By
this application, the applicants, original appellants, seek
permission to bring on record the heirs and legal representatives of
deceased respondent No.1, i.e. Khat Kadva Kara who has expired on
01.02.2011.
Heard
Ms. Amrita Ajmera, learned advocate for the applicant.
Having
regard to the averments made in the application, it is apparent that
respondent No.1 Khat Kadva Kara has expired on 01.02.2011. The
applicant has annexed an affidavit of the son of the deceased wherein
it is stated that his father Khat Kadva Kara expired on 01.02.2011.
This application has been filed on 26th April 2011, within
the prescribed period of limitation.
In
the aforesaid circumstances, the application is allowed. The
appellant is permitted to bring on record the heirs and legal
representatives of deceased respondent No.1 and to amend the cause
title accordingly.
The
application stands disposed of accordingly.
