Heard the learned counsel for the applicant and the learned A.G.A.
for the State.

It is argued by the learned counsel for the applicant that the
similarly placed co-accused Rakesh Singh has been granted bail by
an earlier order dated 21.1.2010 passed by this Court and the case
of the applicant cannot be distinguished from the case of the co-
accused Rakesh.

Learned A.G.A. could not dispute this position, although he
opposed the prayer for bail.

Having heard the submissions of the learned counsel for the parties
and without expressing any opinion on the merits of the case, let
the applicant Krishnapal Singh, involved in Case Crime No. 581
of 2009, under sections 302/201/34 IPC, Police Station Bhojpur,
district Moradabad, be released on bail on his furnishing a personal
bond with two sureties each in the like amount to the satisfaction
of the Court concerned.
