Heard Sri S.K.Verma, learned counsel for the petitioner and Sri
Banwari Lal Maurya, learned counsel for the opposite parties.
This is a review petition. It has been informed by the petitioner
counsel that due to typing mistake the wrong order was transcribed
in this writ petition.
Accordingly, the order is corrected. Now the following order is
passed:-
The petitioner has challenged the suspension order dated
25.6.2010. The reason for suspending the petitioner has been given
in the suspension order itself. It has been stated that the petitioner
has been suspended for getting involved in the dispute between
one Manoj Kumar and Jitendra Kumar,Typist. Petitioner has
drawn the attention of the court to the fact that Jitendra Kuamr
who was involved in the dispute has been reinstated on 27.2.2009
itself. The petitioner has been placed under suspension after one
and half years of an incident which took place on 13.1.2009.
This court does not find any good reason to place the petitioner
under suspension while Jitendra Kumar the main culprit has been
reinstated in this regard.
Sri Banwari Lal Maurya, learned Standing Counsel for opposite
party nos. 1 & 2 prays for and is granted four weeks’ time to file
counter affidavit. Rejoinder affidavit, if any may be filed in a
week. List thereafter.
Meanwhile, the operation and implementation of the order dated
25.6.2010 so far it places the petitioner under suspension shall
remain stayed. The inquiry, if any shall go on.
