HC quashes KSERC order on commercial tariff

Kerala High Court quashed the State Electricity Regulatory Commission’s decision to levy commercial tariff on self financing schools and colleges.

A division bench comprising Justices P R Raman and P Bhavadasan set aside the commission’s December 2007 order.

The commission had stated that self financing educational institutions were using air conditioners and so it had decided to impose commercial tariff on them.

However, the bench said the commission had not conducted any study or produced any documents to support levying of the tariff.The bench said the old tariff would be applicable to the self-financing educational institutions.
