Heard learned counsel for the applicant, learned counsel for the
complainant, learned A.G.A. and perused the entire record of the
case.

The submission of learned counsel for the applicant is that the
allegation against accused applicant is that since the deceased
had no issue, as such, the applicant along with her daughter
Malti and co-accused Ram Samujh, husband of the deceased,
used to torture. It is specifically alleged that applicant used to
call the deceased ‘banjh. The deceased could not resist the
harassment and she committed suicide. It is contended that
initially, when the brother of the deceased informed the police
regarding the death of the deceased, there was absolutely no
such allegation, but in the statement u/s 161 Cr.P.C., which was
recorded after about two months allegation of harassment finds
place.

Considering the facts and circumstances of the case and also
that the applicant is a lady, I hereby direct that the applicant be
released on bail in Case Crime No.90 of 2010, under Section 306
IPC, P.S. Baundi, District Bahraich, on her filing a personal bond
and two sureties each in the like amount to the satisfaction of the
court concerned/remand Magistrate.
