The matter relates to the dispute of a cheque which 
according to the complainant, was dishonoured when 
submitted   in   the   Bank.   There   is   possibility   of 
amicable settlement  between the present applicants 
and the opposite party no.1.

Heard   learned   counsel   for   the   applicant,   learned 
A.G.A.   For   the   State   and   perused   the   relevant 
record.

It is therefore, directed that the applicant shall deposit 
a sum of Rs. 4000/­ with the Mediation Center of the 
High Court within three weeks from today. Out of this 
amount Rs. 3000/­ shall be paid to the opposite party 
No.   1   on   his   appearance   before   the   Mediation 
Center. 

The matter  is referred  to the Mediation  Center  with 
the   direction   that   the   matter   shall   be   decided   after 
giving notices to both the parties. 
It is further  directed  that the Mediation  Center  shall 
dispose of the matter as early as possible preferably 
within a period of three months. Thereafter, the case 
will   be   listed   before   the   appropriate   Bench   on 
28.4.2010, without treating the same as part heard.
As an interim measure it is provided that no coercive 
action   shall   be   taken   against   the   applicant   in   case 
No.1508/09, Yogesh Vs. Kuldeep, under Section 138 
Negotiable   Instrument   Act,   PS   Kotwali   Fatehgarh, 
District   Farrukhabad,pending   in   the   court   of   Chief 
Judicial Magistrate,Hawali, Farrukhabad,provided the 
applicants   produce   the   receipt   of   the   aforesaid 
amount deposited in the Mediation Center before the 
Court concerned.

The  notices  shall  be  issued  to the parties  after  the 
deposit of the aforesaid amount and if the amount is 
not   deposited   within   the   prescribed   period,   the 
interim   measure   granted   above   shall   stand 
automatically vacated.

The application is accordingly disposed of.
