Counter affidavit is taken on record.

Heard learned counsel for the applicant, the learned Additional
Government Advocate and perused the F.I.R., medical report and other
relevant papers filed in support of the bail application.

The incident is of day light and the allegation against the applicant is
that he fired from country made pistol which caused two injuries to
Dharam Pal Dubey, uncle of the applicant. Injury no.1 is on the vital
part,i.e. stomach; charring and tattooing was present. The injury was
examined at P.H.C. but the doctor referred the injured to District
Hospital.

Considering the seat of the injury, which is on vital part and the daring
act of the applicant, I do not find it a fit case to release the applicant on
bail. The bail application is accordingly rejected. However, the trial court
shall make every endeavour to expedite the trial at the earliest and
conclude the same,if possible within six months from the date of receipt
of a certified copy of this order.
