n

the form will be submitted in the first instance<\/p>\n

to Area or Command Headquarters (whichever is<\/p>\n

nearest) where candidates for technical arms will attend<\/p>\n

for interview and medical examination. The completed<\/p>\n

form will then be forwarded to Army Headquarters.<\/p>\n

(b) The certified true copies of the following certificates must<\/p>\n

accompany the application form and must be attested by a<\/p>\n

magistrate or a gazetted or a commissioned officer who is to<\/p>\n

endorse his full name designation and address. Originals of all<\/p>\n

certificates must be produced at all interviews;<\/p>\n

(i) Certificate of age, i.e. Matriculation Certificate.<\/p>\n

or<\/p>\n

a certificate from a local Registrar supported by a judicial<\/p>\n

affidavit from the father or guardian of the candidate<\/p>\n

or other satisfactory proof, instead<\/p>\n

or<\/p>\n

a certificate from a local Registrar supported by a judicial<\/p>\n

department in the case of a civil Government servant :–<\/p>\n

(v) In the case of Government servants, a certificate indicating<\/p>\n

written consent from the head of the Branch or<\/p>\n

Department concerned that the applicant will be available<\/p>\n

for military training and embodiment as and when<\/p>\n

required by the prescribed military authorities.<\/p>\n

8. Method of Selection\u2014Normally all candidates for nontechnical<\/p>\n

commissions will be required to present themselves for<\/p>\n

interview by Sub Area commander and those candidates for<\/p>\n

commissions in technical appointments will be required to present<\/p>\n

themselves for interview by the head of the appropriate<\/p>\n

Corps or Service at Area or Command Headquarters.<\/p>\n

The completed applications of all candidates will then be<\/p>\n

forwarded to Army Headquarters; approved candidates will then<\/p>\n

be required to present themselves before Selection Boards. Exofficers<\/p>\n

and candidates for certain technical appointments may<\/p>\n

be required to present themselves for interview by an Army<\/p>\n

Headquarters Selection Board. This provision will not apply to<\/p>\n

candidates for commission in non-departmental TA units of the<\/p>\n

Corps of Engineers, Signals, and Electrical and Mechanical<\/p>\n

Engineers, who will appear before Services Selection Board.\u201d<\/p>\n

9. Period of Probation\u2014All officers appointed to commissions<\/p>\n

in the Territorial Army will be on probation for 3 years<\/p>\n

and will be confirmed in their appointment on passing the prescribed<\/p>\n

examination for retention. During this period if found<\/p>\n

unsatisfactory, an officer on probation may be called upon to<\/p>\n

resign his commission; if he declines he will be liable to<\/p>\n

removal.<\/p>\n

Ex-officers granted commission in the Territorial Army and<\/p>\n

exempted from passing the retention examination under para 11<\/p>\n

of Appendix X to these Regs, will however not be required to<\/p>\n

remain on probation.<\/p>\n

10. Medical Examination\u2014Each applicant will be examined<\/p>\n

by a Medical Board at the station where he is required to present<\/p>\n

himself for examination and will not be granted a commission<\/p>\n

in the Territorial Army unless he is pronounced physically<\/p>\n

fit for service by the medical board.<\/p>\n

11. Candidates pronounced unfit by the Medical Board<\/p>\n

under para 10 above, may, if they are not satisfied with the finding<\/p>\n

of such medical boards, appeal to the Secretary to the<\/p>\n

Government of India, Ministry of Defence, within a week of<\/p>\n

the date on which the result of their medical examination is<\/p>\n

made known to them. The secretary to the Government of<\/p>\n

India, Ministry of Defence, will after considering such appeals,<\/p>\n

arrange, if necessary, for their re-examination by another Medical<\/p>\n

Board called \u201cThe Appeal Medical Board\u201d. (In cases where<\/p>\n

a specialist opinion is required, a specialist may be included in<\/p>\n

the appeal board). Appeals for re-examination in each case, will<\/p>\n

be accompanied by a fee of Rs. 40 without which no appeal will<\/p>\n

be considered.<\/p>\n

If the appeal proves successful, or if for any reason an<\/p>\n

\u201cAppeal Medical Board\u201d is not convened, the special fee of<\/p>\n

Rs. 40 will be returned to the appellant.<\/p>\n

The appellant will not be entitled to any TA\/DA.<\/p>\n

B\u2014JUNIOR COMMISSIONED OFFICERS<\/strong><\/p>\n

12. Eligibility\u2014(a) Territorial Army Commissions as junior<\/p>\n

190<\/p>\n

commissioned officer may be granted to any national of India<\/p>\n

who possesses the requisite qualifications. Such commissions<\/p>\n

will normally be granted to suitable candidates from the ranks.<\/p>\n

(b) Civilians will not normally be granted direct commissions<\/p>\n

as junior commissions officers. They will be required to<\/p>\n

join a Territorial Army unit as enrolled persons. They may<\/p>\n

thereafter be recommended for JCO\u2019s commission by their commanding<\/p>\n

officers, in their own units, if considered suitable in<\/p>\n

all respects for the grant of such a commission.<\/p>\n

Civilian candidates possessing requisite technical qualifications<\/p>\n

and recommended by Area\/Sub Area\/TA Group Headquarters<\/p>\n

concerned may, in exceptional cases, be considered for<\/p>\n

the grant of direct JCO\u2019s commission in the Corps of Engineers,<\/p>\n

Signals and Electrical and Mechanical Engineers units of the<\/p>\n

Territorial Army.<\/p>\n

(c) Direct Commissions may, however, be granted to suitable<\/p>\n

candidates who fulfil the following conditions:–<\/p>\n

(i) have served for not less than four years in the regular<\/p>\n

army as warrant officers or havildars or their equivalents<\/p>\n

in any of the other two services. State forces,<\/p>\n

ITF, and AF(I) and are recommended for a commission<\/p>\n

by the commanding officer of the unit for which<\/p>\n

they apply;<\/p>\n

or<\/p>\n

(ii) have been junior commissioned officers\/viceroy\u2019s commissioned<\/p>\n

officers in the regular army or its equivalent<\/p>\n

in the other two services, State Forces and ITF;<\/p>\n

or<\/p>\n

(iii) be serving employees of the Port Commissioners, Railways,<\/p>\n

or P&T Department who are in possession of the<\/p>\n

technical qualifications set out in para 16 below and<\/p>\n

are considered suitable;<\/p>\n

or<\/p>\n

(iv) have served with credit in a contingent of the National<\/p>\n

Cadet Corps and have obtained the Proficiency Certificate<\/p>\n

\u2018C\u2019 and be recommended for a commission as<\/p>\n

junior commissioned officer by the officer commanding<\/p>\n

of his unit.<\/p>\n

13. Nationality.\u2014A Candidate must fulfil the same conditions<\/p>\n

of nationality as laid down for TA officers in para 2 of this<\/p>\n

Appendix.<\/p>\n

14. Age Limit\u2014Applicants should have attained the age of 18 years and not have attained<\/p>\n

the age of 35 years, 45 years inthe case of employees of P&T department joining Sig Coys<\/p>\n

(P&T) (T.A.) on the date of application. The upper age limit may, however, be relaxed in the<\/p>\n

case of ex-servicemen and also in the case of civilians possessing technical qualifications at the<\/p>\n

discretion of the Chief of the Army Staff or on his behalf by the<\/p>\n

ADGTA, if so empowered by the Chief of the Army Staff.<\/p>\n

15. Physical Fitness\u2014A candidates must be fit in all respects and must produce a medical<\/p>\n

certificate to this effect from a Government medical officer not below the status of an Assistant<\/p>\n

Surgeon.<\/p>\n

16. Qualifications for Civilian Candidates only\u2014If the candidate fulfils the requisite<\/p>\n

technical qualifications, the educational qualifications may be waived\u2014<\/p>\n

(a) For Corps of Engineers (TA)\u2014<\/p>\n

(i) Should be capable of controlling and organising not less than 50 skilled tradesmen<\/p>\n

either in the workshop or in the Field or both.<\/p>\n

(ii) For Port\u2014Docks and Inland Water Transport units\u2014Should have had a<\/p>\n

minimum of 2 years ser-vice in a supervisory capacity in one of the follow ing trades :–<\/p>\n

17. Method of submission and disposal of the application<\/p>\n

form\u2014(a) Information regarding the type and number of Territorial<\/p>\n

Army Units in a particular locality may be obtained from<\/p>\n

the recruiting officer, or from the Sub-Area\/Bde Area\/Div or<\/p>\n

Command Headquarters.<\/p>\n

(b) Certified true copies of the following certificates attested<\/p>\n

by a magistrate or a gazetted or a commissioned officer showing<\/p>\n

full name, designation and address must accompany the<\/p>\n

application form :–<\/p>\n

(ORIGINALS ARE TO BE PRODUCED AT ALL INTERVIEWS)<\/p>\n

civilian candidates.<\/p>\n

Certificate of age produced from the candidate\u2019s record<\/p>\n

of service<\/p>\n

or<\/p>\n

any other satisfactory proof.<\/p>\n

(ii) Educational Certificates.<\/p>\n

(iv) Medical Certificate.<\/p>\n

(v) Discharge Certificate in the case of ex-servicemen.<\/p>\n

(c) The application form IAF (TA)-14 will be completed by<\/p>\n

all categories of persons applying for JCO commission in the<\/p>\n

Territorial Army. After completion of parts I and II including<\/p>\n

sections A, B and C the form will be submitted to the commanding<\/p>\n

officer of the unit for which the candidate is applying.<\/p>\n

18. Method of Selection\u2014Selection of JCOs for the TA<\/p>\n

will be made as follows :–<\/p>\n

All candidates will be interviewed initially by the commanding<\/p>\n

officer of the unit for which they apply who will<\/p>\n

satisfy himself that the conditions for the grant of a TA<\/p>\n

commission are fulfilled. The Commanding Officer will<\/p>\n

then record his recommendations in Section D of the form.<\/p>\n

Any candidate thus recommended will be interviewed by<\/p>\n

the Area\/Independent Sub Area\/Sub Area\/Bde Area\/<\/p>\n

Brigade Commander\/TA Group Commander who will<\/p>\n

satisfy himself about the suitability of the candidates<\/p>\n

or otherwise and endorse Section E of the form accordingly.<\/p>\n

The application form will then be submitted<\/p>\n

to the TA Dte, Army Headquarters, for the grant of<\/p>\n

a JCO commission.<\/p>\n

19. Period of Probation\u2014(a) Persons granted direct JCO<\/p>\n

commission in the TA will be on probation for a period of<\/p>\n

three years and will be confirmed in the appointment on passing<\/p>\n

the prescribed retention examination and if found suitable in<\/p>\n

all other respects. If any JCO fails to pass this examination<\/p>\n

within the prescribed period, he will have the option to revert<\/p>\n

to the rank of Havildar\/Dafadar failing which he will be discharged<\/p>\n

from service. Those who elect to revert may be considered<\/p>\n

for promotion to Naib\/Subedar on having passed the<\/p>\n

promotion examination and if found otherwise suitable.<\/p>\n

(b) Ex-JCOs\/VCOs and their equivalents of the other two<\/p>\n

services, State Forces ITF, AF-(I), MDSC, Def Bns and Border<\/p>\n

Scouts, who have a minimum of three years previous commissioned<\/p>\n

service and are granted JCO commission in the TA will<\/p>\n

not be required to remain on probation and pass the retention<\/p>\n

examination.<\/p>\n

(c) Serving NCOs who pass the promotion examination from<\/p>\n

havildar\/dafadar to Jemadar and are promoted to Jemadar will<\/p>\n

not be required to remain on probation or pass the retention<\/p>\n
