2/ 18.03.2011 Heard learned counsel for the parties.

The petitioner is an accused in a case under Sections 341,

324, 307/34 of the Indian Penal Code and 27 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected on

28.09.2010 with an observation to renew his prayer for bail after four

months.

The informant alleged that one of two motorcycles borne

miscreants fired at him.

Learned counsel for the petitioner submits that though the

injury was grievous but it was on the right fore-arm. Learned counsel

for the petitioner submits that petitioner is in custody for more than one

year and four months.

Counsel for the State opposes the prayer for bail.

In the circumstances, petitioner, named above, is directed

to be released on bail on furnishing bail bond of Rs. 5,000/- (Five

thousand) with two sureties of the like amount each to the satisfaction

of Additional Sessions Judge, Fast Track Court No.-IV, Bettiah, West

Champaran in connection with Chanpatia P.S. case no.17 of 2009 (S.T.

No. 187 of 2010), with the condition that he will not physically absent

for two consecutive dates at stretch, till three witnesses are examined.
