2. 1.7.2010 Heard Learned counsel for the petitioners and the State.
There is allegation of demand and torture for its non-
fulfilment but at the time of death deceased was residing with her
parents of their native village. If the allegation is accepted then also
some days earlier to the death accused persons went to informant’s
house, abused the deceased but even did not cause any harm. Thereafter,
on 16.6.2009 she fell ill and admitted to hospital where she died. So
question does not arise about involvement of petitioners in dowry death.
Having regard to the facts and circumstances of the case, in
the event of arrest or surrender within a period of one month from the
date of receipt/production of a copy of this order, above named
petitioners shall be released on bail on furnishing bail bond of
Rs.10,000/-(Ten thousand) each with two sureties of the like amount
each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in
connection with Mojahidpur(Babarganj) P.S. case no.121 of 2009
,subject to the conditions as laid down under section 438(2) of the Code
of Criminal Procedure.
