: Anticipatory bail application filed by petitioner Mosarrat
Johan @ Musarrat Jahan @ Mussarraf Jahan is moved by Sri. Jitendra S.
Singh and opposed by Sri. S.K. Srivastava , learned Additional P.P. and
Sri. K.P. Choudhary, learned counsel for the O.P. No. 2.
It appears that parties have amicably settled their dispute
out side the court and executed a deed of mutual agreement.
Learned counsel for the O.P. No. 2 submitted that in
terms of said agreement, he has received one cheque and in due
course he will receive other money.
In view of the above compromise, I allow this application
and direct the petitioner to surrender in the court below by 04.04.2011
and in that event the court below is directed to enlarge the petitioner,
above named, on bail on furnishing bail bond of Rs. 10,000/-(Ten
Thousand) with two sureties of the like amount each to the satisfaction
of Judicial Magistrate, Jamshedpur in connection with C/1 Case No.
1768 of 2010 , subject to the condition as laid down under section
438(2) of the Cr.P.C.
