03. 17.03.2011. Heard.

The police raided the house of the

petitioner and recovered two mousers, country

made pistols from the one corner of the house

which was concealed in polythene. There were

seven cartridges and four empty cartridges

also along with four copies of letter pads

written over it MCC Samaj Sudhark Sangathan.

On the above recoveries, the petitioner was

alleged to be the member of the MCC and he

was made an accused.

The contention is that the petitioner

has falsely been implicated in this case on

account of his political links and further

that the recoveries are transplanted.

Regard being had to the evidence of

recovery as collected by the police on spot,

the court is not inclined to grant bail to

the petitioner. Petition is dismissed.

However, as soon as the petitioner

completes one year of confinement in Gurua

P.S.Case No.53 of 2010 without the trial

being concluded, the petitioner shall be

admitted to bail by the court below, i.e.,

S.D.J.M., Sherghati, Gaya on execution of a

bond to his own satisfaction.
