Counter affidavit filed today on behalf of the respondent no. 1, is taken on
record.

Heard learned counsel for the applicant and learned AGA and perused the
record.

The learned counsel for the applicant submitted that it is a case of theft of
electrical energy. Co-accused Radhey Shyam Pandey, who is the father of the
applicant, has been enlarged on bail by the Special Judge (E.C. Act), Gonda
vide the order dated 18th May 2010. It is further submitted that the applicant
is not named in the FIR, which was lodged against Sushil Pandey only.

There does not appear to be any reasonable ground to believe that the
applicant will tamper with the witnesses or abscond, if released on bail.

Keeping in view the nature of the offence, evidence, complicity of the
accused, the severity of the punishment and submissions of the learned
counsel for the applicant and the learned AGA, I am of the view that the
applicant has made out a case for bail.

Let the applicant Sunil Kumar Pandey involved in Case Crime No. 103 of
2010, under sections 135 of the Indian Electricity Act, P.S. Tarabganj, District
Gonda be released on bail on his furnishing a personal bond and two sureties
each in the like amount to the satisfaction of the court concerned.
