From the perusal of the record, it appears that starting from 1.12.2009 the
respondents State Authorities have been granted indulgence allowing time to
file counter affidavit on 25.1.10, 25.3.10 and 3.7.10 but they have not
responded so far.
Learned Standing Counsel is also not able to tell as to why he has not received
any instructions in the matter.
In the circumstances, I direct all the respondents to appear before his Court on
31.8.2010, on which date they shall explain as to why despite of so many
opportunities, they have not responded in the matter by filing counter
affidavit. It is really unfortunate that in most of the cases it is on account of
inaction of the State authorities by not responding to the notice of the court
and filing reply that the cases are not being decided expeditiously and arrears
are piling up.
List on 31.8.2010. However in case the respondents file counter affidavit by
27.8.2010 and pay a cost of Rs.15,000/- to the petitioner, they may not appear
in person.
Interim order to continue till then.
A copy of this order be made available to the learned Standing Counsel Sri
A.K.Srivastava within 48 hours for communication to the respondents for
information and compliance.
