We have heard learned counsel for the petitioner and learned standing
counsel appearing for respondents.
The District Magistrate, Chitrakoot by his letter dated 23.2.2010 has
made a recommendation to the State Government for granting mining
lease in favour of the petitioner but no order has not yet been passed
by the State Government in granting approval or disapproval.
This petition is disposed of with a direction to the State Government to
pass appropriate orders on the recommendation made by the District
Magistrate dated 23.2.2010, annexure-3 to the writ petition within a
period of one month from the date certified copy of this order is
produced before respondent no.1
The State Government shall also consider the order dated 15.6.2010
passed by the division bench in civil misc. writ petition no.34910 of
2010 Vikas Agarwal vs. State of U.P. and others.
