2 23.8.2011 Petitioner is an accused in a case under Section 376 of the

Indian Penal Code.

The allegation against the petitioner is that he is said to

have raped the informant in broad day light at 11 a.m. The informant

was sleeping in her house built under the Indira Awas Scheme. Her

neighbour, the petitioner is said to have raped her.

Learned counsel for the petitioner submits that the

occurrence seems to be improbable as the father-in-law of the

informant was sleeping close by in the Palani of the house. There is

also previous enmity which would be apparent from Annexure-2.

Annexure-2 indicates that there was some dispute between the

informant regarding the animals destroying the vegetable field of the

petitioner.

Considering the fact that the petitioner has remained in

custody since 6.1.2009, I direct that he (Sujit Kumar) be released on

bail in connection with Sinha (Barahara) P.S. Case No. 184 of 2008,

Corresponding to Sessions Trial No. 203 of 2009 on furnishing bail

bond of rupees ten thousand with two sureties of the like amount each

to the satisfaction of the Fast Track Court No. III, Bhojpur at Arrah.
