CPIO is directed to provide information – show cause notice.
2. We heard this case through video conferencing. The Appellant was

present in our chamber. The Respondent was present in the Muzaffarpur
studio. We heard their submissions.
3. The Appellant had wanted to know the reasons for not crediting the
pension of a certain deceased person for a certain period. He was provided no
information. Even after he filed his appeal and the Appellate Authority directed
the CPIO to provide the information, no information was disclosed. Besides, the
Indian postal order enclosed by him with his RTI application as application fee
was dishonoured and he was compelled to pay the amount through a demand
draft. For both these acts, namely, not honouring the Indian postal order as
application fee and not providing the information, the then CPIO is liable for
imposition of maximum penalty of Rs. 25,000. However, before imposing any
such penalty, we would like to hear his explanation. We, therefore, direct that a
copy of this order be forwarded to the officer who was the CPIO at the relevant
time and that officer should appear before the Commission (Room No.306, 2nd
Floor, ‘B’ Wing, August Kranti Bhawan, Bhikaji Cama Place, New Delhi –
110 066) on 10 February 2011 at 3.00 p.m. to explain if he had a reasonable
cause for his action. If he fails to appear and offer any satisfactory explanation,
we will proceed to impose the maximum penalty on him.
4. We also direct the present CPIO to provide to the Appellant within five
working days from the receipt of this order the desired information without fail.
The appeal is disposed off accordingly.
5. Copies of this order be given free of cost to the parties.
