There is an illness slip of Sri L.K.Tripathi, learned counsel for the
petitioner.
The adjournment is opposed by Sri B.S.Pandey, learned counsel
for the respondents. Sri Pandey has referred to the order-sheet of
this writ petition, since the year 2004 to point out that after
obtaining an interim order, the counsel for the petitioner was
repeatedly sending illness slip and ultimately this Court had
imposed cost of Rs. 1,000/- on the petitioner by order dated
20.3.2008 (order-sheet), who was not filing rejoinder affidavit
also. Sri Pandey has referred to the order dated 23.5.2008 (order-
sheet) to state that due to repeated illness slip sent by Sri
L.K.Tripathi, learned counsel for the petitioner, this Court clarified
that the interim order was not in operation after 23.2.2006 and as
such there is no interim order operating in this writ petition at
present. Again illness slip was sent by learned counsel for the
petitioner on 23.7.2010 and today again an illness slip has been
sent by learned counsel for the petitioner.
Learned counsel for the respondent states that by the impugned
order the matter has been remanded but the proceeding are held up
after remand and are pending before the court below.
In view of the aforesaid circumstances, office is required to issue
notice to the petitioner to engage a new counsel, since counsel
appears to be perpetually ill and is not able to conduct this writ
petition. The notice should indicate a date for appearance and the
matter be listed on such date.
