JUDGMENT
Challenge is against the recovery steps initiated for
realising contributions due to the Kerala Motor Transport
Workers Welfare Fund. The respondent had filed a
detailed statement answering the dispute raised with
respect to correctness of the liability. Eventhough the
petitioner had filed a reply affidavit there is nothing to
indicate that the petitioner is not liable for payment of the
amount demanded.
2. However, this Court was inclined to grant an
interim stay against further steps of recovery initiated on
the basis of Ext.P5 notice, for a period of one month,
subject to condition of the petitioner remitting a sum of
Rs.40,000/-. The above said interim order was issued on
16.11.2010 stipulating such payment to be made within
three weeks thereof. Inspite of several adjournments
thereafter, it is reported that, the petitioner has not

complied with the condition. There is no representation for
the petitioner when the case was taken up for consideration
on today.
Under the above circumstances, the Writ Petition is
dismissed.
