4. 2.7.2010 Heard Learned counsel for the petitioner and the State.

Misappropriation/embezzlement of rupees one lac is denied

on the ground that petitioner had no hand in withdrawal of the amount

as not being drawing/disbursement authority. He was suspended, given

show-cause, replied and satisfied thereon his suspension was

withdrawn. There is no specific allegation showing mode of

misappropriation by this petitioner.

Having regard to the facts and circumstances of the case, in

the event of arrest or surrender within a period of one month from the

date of receipt/production of a copy of this order, above named

petitioner shall be released on bail on furnishing bail bond of

Rs.10,000/-(Ten thousand) with two sureties of the like amount each to

the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua, in

connection with Mohania P.S. case no.80 of 2004 ,subject to the

conditions as laid down under section 438(2) of the Code of Criminal

Procedure.
