Heard
learned counsel for the respective parties. Para 14 of the memo reads
as under :

That
respondent no. 4 and other officers are defending the vada persons,
who are illegally cultivating the river bed because to the
information of the petitioners, the respondent no. 3 and others are
collecting installments and pocketing the same instead of depositing
in the Government treasury under the blessings of concerned revenue
authority and that the new issue of the farmers of uparvas has been
created by the respondent no. 3 and others, only because respondent
no. 3 has not been paid Rs.20,000/- for release of water, which he
has demanded from one farmer Karasinh Jadeja, petitioner no.2, as per
his normal practice.

In
spite of the order dated 22.01.2010, respondent no. 3 has neither
filed the reply, nor has remained present. As a last chance the
matter to come up for hearing on 29.01.2010. It is clarified that
respondent no. 3 will remain present before this Court at 11:00. Mr.
Shah, learned AGP shall take necessary instructions as to how the
order dated 01.12.2009 passed by the State Government can be
implemented in the best manner, which is suitable to the Government.
