I.P.C.
It is submitted by learned counsel for the
petitioner that petitioner’s name surfaced on the basis
of the statement of the police spy and no recovery has
been made from the petitioner nor petitioner has any
criminal antecedent which also gets reflected though
report at Flag-A.
Learned counsel for the State submits that in
the case diary there is no direct material against the
petitioner.
Considering the fact that there is no direct
material against the petitioner and he has no criminal
antecedent, let the petitioner namely Satyanarain Sahu
@ Satyanarain Sah be released on bail on furnishing
bail bond of Rs. 10,000/-(ten thousand) with two
sureties of the like amount each to the satisfaction of
Judicial Magistrate, Birpur(Supaul) in connection with
Nirmali P.S. Case No. 48 of 2009.
