Case :- BAIL No. - 550 of 2010

Petitioner :- Ram Dularey @ Buddhu
Respondent :- State Of U.P.
Petitioner Counsel :- Dhananjai Kumar Singh
Respondent Counsel :- Govt. Advocate

Hon'ble Ashwani Kumar Singh,J.

Heard learned counsel for the applicant, the learned Additional
Government Advocate and perused the F.I.R. and other relevant
papers on the record.

The submission of the learned counsel for the applicant is that, as
alleged, the accused-applicant was commercially using electricity with
the help of ‘Katia’. It is further submitted by learned counsel for the
applicant that the allegations so levelled against the applicant are false
and frivolous and the applicant has falsely been roped in the present
case for not obliging the complainant. It is further alleged that the
complainant had demanded some illegal gratification from the accused-
applicant which he could not fulfil, as such this F.I.R. came to light. The
applicant is in jail since 4.1.2010 as averred in para 17 of the
application.

Considering the facts and circumstance of the case, I direct that the
applicant be released on bail in case Crime No.1928/2009 u/s 135
Electricity Act,2003 (The Electric Act 2003) P.S. Hasanganj District
Unnao on his filing a personal bond and two sureties each in the like
amount to the satisfaction of the court concerned/remand Magistrate.
