02/ 18.03.2011 Heard learned counsel for the petitioner and learned

counsel for the respondents.

2. This writ petition has been filed by the petitioner for

directing the respondents to immediately pay the amount of

Rs.3,90,488.00 with interest against the bill for articles already

supplied by the petitioner to the respondent-Building Construction

Department, Govt. of Bihar, Patna for the use of office and

residential office of the Minister Building Construction

Department, Bihar, Patna for the year 2004-2008 which has been

admitted by the authorities and for other ancillary reliefs.

3. Considering the facts and circumstances as well as

the arguments made by learned counsel for the parties, this writ

petition is disposed of with a liberty to the petitioner to approach

the Chief Engineer (South), Building Construction Department,

Govt. of Bihar, Patna (respondent no.4) for payment of the

aforesaid dues with interest. If such an application is filed by the

petitioner along with a copy of this order within fifteen days from

today before the said authority, it shall decide the same within two

months thereafter and all the admitted dues and interest must be

paid to the petitioner immediately thereafter. If the said respondent

did not find any portion of the dues or interest, he shall pass a

speaking order with respect thereto within the aforesaid time so

that petitioner may challenge the same before the appropriate

authority.
