Heard learned counsel for the revisionists and learned A.G.A. for
the State.

Learned counsel for the revisionist states that it is a matrimonial
dispute and prays that the matter may be referred to the Mediation
Centre.

It is directed that revisionist shall deposit a sum of Rs.8,000/-
within a period of three weeks from today with the Mediation &
Conciliation Centre. Out of which Rs.2000/- shall be given to the
Mediation Centre and Rs.6,000/- shall be given to opposite party
No.2 i.e. wife for her to and fro journey.

Let this order be placed before the Registrar/Incharge of
‘Allahabad HIgh Court Mediation and Conciliation Centre’. The
Registrar/ Incharge of the Mediation Centre shall fix a date and
every efforts shall be made for re-conciliation and complete the
process of mediation within two months from today. In the event,
the effort is not successful, the case will be listed after two months,
along with report of conciliator.

Till the next date of listing, operation of the impugned order dated
23.11.2009 passed by Addl. C.J.M. Court No.2, Aligarh in Case
Crime No. 7189 of 2009 under section 406 I.P.C. and 3/4 D.P.Act
shall remain stayed. In the event revisionist fails to appear before
Mediation Centre on the first date, the interim order shall stand
automatically vacated.
