Heard learned cousnel for the petitioner.
By this writ petition, the petitioner has prayed for a mandamus
directing the Civil Judge (Senior Division), Ballia, to decide the
Civil Suit No. 101 of 1999.
Petitioner’s case is that the petitioner is plaintiff in the suit and in
spite of his being prosecuting the suit, written statement has not
been filed by the defendants. It is further submitted that there was
an order passed by the trial court for ex pare proceeding. Be that as
it may, it is open for the petitioner to make request to the same
court for early disposal of the suit. No direction at this stage, as
prayed for, can be issued.
With aforesaid direction, the writ petition is disposed of.
