\u00a0An\u00a0 <\/span>Act to provide for the conduct of elections to the Houses\u00a0 <\/span>of<\/p>\n

 Parliament  <\/span>and  <\/span>to the House or Houses  <\/span>of the  <\/span>Legislature  <\/span>of  <\/span>each<\/pre>\n
 State,  <\/span>the qualifications and disqualifications for.  <\/span>membership  <\/span>of$<\/pre>\n
 those *1Houses, the corrupt 2* * * practices and other offences at  <\/span>or<\/pre>\n
 in  <\/span>connection  <\/span>with  <\/span>such elections and the decision  <\/span>of  <\/span>doubts  <\/span>and<\/pre>\n
 disputes arising out of or in connection with such elections.<\/pre>\n
      <\/span>BE it enacted by Parliament as follows:-<\/pre>\n
  <\/span><\/pre>\n
 <\/span>PART-1 <\/span><\/span><\/strong><\/pre>\n
 <\/span>PRELIMINARY<\/span><\/strong><\/pre>\n
      <\/span>1.Short  <\/span>title. This Act may be called the Representation of  <\/span>the<\/pre>\n
 People Act, 1951 <\/span><\/pre>\n
      <\/span>2.Interpretation.  <\/span>(1) In this Act, unless the context  <\/span>otherwise<\/pre>\n
 requires,-<\/pre>\n
           <\/span>(a)  <\/span>each  <\/span>of the expressions defined in section 2  <\/span>or  <\/span>sub-<\/pre>\n
          <\/span>section<\/pre>\n
                <\/span>(1)of  <\/span>section 27 of the Representation of  <\/span>the  <\/span>People<\/pre>\n
               <\/span>Act  <\/span>1950,  <\/span>(43 of 1950.) but not defined in  <\/span>this  <\/span>Act,<\/pre>\n
               <\/span>shall have the same meaning as in that Act.;<\/pre>\n
           <\/span>(b)  <\/span>\"appropriate  <\/span>authority\"  <\/span>means,  <\/span>in  <\/span>relation  <\/span>to   <\/span>an<\/pre>\n
          <\/span>election  <\/span>to the House of the People or the Council of States<\/pre>\n
               <\/span>3* * * the Central  <\/span>Government, and in  <\/span>relation  <\/span>to  <\/span>an<\/pre>\n
               <\/span>election   <\/span>to   <\/span>the   <\/span>Legislative   <\/span>Assembly   <\/span>or    <\/span>the<\/pre>\n
               <\/span>Legislative Council of a State, the State Government;<\/pre>\n
 <\/span><\/pre>\n
           <\/span>4[(bb) \"chief electoral officer\" means the officer appointed<\/pre>\n
                <\/span>under  <\/span>section 13A of the Representation of the  <\/span>People<\/pre>\n
               <\/span>Act, 1950 (43 of 1950),]<\/pre>\n
           <\/span>(c) \"corrupt practice\" means any of the practices specified<\/pre>\n
          <\/span>in section 123 5* * *;<\/pre>\n
           <\/span>6[(cc)  <\/span>\"  <\/span>district  <\/span>election  <\/span>officer\"  <\/span>means  <\/span>the  <\/span>officer<\/pre>\n
               <\/span>designated  <\/span>or nominated  <\/span>under  <\/span>section  <\/span>13AA  <\/span>of   <\/span>the<\/pre>\n
               <\/span>Representation of the People Act, 1950; (43 of 1950).]<\/pre>\n

          <\/span>either House of Parliament or in the House or either House of<\/pre>\n
          <\/span>the Legislature of a State other than the State of Jammu  <\/span>and<\/pre>\n
          <\/span>Kashmir<\/pre>\n
           <\/span>2[(e)\"elector\" in relation to a constituency means  <\/span>a person<\/pre>\n
          <\/span>whose  <\/span>name  <\/span>is entered in the electoral roll  <\/span>of  <\/span>that  <\/span>con-<\/pre>\n
          <\/span>stituency  <\/span>for the time being in force and who is not subject<\/pre>\n
          <\/span>to  <\/span>any of the disqualifications mentioned in section  <\/span>16  <\/span>of<\/pre>\n
          <\/span>the Representation of the People Act, 1950; (43 of 1950.)]<\/pre>\n
           <\/span>4[(f)  <\/span>\"Political party\" means an association or a  <\/span>body  <\/span>of<\/pre>\n
          <\/span>individual  <\/span>citizens of India registered with the    <\/span>Election<\/pre>\n
          <\/span>Commission as a political party under section 29A<\/pre>\n
           <\/span>(g)  <\/span>\"prescribed\" means prescribed by rules made under  <\/span>this<\/pre>\n
          <\/span>Act ;<\/pre>\n
            <\/span>4    <\/span>[(h) \" public holiday \" means any day which is a public<\/pre>\n
          <\/span>holiday  <\/span>for  <\/span>the purposes of section 25  <\/span>of  <\/span>the  <\/span>Negotiable<\/pre>\n
          <\/span>Instruments Act, 1881 (26 of 1881.)<\/pre>\n
           <\/span>6[(i)     <\/span>\",sign  <\/span>in relation to a person who is  <\/span>unable  <\/span>to<\/pre>\n
          <\/span>write  <\/span>his name means authenticate in such manner as  <\/span>may  <\/span>be<\/pre>\n
          <\/span>prescribed <\/span><\/pre>\n
      <\/span>(2)  <\/span>For  <\/span>the purposes of this Act, 9*   <\/span>*    <\/span>*  <\/span>a  <\/span>Parliamentary<\/pre>\n
 constituency,  <\/span>an  <\/span>Assembly constituency, a  <\/span>Council  <\/span>constituency,  <\/span>a<\/pre>\n
 local  <\/span>authorities$  <\/span>constituency,  <\/span>a graduates$  <\/span>constituency  <\/span>and  <\/span>a<\/pre>\n
 teachers$  <\/span>constituency shall each be treated as a constituency  <\/span>of  <\/span>a<\/pre>\n
 different class.<\/pre>\n

      <\/span>(3)  <\/span>Any  <\/span>requirement under this Act that a notification,  <\/span>order,<\/pre>\n
 rule,  <\/span>declaration,  <\/span>notice or list issued or made  <\/span>by  <\/span>any  <\/span>authority<\/pre>\n
 shall  <\/span>be published in the Official Gazette, shall,  <\/span>unless  <\/span>otherwise<\/pre>\n
 expressly provided in this Act, be construed as a requirement that the<\/pre>\n
 notification, order, rule, declaration, notice or list shall- <\/span><\/pre>\n
 <\/span>               <\/span>(a)  <\/span>where  <\/span>it  <\/span>is  <\/span>issued  <\/span>or  <\/span>made  <\/span>by  <\/span>the   <\/span>Central<\/pre>\n
               <\/span>Government, be published in the Gazette of India;<\/pre>\n
                <\/span>(b)  <\/span>where it is issued or made by a State  <\/span>Government,<\/pre>\n
               <\/span>be published in the Official Gazette of the State; and<\/pre>\n
                <\/span>(c)  <\/span>where it is issued or made by any other authority,<\/pre>\n
               <\/span>be published in the Gazette of India if it relates to an<\/pre>\n
               <\/span>election   <\/span>to,  <\/span>or  <\/span>membership  <\/span>of,  <\/span>either   <\/span>House   <\/span>of<\/pre>\n
              <\/span> <\/span>Parliament  <\/span>1*  <\/span>* * and in the Official Gazette  <\/span>of  <\/span>the<\/pre>\n
               <\/span>State if it relates to an election to, or membership of,<\/pre>\n
               <\/span>the House or either House of the Legislature of a State <\/span><\/pre>\n
       <\/span>(4) Where, under any of the provisions of this Act, anything  <\/span>is<\/pre>\n
 to be prescribed, different provisions may be made for different cases<\/pre>\n
 or classes of cases <\/span><\/pre>\n
      <\/span>3[(5) Any reference in this Act to a law which is not in force in<\/pre>\n
 the State of Jammu and   <\/span>Kashmir shall, in relation to that State,  <\/span>be<\/pre>\n
 construed as a reference to the corresponding law, if any, in force in<\/pre>\n
 that State.]<\/pre>\n
 CHAPTER II<\/span><\/strong>\r\n
 <\/span><\/strong><\/pre>\n
QUALIFICATION FOR  <\/span>MEMBERSHIP OF PARLIAMENT<\/span><\/strong><\/pre>\n
5[3.Qualification  <\/span>for  <\/span>membership of the Council  <\/span>of  <\/span>states.  <\/span>A\r\n
 person shall not be qualified to be chosen as a representative of  <\/span>any<\/span><\/pre>\n

               <\/span>State,   <\/span>and  <\/span>is  <\/span>an  <\/span>elector  <\/span>for   <\/span>any   <\/span>Parliamentary<\/span><\/pre>\n
               <\/span>constituency;<\/span><\/pre>\n
 <\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
                <\/span>(b)  <\/span>in  <\/span>the case of a seat reserved for the  <\/span>Scheduled<\/span><\/pre>\n
               <\/span>Tribes in any State (other than those in the  <\/span>autonomous<\/span><\/pre>\n
               <\/span>districts  <\/span>of  <\/span>Assam),  <\/span>he is a member  <\/span>of  <\/span>any  <\/span>of  <\/span>the<\/span><\/pre>\n
               <\/span>Scheduled Tribes, whether of that State or of any  <\/span>other<\/span><\/pre>\n
               <\/span>State  <\/span>(excluding the tribal areas of Assam), and is  <\/span>an<\/span><\/pre>\n
               <\/span>elector for any Parliamentary constituency;<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(c)  <\/span>in  <\/span>the case of a seat reserved for the  <\/span>Scheduled<\/span><\/pre>\n
               <\/span>Tribes  <\/span>in  <\/span>the autonomous districts of Assam, he  <\/span>is  <\/span>a<\/span><\/pre>\n
               <\/span>member  <\/span>of  <\/span>any  <\/span>of those Scheduled  <\/span>tribes  <\/span>and  <\/span>is  <\/span>an<\/span><\/pre>\n
            <\/span>   <\/span>elector for the Parliamentary constituency in which such<\/span><\/pre>\n
               <\/span>seat   <\/span>is  <\/span>reserved  <\/span>or  <\/span>for  <\/span>any  <\/span>other   <\/span>Parliamentary<\/span><\/pre>\n

          <\/span>QUALIFICATIONS FOR MEMBERSHIP OF STATE LEGISLATURES<\/strong>.<\/span><\/pre>\n
  <\/span><\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
      <\/span>5.Qualifications  <\/span>for  <\/span>membership of a  <\/span>Legislative  <\/span>Assembly.  <\/span>A<\/span><\/pre>\n
 person  <\/span>shall  <\/span>not  <\/span>be qualified to be chosen to fill a  <\/span>seat  <\/span>in  <\/span>the<\/span><\/pre>\n
 Legislative Assembly of a State unless-<\/span><\/pre>\n
 <\/span><\/pre>\n

                <\/span>(a)  <\/span>in  <\/span>the case of a seat reserved for the  <\/span>Scheduled<\/span><\/pre>\n

          <\/span>     <\/span>constituency in that State ;<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(b)  <\/span>in  <\/span>the case of a seat reserved for an  <\/span>autonomous<\/span><\/pre>\n
               <\/span>district  <\/span>of  <\/span>Assam,  <\/span>1  <\/span>***  <\/span>he is  <\/span>a  <\/span>member  <\/span>of  <\/span>a  <\/span>2<\/span><\/pre>\n
               <\/span>[Scheduled  <\/span>Tribe of any autonomous district] and is  <\/span>an<\/span><\/pre>\n
    <\/span>           <\/span>elector for the Assembly constituency in which such seat<\/span><\/pre>\n
               <\/span>or any other seat is reserved for that district ; and<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(c)  <\/span>in  <\/span>the case of any other seat, he is  <\/span>an  <\/span>elector<\/span><\/pre>\n
               <\/span>for any Assembly  <\/span>constituency in that State:<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>3[Provided  <\/span>that  <\/span>for  <\/span>the period referred to in  <\/span>clause  <\/span>(2)  <\/span>of<\/span><\/pre>\n
 article 371A, a person shall not be qualified to be chosen to fill any<\/span><\/pre>\n
 seat allocated to the Tuensang district in the Legislative Assembly of<\/span><\/pre>\n
 Nagaland unless he is a member of the regional council referred to  <\/span>in<\/span><\/pre>\n
 that article.]<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>4[5A.5[(1)]Qualifications for membership of Legislative  <\/span>Assembly<\/span><\/pre>\n
 of Sikkim.  <\/span>Notwithstanding anything contained in section 5, a  <\/span>person<\/span><\/pre>\n
 shall not be qualified to be chosen to fill a seat in the  <\/span>Legislative<\/span><\/pre>\n
 Assembly  <\/span>of  <\/span>Sikkim (deemed to be the Legislative  <\/span>Assembly  <\/span>of  <\/span>that<\/span><\/pre>\n
 State duly constituted under the Constitution) unless-<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(a) in  <\/span>the  <\/span>case of a seat reserved for  <\/span>Sikkimese  <\/span>of<\/span><\/pre>\n
               <\/span>Bhutia-Lepcha origin, he is a person either of Bhutia or<\/span><\/pre>\n
               <\/span>Lepcha  <\/span>origin  <\/span>and  <\/span>is  <\/span>an  <\/span>elector  <\/span>for  <\/span>any  <\/span>Assembly<\/span><\/pre>\n
               <\/span>constituency  <\/span>in the State other than  <\/span>the  <\/span>constituency<\/span><\/pre>\n
               <\/span>reserved for the Sanghas ;<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(b)  <\/span>in the case  <\/span>of a seat reserved for  <\/span>Sikkimese  <\/span>of<\/span><\/pre>\n
               <\/span>Nepal  <\/span>origin he is a person of Nepali origin and is  <\/span>an<\/span><\/pre>\n
               <\/span>elector for an Assembly constituency in the State;<\/span><\/pre>\n
 <\/span><\/pre>\n

      <\/span>7.Definition. In this Chapter,-<\/span><\/pre>\n
 <\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
                <\/span>(a)  <\/span>\"appropriate Government\" means in relation to  <\/span>any<\/span><\/pre>\n
               <\/span>disqualification  <\/span>for  <\/span>being chosen as or  <\/span>for  <\/span>being  <\/span>a<\/span><\/pre>\n
               <\/span>member  <\/span>of  <\/span>either  <\/span>House  <\/span>of  <\/span>Parliament,  <\/span>the  <\/span>Central<\/span><\/pre>\n
               <\/span>Government, and in relation to any disqualification  <\/span>for<\/span><\/pre>\n
               <\/span>being chosen as or for being a member of the Legislative<\/span><\/pre>\n
               <\/span>Assembly  <\/span>or Legislative Council of a State,  <\/span>the  <\/span>State<\/span><\/pre>\n

           <\/span>(a)  <\/span>section  <\/span>153A  <\/span>(offence  <\/span>of  <\/span>promoting  <\/span>enmity  <\/span>between<\/span><\/pre>\n
          <\/span>different groups on ground of religion, race, place of birth,<\/span><\/pre>\n
          <\/span>residence,  <\/span>language,  <\/span>etc., and doing  <\/span>acts  <\/span>prejudicial  <\/span>to<\/span><\/pre>\n
          <\/span>maintenance of harmony) or section 171E (offence of  <\/span>bribery)<\/span><\/pre>\n
          <\/span>or section 171F (offence of undue influence or personation at<\/span><\/pre>\n
          <\/span>an election) or sub-section (1) or sub-section (2) of section<\/span><\/pre>\n
          <\/span>376  <\/span>or  <\/span>section  <\/span>376A or section 376B  <\/span>or  <\/span>section  <\/span>376C  <\/span>or<\/span><\/pre>\n
        <\/span>  <\/span>section  <\/span>376D  <\/span>(offences relating to rape)  <\/span>or  <\/span>section  <\/span>498A<\/span><\/pre>\n
          <\/span>(offence of cruelty towards a woman by husband or relative of<\/span><\/pre>\n
          <\/span>a  <\/span>husband) or sub-section (2) or sub-section (3) of  <\/span>section<\/span><\/pre>\n
          <\/span>505  <\/span>(offence  <\/span>of  <\/span>making  <\/span>statement  <\/span>creating  <\/span>or  <\/span>promoting<\/span><\/pre>\n
          <\/span>enmity,  <\/span>hatred  <\/span>or  <\/span>ill-will  <\/span>between  <\/span>classes  <\/span>or   <\/span>offence<\/span><\/pre>\n
          <\/span>relating to such statement in any place of worship or in  <\/span>any<\/span><\/pre>\n
          <\/span>assembly  <\/span>engaged in the performance of religious worship  <\/span>or<\/span><\/pre>\n
          <\/span>religious ceremonies) of the Indian Penal Code; or<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(b)  <\/span>the  <\/span>Protection of Civil Rights  <\/span>Act,  <\/span>1955  <\/span>which<\/span><\/pre>\n
               <\/span>provides  <\/span>for punishment for the preaching and  <\/span>practice<\/span><\/pre>\n
               <\/span>of  <\/span>\"untouchability\",  <\/span>and for the  <\/span>enforcement  <\/span>of  <\/span>any<\/span><\/pre>\n
               <\/span>disability arising therefrom ; or<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(c)  <\/span>section  <\/span>11  <\/span>(offence of  <\/span>importing  <\/span>or  <\/span>exporting<\/span><\/pre>\n
               <\/span>prohibited goods) of the Customs Act, 1962 (52 of 1962);<\/span><\/pre>\n
               <\/span>or<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(d) sections 10 to 12 (offence of being a member of  <\/span>an<\/span><\/pre>\n
               <\/span>association  <\/span>declared  <\/span>unlawful,  <\/span>offence  <\/span>relating   <\/span>to<\/span><\/pre>\n
               <\/span>dealing with funds of an unlawful association or offence<\/span><\/pre>\n
               <\/span>relating to contravention of an order made in respect of<\/span><\/pre>\n
  <\/span>             <\/span>a   <\/span>notified   <\/span>place)   <\/span>of   <\/span>the   <\/span>Unlawful   <\/span>Activities<\/span><\/pre>\n
               <\/span>(Prevention) Act, 1967 (37 of 1967); or<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(e) the   <\/span>Foreign   <\/span>Exchange  <\/span>(Regulation)   <\/span>Act,  <\/span>1973<\/span><\/pre>\n
               <\/span>(76 of 1973); or<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(f) the Narcotic Drugs and Psychotropic Substances Act,<\/span><\/pre>\n
               <\/span>1985 (61 of 1985); or<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(g) section 3 (offence of committing terrorist acts) or<\/span><\/pre>\n
               <\/span>section 4 (offence of committing disruptive  <\/span>activities)<\/span><\/pre>\n
               <\/span>of the Terrorist and Disruptive Activities (Prevention )<\/span><\/pre>\n
               <\/span>Act, 1987 (28 of 1987); or<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(h)   <\/span>section  <\/span>7  <\/span>(offence  <\/span>of  <\/span>contravention  <\/span>of   <\/span>the<\/span><\/pre>\n
               <\/span>provisions  <\/span>of  <\/span>sections  <\/span>3  <\/span>to  <\/span>6)  <\/span>of  <\/span>the   <\/span>Religious<\/span><\/pre>\n
               <\/span>Institutions    <\/span>(Prevention   <\/span>of   <\/span>Misuse)   <\/span>Act,   <\/span>1988<\/span><\/pre>\n

               <\/span>Act, 1991,\"] [or]7<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>7[\"(k)  <\/span>section  <\/span>2  <\/span>(offence  <\/span>of  <\/span>insulting  <\/span>the Indian<\/span><\/pre>\n
               <\/span>National Flag or the Constitution of India) or section 3<\/span><\/pre>\n
               <\/span>(offence  <\/span>of preventing singing of National  <\/span>Antham)  <\/span>of<\/span><\/pre>\n
               <\/span>the Prevention of Insults to National Honour  <\/span>Act,  <\/span>1971<\/span><\/pre>\n
               <\/span>(69 of 1971);]<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>shall  <\/span>be disqualified for a period of six  <\/span>years  <\/span>from<\/span><\/pre>\n
               <\/span>the date of such conviction.<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(2) A person convicted for the contravention of--<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(a) any law providing for the prevention of hoarding or<\/span><\/pre>\n
               <\/span>profiteering; or<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(b)  <\/span>any  <\/span>law relating to the adulteration of  <\/span>food  <\/span>or<\/span><\/pre>\n
               <\/span>drugs; or<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(c) any provisions of the Dowry Prohibition  <\/span>Act,  <\/span>1961<\/span><\/pre>\n
  <\/span>             <\/span>(28 of 1961); or<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(d)   <\/span>any   <\/span>provisions  <\/span>of  <\/span>the  <\/span>Commission   <\/span>of   <\/span>Sati<\/span><\/pre>\n
               <\/span>(Prevention) Act. 1987 (3 of 1988),<\/span><\/pre>\n
 <\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
 <\/span>and  <\/span>sentenced to imprisonment for not less than six months, shall  <\/span>be<\/span><\/pre>\n
 disqualified from the date of such conviction and shall continue to be<\/span><\/pre>\n
 disqualified for a further period of six years since his release.<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>(3)   <\/span>A  <\/span>person  <\/span>convicted  <\/span>of  <\/span>any  <\/span>offence  <\/span>and  <\/span>sentenced   <\/span>to<\/span><\/pre>\n
 imprisonment  <\/span>for  <\/span>not  <\/span>less than two years [other  <\/span>than  <\/span>any  <\/span>offence<\/span><\/pre>\n
 referred   <\/span>to   <\/span>in  <\/span>sub-section  <\/span>(1)  <\/span>or  <\/span>sub-section   <\/span>(2)]shall   <\/span>be<\/span><\/pre>\n
 disqualified form the date of such conviction and shall continue to be<\/span><\/pre>\n
 disqualified for a further period of six years since his release.]<\/span><\/pre>\n

      <\/span>(4) Notwithstanding anything in sub-section (1),sub-section(2),or<\/span><\/pre>\n
 sub-section (3)] a  <\/span>disqualification  <\/span>under  <\/span>either  <\/span>sub-section shall<\/span><\/pre>\n
 not,  <\/span>in the case of a person who on the date of the conviction  <\/span>is  <\/span>a<\/span><\/pre>\n
 member of Parliament or the Legislature of a State, take effect  <\/span>until<\/span><\/pre>\n
 three months have elapsed<\/span><\/pre>\n

               <\/span>dity may be bought or sold ;<\/span><\/pre>\n

                <\/span>(iii)the   <\/span>regulation   <\/span>of   <\/span>acquisition,   <\/span>possession,<\/span><\/pre>\n
               <\/span>storage,  <\/span>transport,  <\/span>distribution,  <\/span>disposal,  <\/span>use   <\/span>or<\/span><\/pre>\n
               <\/span>consumption of any essential commodity;<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(iv)the prohibition of the withholding from sale of any<\/span><\/pre>\n
               <\/span>essential commodity ordinarily kept for sale ;<\/span><\/pre>\n
 <\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
           <\/span>(b)  <\/span>\"drug\" has the meaning assigned to it in the Durgs and<\/span><\/pre>\n
           <\/span>Cosmetics Act, 1940 (23 of 1940)<\/span><\/pre>\n
 <\/span><\/pre>\n
           <\/span>(c)  <\/span>\"essential commodity\" has the meaning assigned to it in<\/span><\/pre>\n
          <\/span>the Essential Commodity Act, 1955; (10 of 1955)<\/span><\/pre>\n
 <\/span><\/pre>\n
           <\/span>(d)  <\/span>\"food\" has the meaning assigned to it in the Prevention<\/span><\/pre>\n
          <\/span>of Food Adulteration Act, 1954.(37 of 1954)<\/span><\/pre>\n
 <\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
      <\/span>1[8A. Disqualification on  <\/span>ground  <\/span>of corrupt practices. (1)  <\/span>The<\/span><\/pre>\n
 case   <\/span>of every person found guilty of a corrupt practice by an  <\/span>order<\/span><\/pre>\n
 under  <\/span>section  <\/span>99 shall be submitted, as soon as may  <\/span>be  <\/span>after  <\/span>such<\/span><\/pre>\n
 order  <\/span>takes effect, by such authority as the Central  <\/span>Government  <\/span>may<\/span><\/pre>\n
 specify  <\/span>in  <\/span>this behalf, to the President for  <\/span>determination  <\/span>of  <\/span>the<\/span><\/pre>\n
 question  <\/span>as to whether such person shall be disqualified and  <\/span>if  <\/span>so,<\/span><\/pre>\n
 for what period:<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>Provided that the period for which any person may be disqualified<\/span><\/pre>\n
 under this sub-section shall in no case exceed six years from the date<\/span><\/pre>\n
 on  <\/span>which  <\/span>the order made in relation to him under  <\/span>section  <\/span>99  <\/span>takes<\/span><\/pre>\n
 effect.<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>(2)  <\/span>Any person who stands disqualified under section 8A of  <\/span>this<\/span><\/pre>\n
 Act  <\/span>as it stood immediately before the commencement of  <\/span>the  <\/span>Election<\/span><\/pre>\n
 Laws  <\/span>(Amendment) Act, 1975, (40 of 1975) may, if the period  <\/span>of  <\/span>such<\/span><\/pre>\n
 disqualification ha<\/span> <\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
 <\/span>not  <\/span>expired,  <\/span>submit a petition to the President for the  <\/span>removal  <\/span>of<\/span><\/pre>\n
 such disqualification for the unexpired portion of the said period.<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>(3)  <\/span>Before giving his decision on any question mentioned in sub-<\/span><\/pre>\n
 section  <\/span>(1) or on any petition submitted under sub-section  <\/span>(2),  <\/span>the<\/span><\/pre>\n
 President shall obtain the opinion of the Election Commission on  <\/span>such<\/span><\/pre>\n
 question or petition and shall act according to such opinion.]<\/span>  <\/span><\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
     <\/span>9.Disqualification for dismissal for corruption or disloyalty. (1)<\/span><\/pre>\n
 A  <\/span>person who having held an office under the Government of  <\/span>India  <\/span>or<\/span><\/pre>\n
 under the Government of any State has been dismissed for corruption or<\/span><\/pre>\n
 for disloyalty to the State shall be disqualified for a period of five<\/span><\/pre>\n
 years from the date of such dismissal.<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>(2)  <\/span>For the purposes of sub-section (1), a certificate issued by<\/span><\/pre>\n
 the Election Commission to the effect that a person having held office<\/span><\/pre>\n
 under the Government of India or under the Government of a State,  <\/span>has<\/span><\/pre>\n
 or  <\/span>has  <\/span>not been dismissed for corruption or for  <\/span>disloyalty  <\/span>to  <\/span>the<\/span><\/pre>\n
 State shall be conclusive proof of that fact :<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>Provided that no certificate to the effect that a person has been<\/span><\/pre>\n
 dismissed  <\/span>for  <\/span>corruption  <\/span>or for disloyalty to the  <\/span>State  <\/span>shall  <\/span>be<\/span><\/pre>\n
 issued  <\/span>unless  <\/span>an opportunity of being- heard has been given  <\/span>to  <\/span>the<\/span><\/pre>\n
 said person,<\/span><\/pre>\n
 <\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
      <\/span>9A.Disqualification for Government contract, etc.  <\/span>A person shall<\/span><\/pre>\n
 be  <\/span>disqualified  <\/span>if, and for so long as, there  <\/span>subsists  <\/span>a  <\/span>contract<\/span><\/pre>\n
 entered  <\/span>into by him in the course of his trade or business  <\/span>with  <\/span>the<\/span><\/pre>\n
 appropriate  <\/span>Government  <\/span>for  <\/span>the  <\/span>supply of  <\/span>goods  <\/span>to,  <\/span>or  <\/span>for  <\/span>the<\/span><\/pre>\n
 execution of any works undertaken by, that Government.<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>Explanation.-For  <\/span>the purposes of this section, where a  <\/span>contract<\/span><\/pre>\n
 has  <\/span>been  <\/span>fully performed by the person by whom it has  <\/span>been  <\/span>entered<\/span><\/pre>\n
 into with the appropriate Government, the contract shall be deemed not<\/span><\/pre>\n
 to  <\/span>subsist  <\/span>by reason only of the fact that the  <\/span>Government  <\/span>has  <\/span>not<\/span><\/pre>\n
 performed its part of the contract either wholly or in partially<\/span>.<\/span><\/pre>\n
  <\/span><\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
      <\/span>10.Disqualification for office under Government company. A person<\/span><\/pre>\n
 shall be disqualified if, and for so long as, he is a managing  <\/span>agent,<\/span><\/pre>\n
 manager  <\/span>or secretary of any company or corporation (other than a  <\/span>co-<\/span><\/pre>\n
 operative society) in the capital of which the appropriate  <\/span>Government<\/span><\/pre>\n
 has not less than twenty-five per cent. share.<\/span> <\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
      <\/span>10A.Disqualification  <\/span>for  <\/span>failure to lodge account  <\/span>of  <\/span>election<\/span><\/pre>\n
 expenses. If the Election Commission is satisfied that a person-<\/span><\/pre>\n
 <\/span><\/pre>\n
                <\/span>(a)  <\/span>has  <\/span>failed  <\/span>to  <\/span>lodge  <\/span>an  <\/span>account  <\/span>of   <\/span>election<\/span><\/pre>\n
               <\/span>expenses  <\/span>within the time and in the manner required  <\/span>by<\/span><\/pre>\n
               <\/span>or under this Act and (b) has   <\/span>no   <\/span>good   <\/span>reason    <\/span>or<\/span><\/pre>\n
               <\/span>justification for the failure,<\/span><\/pre>\n
 <\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
 <\/span>the  <\/span>Election  <\/span>Commission shall, by order published  <\/span>in  <\/span>the  <\/span>Official<\/span><\/pre>\n
 Gazette,  <\/span>declare him to be disqualified and any such person shall  <\/span>be<\/span><\/pre>\n
 disqualified for a period of three years from the date of the order.<\/span>.<\/span><\/pre>\n
  <\/span><\/span><\/pre>\n
 <\/span><\/span><\/pre>\n
      <\/span>11.Removal  <\/span>or  <\/span>reduction  <\/span>of  <\/span>period  <\/span>of  <\/span>disqualification.  <\/span>The<\/span><\/pre>\n
 Election  <\/span>Commission  <\/span>may,  <\/span>for reasons to  <\/span>be  <\/span>recorded,  <\/span>remove  <\/span>any<\/span><\/pre>\n
 disqualification  <\/span>under this Chapter 1[(except under section  <\/span>8A)]  <\/span>or<\/span><\/pre>\n
 reduce the period of any such disqualification.<\/span><\/pre>\n
 <\/span><\/pre>\n
  <\/span><\/span><\/pre>\n
 <\/span>CHAPTER IV<\/strong><\/pre>\n
  <\/strong><\/span><\/pre>\n
 <\/span>DISQUALIFICATIONS FOR <\/strong>VOTING                              <\/span><\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>11A.2[(1)] Disqualification arising out of conviction and corrupt<\/span><\/pre>\n
 practices.  <\/span>If any person, after the commencement of this Act,-<\/span><\/pre>\n
 <\/span><\/pre>\n

 disqualified for voting at any election.<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>6[(2)  <\/span>Any  <\/span>person disqualified by a decision  <\/span>of  <\/span>the  <\/span>President<\/span><\/pre>\n
 under  <\/span>sub-section  <\/span>(1)  <\/span>of  <\/span>section  <\/span>8A  <\/span>for  <\/span>any  <\/span>period  <\/span>shall   <\/span>be<\/span><\/pre>\n
 disqualified for the same period for voting at any election.<\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>(3)  <\/span>The decision of the President on a petition submitted by any<\/span><\/pre>\n

NOTIFICATION OF GENERAL ELECTIONS<\/span><\/pre>\n
 <\/span>12.Notification <\/span>for biennial election to the Council of <\/span>States.<\/p>\n
 For  <\/span>the  <\/span>purpose of filling the seats of members of  <\/span>the  <\/span>Council  <\/span>of<\/span><\/pre>\n
 States  <\/span>retiring on the expiration of their term of office the  <\/span>Presi-<\/span><\/pre>\n
 dent  <\/span>shall, by one or more notifications published in the Gazette  <\/span>of<\/span><\/pre>\n
 India  <\/span>on  <\/span>such date or dates as may be recommended  <\/span>by  <\/span>the  <\/span>Election<\/span><\/pre>\n
 Commission, call upon the elected members of the Legislative  <\/span>Assembly<\/span><\/pre>\n
 or, as the case may be, the  <\/span>members of the electoral college, of each<\/span><\/pre>\n
 State concerned to elect members in accordance with the provisions  <\/span>of<\/span><\/pre>\n
 this Act and of the rules and orders made thereunder :<\/span><\/pre>\n
 <\/span><\/pre>\n
 <\/span>     <\/span>Provided that no notification under this section shall be  <\/span>issued<\/span><\/pre>\n

      <\/span>2[20.General duties of chief electoral Officers.  <\/span>Subject to  <\/span>the<\/pre>\n
 superintendence, direction and control of the Election Commission, the<\/pre>\n
 chief  <\/span>electoral officer of each State shall supervise the conduct  <\/span>of<\/pre>\n
 all elections in the State under this Act.<\/pre>\n
      <\/span>3[20A.(1)General duties of district election officer.  <\/span>Subject to<\/pre>\n
 the  <\/span>superintendence,  <\/span>direction and control of  <\/span>the  <\/span>chief  <\/span>electoral<\/pre>\n
 officer, the district election officer shall coordinate and  <\/span>supervise<\/pre>\n
 all  <\/span>work  <\/span>in the district or in the area within his  <\/span>jurisdiction  <\/span>in<\/pre>\n
 connection  <\/span>with, the conduct of all elections to Parliament  <\/span>and  <\/span>the<\/pre>\n
 Legislature of the State.<\/pre>\n
      <\/span>(2)  <\/span>The district election officer shall also perform such  <\/span>other<\/pre>\n
 functions as may be entrusted to him by the  <\/span>Election  <\/span>Commission  <\/span>and<\/pre>\n
 the chief electoral officer.]<\/pre>\n
      <\/span>6[20B.  <\/span>(1) The Election Commission may nominate an Observer  <\/span>who<\/pre>\n
 shall be an officer of Government to watch the conduct of elections in<\/pre>\n
 a constituency or a group of constituencies and to perform  <\/span>such other<\/pre>\n
 functions as may be entrusted to him by the Election Commission.<\/pre>\n
      <\/span>(2) The  <\/span>Observer nominated under sub-section (1) shall have  <\/span>the<\/pre>\n
 power to direct the returning officer for the constituency or for  <\/span>any<\/pre>\n
 of  <\/span>the  <\/span>constituencies  <\/span>for  <\/span>which he has been nominated, to stop the<\/pre>\n
 counting of votes at any time before the declaration of the result  <\/span>or<\/pre>\n
 not  <\/span>to  <\/span>declare  <\/span>the  <\/span>result  <\/span>if in the opinion of the Observer booth<\/pre>\n
 capturing has taken place at a large number of polling stations or  <\/span>at<\/pre>\n
 places  <\/span>fixed  <\/span>for  <\/span>the poll or counting of votes or any ballot papers<\/pre>\n
 used at a polling station or  <\/span>at  <\/span>a  <\/span>place  <\/span>fixed  <\/span>for  <\/span>the  <\/span>poll  <\/span>are<\/pre>\n
 unlawfully  <\/span>taken  <\/span>out  <\/span>of the custody of the returning officer or are<\/pre>\n
 accidentally or intentionally destroyed or  <\/span>lost  <\/span>or  <\/span>are  <\/span>damaged  <\/span>or<\/pre>\n
 tampered  <\/span>with  <\/span>to  <\/span>such an extent that the result of the poll at that<\/pre>\n
 polling station or place cannot be ascertained.<\/pre>\n
      <\/span>(3) Where  <\/span>an Observer has directed the returning  <\/span>officer  <\/span>under<\/pre>\n
 this  <\/span>section  <\/span>to stop counting of votes or not to declare the result,<\/pre>\n
 the Observer  <\/span>shall  <\/span>forthwith  <\/span>report  <\/span>the  <\/span>matter  <\/span>to  <\/span>the  <\/span>Election<\/pre>\n
 Commission  <\/span>shall,  <\/span>after  <\/span>taking   <\/span>all  <\/span>material  <\/span>circumstances  <\/span>into<\/pre>\n
 account, issue appropriate directions under section 58A or section 64A<\/pre>\n
 or section 66.<\/pre>\n
      <\/span>Explanation.- For the purposes of sub-section (2) and sub-section<\/pre>\n
 (3),  <\/span>\"Observer\"  <\/span>shall  <\/span>include  <\/span>a  <\/span>Regional Commissioner or any such<\/pre>\n
 officer of the Election Commission as  <\/span>has  <\/span>been assigned  <\/span>under  <\/span>this<\/pre>\n
 section the duty of watching the conduct of election or elections in a<\/pre>\n

      <\/span>21.Returning officers. For every constituency, for every election<\/pre>\n
 to  <\/span>fill  <\/span>a  <\/span>seat  <\/span>or seats in the Council of  <\/span>States  <\/span>and  <\/span>for  <\/span>every<\/pre>\n
 election by the members of the Legislative Assembly of a State to fill<\/pre>\n
 a seat or seats in the Legislative Council of the State, the  <\/span>Election<\/pre>\n
 Commission  <\/span>shall, in consultation with the Government of  <\/span>the  <\/span>State,<\/pre>\n
 designate  <\/span>or nominate a returning officer who shall be 4 [an  <\/span>officer<\/pre>\n

 appoint  <\/span>one  <\/span>or more persons to assist any returning officer  <\/span>in  <\/span>the<\/pre>\n
 performance of his functions:<\/pre>\n

 -this Act to the returning officer shall, unless the context otherwise<\/pre>\n
 requires,  <\/span>be  <\/span>deemed  <\/span>to  <\/span>include  <\/span>an  <\/span>assistant  <\/span>returning   <\/span>officer<\/pre>\n
 performing  <\/span>any function which he is authorised to perform under  <\/span>sub-<\/pre>\n

      <\/span>24.General  <\/span>duty  <\/span>of returning officer. It shall be  <\/span>the  <\/span>general<\/pre>\n
 duty of the returning officer at any election to do all such acts  <\/span>and<\/pre>\n
 things as may be necessary for effectually conducting the election  <\/span>in<\/pre>\n
 the manner provided by this Act and rules or orders made thereunder.<\/pre>\n
 <\/span><\/pre>\n
  <\/span><\/pre>\n
 <\/span>25.<\/pre>\n
  <\/span><\/pre>\n
 <\/span>Provision of polling stations for constituencies.<\/pre>\n
  <\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>3[25.Provision  <\/span>of  <\/span>polling  <\/span>stations  <\/span>for  <\/span>constituencies.   <\/span>The<\/pre>\n
 district,  <\/span>election officer shall, with the previous approval  <\/span>of  <\/span>the<\/pre>\n
 Election  <\/span>Commission, provide a sufficient number of polling  <\/span>stations<\/pre>\n
 for every constituency the whole or greater part of which lies  <\/span>within<\/pre>\n
 his  <\/span>jurisdiction, and shall publish, in such manner as  <\/span>the  <\/span>Election<\/pre>\n
 Commission  <\/span>may  <\/span>direct,  <\/span>a  <\/span>list showing   <\/span>the  <\/span>polling  <\/span>stations  <\/span>so<\/pre>\n
 provided and the polling areas or groups of voters for which they have<\/pre>\n
 respectively been provided.]  <\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>26.Appointment of presiding officers of polling stations. (1) The<\/pre>\n
 4[district election officer] shall appoint a presiding office for each<\/pre>\n
 polling  <\/span>station  <\/span>and  <\/span>such polling officer or officers  <\/span>as  <\/span>he  <\/span>think<\/pre>\n
 necessary,  <\/span>but he shall not appoint any person who has been  <\/span>employed<\/pre>\n
 by or on behalf of, or has been otherwise working for, a candidate  <\/span>in<\/pre>\n
 or about the election<\/pre>\n
      <\/span>Provided  <\/span>that  <\/span>if a polling officer is absent from  <\/span>the  <\/span>polling<\/pre>\n
 station, the  <\/span>presiding  <\/span>officer may appoint any person who is present<\/pre>\n
 at the polling<\/pre>\n

 or  <\/span>has  <\/span>been  <\/span>otherwise  <\/span>working for, a candidate  <\/span>in  <\/span>or  <\/span>about  <\/span>the<\/pre>\n
 election,  <\/span>to be the polling officer during the absence of the  <\/span>former<\/pre>\n
 officer, and inform the 1[district election officer] accordingly :<\/pre>\n
      <\/span>2[Provided further that nothing in this sub-section shall prevent<\/pre>\n
 the 1[district election officer] from appointing the same person to be<\/pre>\n
 the  <\/span>presiding  <\/span>officer  <\/span>for more than one polling station in the same<\/pre>\n
 premises.]<\/pre>\n
      <\/span>(2)  <\/span>A  <\/span>polling officer shall, if so directed  <\/span>by  <\/span>the  <\/span>presiding<\/pre>\n
 officer,  <\/span>perform all or any of the functions of a  <\/span>presiding  <\/span>officer<\/pre>\n
 under this Act or any rules or orders made thereunder.<\/pre>\n
      <\/span>(3)  <\/span>If  <\/span>the  <\/span>presiding  <\/span>officer,  <\/span>owing  <\/span>to  <\/span>illness  <\/span>or   <\/span>other<\/pre>\n
 unavoidable  <\/span>cause,  <\/span>is  <\/span>obliged to absent himself  <\/span>from  <\/span>the  <\/span>polling<\/pre>\n
 station,  <\/span>his functions shall be performed by such polling officer  <\/span>as<\/pre>\n
 has been previously authorized by the 1[district election officer]  <\/span>to<\/pre>\n
 perform such functions during any such absence.<\/pre>\n
      <\/span>(4) References in this Act to the presiding officer shall, unless<\/pre>\n
 the  <\/span>context  <\/span>otherwise  <\/span>requires, be deemed  <\/span>to  <\/span>include  <\/span>any  <\/span>person<\/pre>\n
 performing  <\/span>any function which he is authorized to perform under  <\/span>sub-<\/pre>\n
 section (2) or sub-section (3), as the case may be.<\/pre>\n
      <\/span>3[(5) Any reference to a district election officer in section  <\/span>25<\/pre>\n
 and  <\/span>in this section shall, in relation to a constituency in  <\/span>a  <\/span>Union<\/pre>\n
 territory,  <\/span>be construed as a reference to the returning  <\/span>officer  <\/span>for<\/pre>\n
 that constituency.<\/pre>\n
  <\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>27.  <\/span>General  <\/span>duty  <\/span>of the presiding officer.  <\/span>It  <\/span>shall  <\/span>be  <\/span>the<\/pre>\n
 general  <\/span>duty  <\/span>of the presiding officer at a polling station  <\/span>to  <\/span>keep<\/pre>\n
 order thereat and to see that the poll is fairly taken.<\/pre>\n
  <\/span><\/pre>\n
 <\/span><\/pre>\n
      <\/span>28.  <\/span>Duties  <\/span>of a polling officer. It shall be the  <\/span>duty  <\/span>of  <\/span>the<\/pre>\n
 polling officers at a polling station to assist the presiding  <\/span>officer<\/pre>\n
 for such station in the performance of his functions.<\/pre>\n
      <\/span>[28A. Returning officer, presiding officer, etc., deemed to be on<\/pre>\n
 deputation  <\/span>to Election Commission. The returning  <\/span>officer,  <\/span>assistant<\/pre>\n
 returning  <\/span>officer, presiding officer, polling officer, and any  <\/span>other<\/pre>\n
 officer appointed under this Part, and. any police officer  <\/span>designated<\/pre>\n
 for  <\/span>the  <\/span>time being by the State Government, for the conduct  <\/span>of  <\/span>any<\/pre>\n
 election  <\/span>shall  <\/span>be  <\/span>deemed  <\/span>to  <\/span>be  <\/span>on  <\/span>deputation  <\/span>to  <\/span>the  <\/span>Election<\/pre>\n
 Commission  <\/span>for  <\/span>the  <\/span>period commencing on and from the  <\/span>date  <\/span>of  <\/span>the<\/pre>\n
 notification  <\/span>calling  <\/span>for such election and ending with the  <\/span>date  <\/span>of<\/pre>\n
 declaration  <\/span>of  <\/span>the results of such election  <\/span>and  <\/span>accordingly,  <\/span>such<\/pre>\n
 officers  <\/span>shall,  <\/span>during  <\/span>that  <\/span>period, be  <\/span>subject  <\/span>to  <\/span>the  <\/span>control,<\/pre>\n
 superintendence and discipline of the Election Commission.]  <\/span><\/pre>\n

      <\/span>29. Special provisions in the case of certain elections. (1)  <\/span>The<\/pre>\n
